CALIFORNIA GOVERNMENT CODE §84308 - LEVINE ACT
Government Code § 84308. Parties to any proceeding involving a license, permit or other entitlement for use pending before the City Council must disclose any campaign contributions over $250 (aggregated) within the preceding 12 months made by the party, their agent, and those required to be aggregated with their contributions under Government Code § 82015.5. The disclosure must include the amount contributed and the name(s) of the contributor(s).

ID#24-509 Sanitary Sewer Development Impact Fee Update Amendment Received report from Public Works Director David Jacobs regarding amending the Sanitary Sewer Development Impact Fee approved by City Council through Resolution No. 22942. The Sanitary Sewer Development Impact Fee schedule erroneously included the term “per 1000 square foot” instead of “per square foot” for the commercial and industrial fees. The updated fee shall be effective December 1, 2024. Report filed with the City Clerk as the official record.

Received report from Kimley Horn and Associates Fredrik Venter regarding the City's update to the current bicycle and pedestrian plans which were developed in the early 2000s. The 2024 Active Transportation Plan is intended to create an accessible, high-quality network of walking and biking routes that connect all neighborhoods within the city. The 2024 Active Transportation Plan identifies transportation needs and prioritizes projects that will make walking and biking reliable, comfortable, convenient, and more connected for all users. RECOMMENDED MOTION:
A motion to approve a resolution:
1) Authorizing the City Manager to execute First Amendment with Brightview Landscape Service, Inc. for Harden Ranch Maintenance District and Mira Monte, Airport, and Woodside Maintenance District;
2) Increasing the compensation for Harden Ranch Maintenance District by $5,000 for a revised not to exceed amount of $76,000 to cover unscheduled/extra work; and 3) Increasing the compensation for Mira Monte, Airport, and Woodside Maintenance Districts to increase the compensation by $15,700 for a revised not to exceed amount of $84,719 to cover unscheduled/extra work.
EXECUTIVE SUMMARY:
This Amendment will allow the City Manager to execute any unscheduled/extra work cost increases in Harden Ranch Maintenance Districts Agreement. The initial unscheduled/extra work increase will be $5,000 and may change with in the yearly service due to the unpredictability of unforeseen landscape issues that may arise. The revised not to exceed amount for unscheduled/extra work and the current Agreement for annual compensation will be $76,000.
This Amendment will also allow the City Manager to execute any unscheduled/extra work cost increases in Mira Monte, Airport, and Woodside Maintenance Districts Agreement. The initial extra work increase will be $15,700 and may change with in the yearly service due to the unpredictability of unforeseen landscape issues that may arise. The revised not to exceed amount for unscheduled/extra work and the current Agreement for annual compensation will be $84,719.

BACKGROUND:
On June 25, 2024, City Council approved the contract agreements for Landscape Maintenance with Brightview Landscape Service, Inc. for Harden Ranch Maintenance District and Mira Monte, Airport, and Woodside Maintenance District. The total amount of annual compensation for Harden Ranch Maintenance District was not to exceed $71,000 and Mira Monte, Airport, and Woodside Maintenance District annual compensation not to exceed is $69,019 but the unscheduled/extra work was not included in the agreement’s not to exceed total. Unscheduled, extra work was verbalized as an item in the original proposal. Unscheduled extra work would include unpredictable issues or events that happen such as down trees or branches that cause obstruction or hazards to the public. Staff is recommending that the two totals be combined and allowed to be approved to continue the landscape service as needed.
CEQA CONSIDERATION:
Not a Project. The City of Salinas has determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CEQA Guidelines Section 15378).
In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.
CALIFORNIA GOVERNMENT CODE §84308 APPLIES:
No, this contract does not apply to Government Code §84308/Levine Act.
STRATEGIC PLAN INITIATIVE:
The Landscape Maintenance Service Contract for the Maintenance Districts relates to the Council’s Strategic Goal of Infrastructure and Environmental Sustainability.
DEPARTMENTAL COORDINATION:
Public Works Department has been coordinating with the City’s Finance and Legal Departments to ensure compliance with standards as well as all fiscal elements are being met.

AIRPORT, AND WOODSIDE MAINTENANCE DISTRICTS
WHEREAS, the City and Contractor first entered into an agreement for Harden Ranch Maintenance District and Mira Monte, Airport, and Woodside Maintenance District effective June 18, 2024, pursuant to which Contractor agreed to act as and provide certain services to the City for compensation for unscheduled/extra work (the “Agreement”); and WHEREAS, pursuant to Resolution #No. 23010 (N.C.S.) the City Council awarded an agreement to Contractor to include unscheduled/extra work compensation for unforeseen landscape issues that may arise in the Harden Ranch Maintenance District and Mira Monte, Airport, and Woodside Maintenance Districts; and
WHEREAS, the Amendment will allow the City Manager to execute the First Amendment for unscheduled/extra work cost increases in Harden Ranch Maintenance Districts Agreement. The initial unscheduled/extra work increase will be $5,000.00 and may change with in the yearly service due to the unpredictability of unforeseen landscape issues that may arise. The revised not to exceed amount for unscheduled/extra work and the current Agreement for annual compensation will be $76,000.00.
WHEREAS, the Amendment will allow the City Manager to execute the First Amendment for unscheduled/extra work cost increases in Mira Monte, Airport, and Woodside Maintenance Districts Agreement. The initial unscheduled/extra work increase will be $15,700.00 and may change with in the yearly service due to the unpredictability of unforeseen landscape issues that may arise. NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council approves additional compensation in the amount of $5,000 for unscheduled/extra work increasing the not to exceed amount in Harden Ranch Maintenance District to $76,000 and additional compensation in the amount of $15,700 for unscheduled/extra work increasing the not to exceed amount in Mira Monte, Airport, and Woodside Maintenance District to $84,719.

AMENDMENT NO. 1 TO
Harden Ranch Maintenance District
AGREEMENT BETWEEN
BRIGHTVIEW LANDSCAPE SERVICES, INC., AND CITY OF SALINAS This Amendment No. 1 to the Harden Ranch Maintenance District Agreement is entered into this 8 th day of October
2024, by and between the City of Salinas (the “City”) and Brightview Landscape Services, Inc., (the “Contractor”). City and Contractor may be individually referred to herein as a “Party” and collectively the City and Contractor may be referred to as the “Parties.”
RECITALS
WHEREAS, the City and Contractor first entered into an agreement for Harden Ranch Maintenance District effective June 18, 2024, pursuant to which Contractor agreed to act as and provide certain services to the City for compensation for unscheduled/extra work (the “Agreement”); and WHEREAS, pursuant to Resolution #-No. 223010 (N.C.S.) the City Council awarded an agreement to Contractor to include unscheduled/extra work compensation for unforeseen landscape issues that may arise in the Harden Ranch Maintenance District; and
WHEREAS, on October 8, 2024, the city amends this contract to allow unscheduled/extra work to be included to the annual compensation not to exceed amount of $71,000.00 per the contract agreement as well as granting the city manager authorization to execute all future amendment cost increases to this agreement.
NOW, THEREFORE, in mutual consideration of the terms and conditions set forth below, the Parties agree as follows:
TERMS
1. The total amount of compensation to be paid under the Agreement is hereby increased by $5,000 for a total amount of compensation not to exceed $76,000.
2. All other terms and conditions of the Agreement not specifically amended herein shall remain in full force and effect as originally written and are fully incorporated herein by this reference.
IN WITNESS WHEREOF, the undersigned, as authorized representatives of the City and Contractor have entered into this Agreement as of the date first written above.
