PROPOSAL AND CONTRACT
CONTRACTORS AGREES TO PROVIDE THE FOLLOWING: 1 of City Hall Prevailing:
Total 1 – 18’ x 8’6” Custom California style single slide gate (UL325).
Total 2 – Steel assemblies with slide gate hardware.
Total 1 – 3’ x 8’ Custom Apache pedestrian gate with expanded metal.
Total 2 – Steel assemblies with swing gate hardware.
Total 1 – CODE LOCK CL610BB-BS mechanical lock, double sided (ped gate).
Total 18’ running feet, Custom Apache style fence net 8’ high with expanded metal.
Total 230’ running feet, Custom Railing net 16” high.
Total 1 – LiftMaster CSL24U DC Commercial slide gate operator on ped with 5 year warranty, (note, this operator continues to operate in a power failure / see spec’s) Total 1 – Enforcer Sk-1323-SDQ, PP mc-c5-06 Access keypad and steel pedestal.
Total 1 – BEA LZR-H100 Lazer scanner, 1/safety, 1/free exit, (see spec’s).
Total 2 – LiftMaster 5' Safety edges bumper, (see spec’s/ UL325).
Total 2 – LiftMaster Edge Safety Reversing Transmitter, (see spec’s/ UL325).
Total 1 – LiftMaster Edge Safety Reversing Receiver, (see spec’s/ UL325).
Total 1 – LiftMaster photo eye, 1/safety, (UL325).
Total 1 – LiftMaster Radio Receiver.
Total 1 – Knox KS2 Key Switch, fire dept/emergency vehicle access.
Installation includes all the above.

Contractor will contact USA Underground Service Alert and have all underground public utilities marked out prior to commencing work. Contractor will endeavor to prevent damage to any underground utilities, customer-owned utilities, and sprinkler pipes but contractor is not responsible for any damage should it occur. Gate measurements listed above are approximate and accurate specifications and elevations will be determined after the ground-breaking phase of the project is complete. Therefore, gate fabrication will not begin prior to the ground-breaking phase.

Should the owner, at the time, desire alterations, deviations, additions, to or omissions from this contract, specifications, or plans, contractor shall be at liberty to order them and the amount thereof shall be added to or deducted from the contract price but said alterations, deviations, additions, or omissions, shall be furnished to contractor in writing.
PAYMENTS TO BE MADE AS FOLLOWS: (Net 10 days)
CCOI accepts: checks, money orders, Visa & MasterCard payments. There is an additional 2% transaction fee on all credit card transactions.
1. Twenty Five Percent (25%) of contract price to be paid to contractor as a deposit and for material acquisition at the time of contract signing. When CCOI receives the signed contract and check we will then schedule the installation date.
2. Twenty Five Percent (25%) of contract price to be paid to contractor at the time that work is started (ground-breaking phase).
3. Twenty Five Percent (25%) of contract price to be paid to contractor as material acquisition when the gates go into fabrication.
4. Twenty Five Percent (25%) of contract to be paid to contractor at the time of completion.
Any change orders, alterations, or additions to scope of work will be paid immediately upon acceptance of customer and contractor. If there are any outstanding draw balances on the customer’s account, contractor will not schedule additional phases. In the event there is any dispute hereunder CCOI shall be entitled to recover attorney’s fees plus cost, including attorney’s fees and cost for appeal and collection of any judgment obtained. Attorney fees and costs for wrongful withholding of progress payments declare that prevailing party is entitled to attorney’s fees and costs.

If bills not paid in full of the labor, services, equipment, or materials furnished or to be furnished, a mechanics lien leading to the loss, through court foreclosure proceedings, of all or part of your property being so improved may be placed against property even though you have paid your general contractor in full. You may wish to protect yourself against consequence by (1) requiring your contractor to furnish a signed release by the person or firm giving you the notice before making payment to your contractor or (2) any other method or device that is appropriate under the circumstances.
WARRANTY:
Operator: 5 Year Manufacturer’s Warranty.
Keyless entry: 2 Year Manufacturer’s Warranty.
Contractor warranties parts and workmanship for 1 year.
It is the strong recommendation of the contractor that following installation this gate system be maintained on a regular basis, in order to insure long life and keep the materials and equipment in proper working order. The written warranties are in no way to imply that contractor or manufacturer accepts any liability for the misuse or outside damage and strongly encourages customers to carry liability insurance on their gate systems.
