TITLE: BORONDA ROAD CONGESTION RELIEF PROJECT PHASE 1, CIP 9510 - CCOs RECOMMENDED MOTION:
A motion to:
Approve Contract Change Order (CCO) No. 2 for the Boronda Road Congestion Relief Project Phase 1, CIP No. 9510 in the amount of $180,000; Approve 12% project contingencies in the amount of $1,876,536 for this project for a revised not to exceed construction costs of $17,514,332.93; and Authorize the City Manager to approve all change orders for this project.
EXECUTIVE SUMMARY:
The Boronda Road Congestion Relief Project (Project) proposes to widen East Boronda Road into a four-lane roadway (two-lanes at each direction) between Dartmouth Way and Independence Boulevard, and to construct roundabouts at McKinnon Street, El Dorado Drive, Natividad Road, and Independence Boulevard. The Project will be built in phases to accommodate funding availability.
The Boronda Road Congestion Relief Phase 1 Project (Phase 1 Project) will build the McKinnon roundabout with the associated improvements and was awarded to Granite Construction Company on June 18, 2024 (Resolution No. 23008 and 23053). Construction of the Phase 1 Project started on November 13, 2024.
CCO No. 2 in the amount of $180,000 is to accelerate the project to accommodate the Regional Water Quality Control Board (RWQCB) Permit restriction during winter work.
BACKGROUND:
The Boronda Road Congestion Relief Project (Project) proposes to widen East Boronda Road into a four-lane roadway (two-lanes at each direction) between Dartmouth Way and Independence Boulevard, and to construct roundabouts at McKinnon Street, El Dorado Drive, Natividad Road, and Independence Boulevard. In May 2017, City Council approved the roundabout concept at the intersections identified above along with Hemingway Drive (Resolution No. 21169). The Project is planned to be built in phases to accommodate funding availability. The Boronda Road Congestion Relief Phase 1 Project (Phase 1 Project) will build the McKinnon Roundabout and associated improvements from east of Dartmouth Way to a point between McKinnon Street and El Dorado Drive.
The Phase 1 Project will include:
Widening East Boronda Road from east of Dartmouth Way to east of El Dorado Dr from two lanes to four lanes; Constructing a multilane roundabout at McKinnon Street; Relocating the existing agricultural ditches along the north side of East Boronda Road north of the improvements; Constructing stormwater treatment facilities and bioretention facilities to mitigate runoff from the improvements; Constructing buffered bike lanes;
Constructing shared‐use paths at the roundabout;
Install a flashing beacon system at the pedestrian crossing; Constructing bus pullouts, street lighting, sidewalks, ADA-compliant pedestrian curb ramps at all crosswalks; and install storm drain lines, sanitary sewer mainline and extensions, and pavement delineation and street signs, and landscaping.
Design of the Phase 1 Project was completed in February 2024. The Phase 1 Project was awarded to Granite Construction Company on June 18, 2024 (Resolution No. 23008 and 23053). Construction of the project started on November 13, 2024 with the installation of Animal Exclusion Fence.
CCO No. 1 in the amount of $102,000 was approved for this project to change the type of temporary fencing to the Animal Exclusion Fence for California red-legged frog and California tiger salamander as specified by the California Department of Fish and Wildlife, and US Fish and Wildlife Service. CCO No 1 deleted the bid item for high visibility fence in the amount of $28,300 and reduced the amount of fiber rolls required. Thus, the net cost for CCO No. 1 will be under $70,000. The final cost will be determined after the installation of the fiber rolls.
CCO No. 2 in the amount of $180,000 is to accelerate the project to accommodate the Regional Water Quality Control Board (RWQCB) Permit during winter work restriction. Among the conditions listed by the RWQCB is accelerating the work to 10-hour shifts during weekdays and 8-hour shifts on Saturdays to complete the agricultural ditch portion of the work as soon as possible. Staff is requesting approval of this CCO No. 2 to accommodate RWQCB Permit.
The “Fiscal and Sustainability Impact” portion of the June 18th staff report included the estimated construction costs for the Phase 1 project as follows:
Construction Cost (Granite’s Bid)
$15,637,796.93
Contingencies (12%)
$1,876,536.00
Construction Management Services (MNS Engineers, Inc.)
$1,829,248.00
Construction Support – Design (Wallace Group)
$400,000.00
Administrative Overhead (2 years)
$100,000.00
City Staff Project Management (2%)
$312,700.00
Environmental Mitigation (Sparling Ranch) (Phase 1 & 2a) $608,300.00
Total Estimated Construction Costs
$20,764,584.93
Staff is requesting that the 12% contingencies in the amount of $1,876,536.00 be encumbered as a separate Purchase Order for Granite Construction Company for Contract Change Orders (CCOs), and staff is also requesting that the City Manager be authorized to approve all CCOs for this project. This action would help streamline the project’s construction activities timeline in case additional unforeseen issues may be encountered during the course of the project construction requiring CCOs.
CEQA CONSIDERATION:
The environmental impacts of the project have been analyzed in accordance with CEQA guidelines. An Initial Study (IS) was prepared to evaluate the potential impacts associated with the project. Based upon review of the IS, the proposed project will not have a significant effect on the environment because the mitigation measures outlined in the Mitigation Monitoring and Reporting Program (MMRP) have been included in the project.
A Mitigated Negative Declaration (MND) was prepared for this project pursuant to the provisions of CEQA, and on November 3, 2020, the Salinas City Council adopted and approved the MND and MMRP for the project.
In addition, the following Environmental Permits have been received for Phases 1 & 2 of the Project:
Central Coast Regional Water Quality Control Board (Water Board):
Section 401 Permit/Water Quality Certification was issued by the Water Board last October 2021.
US Army Corps of Engineers (USACE):
USACE Nationwide Permit (NWP) (for Phases 1 & 2) was received on May 9, 2023.
On April 24, 2023, a reinitiated Biological Opinion was issued by the US Fish and Wildlife Service, through the USACE consultation process. The reinitiated BO contains environmental measures to minimize effects to California red-legged frogs and California tiger salamanders.
A Consistency Determination dated September 22, 2023, was issued by the California Department of Fish and Wildlife. The Determination states that the Service’s incidental take statement and accompanying revised BO are consistent with the California Endangered Species Act (CESA).
CALIFORNIA GOVERNMENT CODE SECTION 84308 APPLIES:

STRATEGIC PLAN INITIATIVE:
The project addresses the City Council’s Strategic Goals of Infrastructure and Environmental Sustainability, and Economic Development.
DEPARTMENTAL COORDINATION:
The planning phase of this Project involved Public Works, Community Development, Finance, and Legal Departments. Public Works Department was the lead on this Project in close coordination with Community Development and Legal Departments in the review of the CEQA Documents, and there has been an extensive and iterative coordination effort between West Area Specific Plan, Central Area Specific Plan and the Boronda Road Congestion Relief Project to ensure consistency with the projects.
