TITLE: FIRST AMENDMENT WITH SMITH & ENRIGHT LANDSCAPING, INC. FOR CITY-WIDE LANDSCAPE SERVICES RECOMMENDED MOTION:
A motion to approve a resolution:
Authorizing the City Manager to execute First Amendment with Smith & Enright Landscaping, Inc. for City-Wide Landscape Service for Greenbelts, Medians & Roundabouts; and Increasing the compensation by $120,400 for a revised not to exceed amount of $365,104.
EXECUTIVE SUMMARY:
This Amendment is for unscheduled/extra work cost increases to the City-Wide Landscape Service for Greenbelts, Medians & Roundabouts Agreement. The initial unscheduled/extra work increase will be $120,400 and may change due to the unpredictability of unforeseen landscape issues that may arise. The revised not to exceed amount for unscheduled/extra work and the current Agreement for annual compensation will be $365,104.
BACKGROUND:
On June 14, 2022, City Council approved a contract agreement for Landscape Maintenance for the City-Wide Landscape Services for Greenbelts, Medians & Roundabouts with Smith & Enright Landscaping, Inc. The total amount of annual compensation not to exceed is $244,704.00 but the unscheduled/extra work was not included in the agreement as a total amount but was included as an item in the original proposal. Unscheduled extra work would include unpredictable issues or events that happen such as down trees or branches that cause obstruction or hazards to the public.

Because the matter does not cause a direct or foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.
