RESOLUTION NO. (N.C.S.)
A RESOLUTION OF THE SALINAS CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENTS TO AGREEMENTS FOR SERVICES WITH SMITH & ENRIGHT LANDSCAPING, INC. AND APPROVING AN INCREASE IN COMPENSATION FOR THE NORTH/EAST AND MONTE BELLA MAINTENANCE DISTRICTS WHEREAS, the City and Contractor first entered into an agreement for North/East Maintenance District and Monte Bella Maintenance District effective June 22, 2021, pursuant to which Contractor agreed to act as and provide certain services to the City for compensation for unscheduled/extra work (the “Agreement”); and WHEREAS, pursuant to Resolution No. 22149 (N.C.S.) the City Council awarded an agreement to Contractor to include unscheduled/extra work compensation for unforeseen landscape issues that may arise in the North/East Maintenance District; and WHEREAS, pursuant to Resolution No. 22149 (N.C.S.) the City Council awarded an agreement to Contractor to include unscheduled/extra work compensation for unforeseen landscape issues that may arise in the Monte Bella Maintenance District; and WHEREAS, the Amendment will allow the City Manager to execute this Amendment for unscheduled/extra work cost increases in North/East Maintenance Districts Agreement. The initial unscheduled/extra work increase will be $80,000.00 and may change with in the yearly service due to the unpredictability of unforeseen landscape issues that may arise. The revised not to exceed amount for unscheduled/extra work and the current Agreement for annual compensation will be $409,776.92.
WHEREAS, the Amendment will allow the City Manager to execute this amendment for unscheduled/extra work cost increases in Monte Bella Maintenance Districts Agreement. The initial unscheduled/extra work increase will be $20,000.00 and may change with in the yearly service due to the unpredictability of unforeseen landscape issues that may arise. The revised not to exceed amount for unscheduled/extra work and the current Agreement for annual compensation will be $98,624.00.
NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council approves additional compensation in the amount of $80,000 for the North/East Maintenance District thereby increasing the total not to exceed amount to $409,776.92 and additional compensation in the amount of $20,000 for the Monte Bella Maintenance District thereby increasing the total not to exceed amount to $98,624; BE IT FURTHER RESOLVED that the City Manager is authorized to execute amendments to the agreements to include unscheduled/extra work cost increases in North/East Maintenance District and Monte Bella Maintenance District Agreements.
