TITLE: APPEALS OF CANNACRUZ, INC. FROM THE SALINAS PLANNING COMMMISSION’S DENIAL OF CONDITIONAL USE PERMIT 2022-048 AND FROM THE SELECTION COMMITTEE’S DENIAL OF A MAJOR AMENDMENT TO COMMERCIAL CANNABIS PERMIT 2023-007 RECOMMENDED MOTION:
It is recommended that the City Council approve a Resolution granting CannaCruz, Inc.’s appeals from the Planning Commission’s denial of Conditional Use Permit 2022-048 and from the Selection Committee’s denial of a major amendment to Commercial Cannabis Permit 2023-007 related to the relocation of CannaCruz from 1156 Abbott Street to 1228 South Main Street.
EXECUTIVE SUMMARY:
On June 18, 2024, the City Council heard appeals from CannaCruz, Inc. from the Planning Commission’s denial of Conditional Use Permit 2022-048 and from the Selection Committee’s denial of a major amendment to Commercial Cannabis Permit 2023-007. Following a duly-noticed public hearing at which all those wishing to be heard were allowed to speak or present written comments and other materials, the City Council directed staff to prepare a resolution consistent with the City Council’s direction and findings. After consideration of the reports (written and oral), documents, testimony, and other materials presented, the City Council granted CannaCruz, Inc.’s appeals and Conditional Use Permit 2022-048 and a major amendment to Commercial Cannabis Permit 2023-007 allowing for CannaCruz, Inc. to relocate a dispensary with associated delivery and distribution from 1156 Abbott Street to 1228 South Main Street. A draft conditional use permit and a draft commercial cannabis permit are attached to this report for reference. Both will be updated consistent with the resolution and the City Council’s findings, determinations, and conditions.
STRATEGIC PLAN INITIATIVE:
An increase to the City Council’s compensation would support the City Council’s Goal of an effective and culturally responsive government.
DEPARTMENTAL COORDINATION:
The City Attorney’s Office and Community Development Department coordinated on this Report, Resolution, and draft Conditional Use Permit and Commercial Cannabis Permit.
FISCAL AND SUSTAINABILITY IMPACT:
Approval of the resolution would not have a direct impact on the City’s General Fund other than from the continued tax revenue to be generated by CannaCruz, Inc. from business operations at the new location.
