A. ADDITIONAL EFFORT REQUIRED FOR SALINAS CREEKS FLOOD CONTROL PROJECT This additional effort required is described below and shown for Tasks 1, 2, 4 and 5 in Attachment A.

This effort supports deliverables already included in the scope of work and the additional deliverables underlined below, as requested by the agencies.

UPPER NATIVIDAD CREEK AND UPPER GABILAN CREEK
• Extended Time Period and Additional Communications with City regarding Side Channel and Changing Project Design
• Project Design Conceptually Revised to reduce Project costs and Mitigation needs/costs • On-Site Meetings/Field Investigations to Revise Project Design and Conceptual Mitigation Plan • Virtual Meetings regarding the City of Salinas’s Changing Project Goals, Funding Availability, Revised Timing of Project Implementation, and Revised Conceptual Mitigation Plans • Additional Meetings with the Regional Board regarding the Changing Project Design (Pre-Filing Meeting #2) and 5-Year Management Plan (Pre-filing Meeting #3) • On
-going Meetings with City (2x/month for 6 months)
• Revise Project Description, Project Design Plans, Biological Assessment and Aquatic Resources Delineation Report, Impact Calculations (wetlands, waters, and riparian), and Permit Applications to Current Project Plan
• I
ncorporate /Edit Steelhead Critical Habitat Memo (prepared for Lower Gabilan – see below), and Prepare Southwestern Pond Turtle, and California Red-legged Frog (CRLF) Assessment and Incorporate into Permit Applications
• A dditional rounds of consultation with the Corps, Regional Board, and CDFW due to the issuance of permits for both one-time sediment removal and 5-Year maintenance (per October 29, 2024 meeting with Alia Ajina of the Regional Board).
• Formal consultation with NOAA Fisheries and US Fish and Wildlife Service regarding sensitive wildlife species (see also above bullet)
T
he beneficial results of these extra efforts and communications include:
• Obtaining a single permit for both One-time Sediment Removal (Channel Restoration) and 5-year Maintenance Activities (instead of two separate permits) to allow:
o on-going sediment removal at pinch points (bridges),
o tree limbing and pruning, and
o removal of large debris (fallen trees or limbs) from the main channel. • Substantial reduction in the amount and cost of mitigation through negotiations with the Regional Board staff to:
o eliminate the side channel and
o identify most impacts as temporary.

ITY OF SALINAS UNPERMITTED CLEARING OF RIPARIAN VEGETATION • Research, emails and phone calls with City staff regarding unpermitted clearing of riparian and wetland vegetation.

B. YEAR 1 ANNUAL MITIGATION MONITORING AND REPORTING
P
er the City’s request, to satisfy the Agency permit requirements, this new task includes Year 1 Annual Mitigation Monitoring and Reporting for the project work conducted at Upper Natividad Creek, Upper Gabilan Creek, and Lower Gabilan Creek (shown as Tasks X and Y in Attachment A).

C. CONTINGENCY FUND FOR AGENCY CONSULTATION
It
is notoriously difficult to predict the level of effort required during Agency Consultation because of different and changing agency representatives, their different interpretations of regulations and requirements, and on-going agency-wide changes in regulatory implementation and associated permit conditions. Therefore, we included a contingency fund as an optional item for the City’s consideration (shown as Task Z in Attachment A).
