RESOLUTION NO. (N.C.S.)
A RESOLUTION AUTHORIZING AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF SALINAS AND WALLACE GROUP.
WHEREAS, on December 14, 2021, City Council approved Resolution 22269 (N.C.S.) approving an Agreement for Professional Services between the Wallace and the City of Salinas for engineering services to update the Stormwater Master Plan in the amount of $800,000; and WHEREAS, on March 27, 2023, Amendment No. 1 was signed to extend the contract term expiration date to December 31, 2023; and WHEREAS, on September 21, 2023, Amendment No. 2 was signed to extend the contract term expiration date to August 31, 2024; and WHEREAS, on June 28, 2024, Amendment No. 3 was signed to extend the contract expiration date to May 31, 2025; and WHEREAS, California Government Code Sections 66000-66008 (Mitigation Fee Act) provide local jurisdictions with the authority to impose fees on development projects to cover all or a portion of the cost of public facilities affected by the project; and WHEREAS, the Mitigation Fee Act requires a nexus study to periodically re-evaluate development impact fees; WHEREAS, in order to update current service fees, a nexus study to analyze the land use and project data of the updated Stormwater Master Plan to develop a fee based on building area consistent with Assembly Bill 602 needs to be completed; and WHEREAS, Amendment 4 will add additional scope of services of $47,750 to complete this study.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SALINAS, that Amendment No.4 to the Professional Services Agreement between the City of Salinas and Wallace Group to provide a nexus study on the City’s Stormwater Development Impact Fees in the amount of $47,750 with a period of one (1) one-year annual Agreement extension option, is hereby approved; and BE IT FURTHER RESOLVED that the City Council authorizes the allocation of $47,750 from 3911.50.8192, American Rescue Plan Act (ARPA) Green Infrastructure, and BE IT FURTHER RESOLVED that the City Manager of Salinas is hereby authorized to execute Amendment No. 4 and any other non-substantive modifications to the Agreement as necessary.
