AMENDMENT NO. 1 TO
Monte Bella Maintenance District
AGREEMENT BETWEEN
SMITH & ENRIGHT LANDSCAPING, INC., AND CITY OF SALINAS
This Amendment No. 1 to the Monte Bella Maintenance District Agreement is entered into this ____ day of June 2024, by and between the City of Salinas (the “City”) and Smith & Enright Landscaping, Inc., (the “Contractor”). City and Contractor may be individually referred to herein as a “Party” and collectively the City and Contractor may be referred to as the “Parties.”
RECITALS
WHEREAS, the City and Contractor first entered into an agreement for Monte Bella Maintenance District effective June 22, 2021, pursuant to which Contractor agreed to act as and provide certain services to the City for compensation (the “Agreement”); and WHEREAS, pursuant to Resolution #-No. 22149 (N.C.S.) the City Council awarded an agreement to Contractor for a three (3) year term, with the option for an additional two (2) year term with an inflation rate increase per the ENR Cost Index; and WHEREAS, on February 15, 2024, Contractor submitted a written request to exercise the option for an additional two (2) year term with the request of the ENR Cost Index of 5% or less. The new cost for Monte Bella Maintenance District will increase $312.00 monthly from $6,240.00 to $6,552.00 per month.
NOW, THEREFORE, in mutual consideration of the terms and conditions set forth below, the Parties agree as follows:
TERMS
The term of the Agreement is hereby extended for a two-year period commencing on July 1, 2024, and ending on June 30, 2026.
The total amount of compensation to be paid by the City to the Contractor under the Agreement is hereby increased by $312.00 per month to $6,552.00 per month, for a total amount of annual compensation not to exceed $78,624.00.
All other covenants, terms, and conditions set forth in the Agreement and not amended by this Amendment No. 1 shall remain in full force and effect as if fully set forth herein.
IN WITNESS WHEREOF, the undersigned, as authorized representatives of the City and Contractor have entered into this Agreement as of the date first written above.
