Tow Service Franchise Agreement
Amendment No. 1
This Amendment to the FY 2023/2024 Tow Service Franchise Agreement is entered into this ____ day of June, 2024, by and between the City of Salinas, a California charter city and municipal corporation hereinafter referred to as the “City,” and __________________________, hereinafter referred to as the “Franchise Tow Company.” WHEREAS, the City of Salinas, through its Police Department, manages a rotational tow program to support the Police Department’s operations and enforcement of the law; and WHEREAS, the Franchise Tow Company provides service to the Salinas Police Department pursuant to a franchise issued by the City and a Tow Service Franchise Agreement entered into between the City and the Franchise Tow Company; and
WHEREAS, the City and the Franchise Tow Company last entered into a Tow Service Franchise Agreement in June 2023, which agreement is set to expire on June 30, 2024 (the “FY 2023/2024 Tow Service Franchise Agreement”); and WHEREAS, the City and the Franchise Tow Company desire to extend the FY 2023/2024 Tow Service Franchise Agreement in order for the City and the Franchise Tow Company to continue working to resolve outstanding issues related to the City’s rotational tow program.
NOW, THEREFORE, the City and the Franchise Tow Company desire to amend the FY 2023/2024 Tow Service Franchise Agreement as follows:
The Term of the FY 2023/2024 Tow Service Franchise Agreement is hereby extended through August 23, 2024.
All other covenants, terms, and conditions of the FY 2023/2024 Tow Service Franchise Agreement not specifically amended herein shall be fully incorporated herein by this reference and shall remain in full force and effect through the term of this Amendment.
