AMENDMENT NO. 1 TO
Mira Monte, Airport, and Woodside Maintenance District
AGREEMENT BETWEEN
BRIGHTVIEW LANDSCAPE SERVICES, INC., AND CITY OF SALINAS
This Amendment No. 1 to the Mira Monte, Airport, and Woodside Maintenance District Agreement is entered into this 8th day of October 2024, by and between the City of Salinas (the “City”) and Brightview Landscape Services, Inc., (the “Contractor”). City and Contractor may be individually referred to herein as a “Party” and collectively the City and Contractor may be referred to as the “Parties.”
RECITALS
WHEREAS, the City and Contractor first entered into an agreement for Mira Monte, Airport, and Woodside Maintenance District effective June 18, 2024, pursuant to which Contractor agreed to act as and provide certain services to the City for compensation for unscheduled/extra work (the “Agreement”); and
WHEREAS, pursuant to Resolution #-No. 23010 (N.C.S.) the City Council awarded an agreement to Contractor to include unscheduled/extra work compensation for unforeseen landscape issues that may arise in the Mira Monte, Airport, and Woodside Maintenance District; and
WHEREAS, on October 8, 2024, the city amends this contract to allow unscheduled/extra work to be included to the annual compensation not to exceed amount of $69,019.00 per the contract agreement as well as granting the city manager authorization to execute all future amendment cost increases to this agreement.
NOW, THEREFORE, in mutual consideration of the terms and conditions set forth below, the Parties agree as follows:
TERMS
1. The total amount of compensation to be paid under the Agreement is hereby increase by $15,700 for a total amount of compensation not to exceed $84,719.
2. All other terms and conditions of the Agreement not specifically amended herein shall remain in full force and effect as originally written and are fully incorporated herein by this reference.
IN WITNESS WHEREOF, the undersigned, as authorized representatives of the City and Contractor have entered into this Agreement as of the date first written above.
