RESOLUTION NO. (N.C.S.)
A RESOLUTION OF THE CITY OF SALINAS CITY COUNCIL AUTHORIZING THE PARTIAL ACCEPTANCE OF THE NATIVIDAD CREEK PARK RESTROOM REHABILITATION PROJECT (CIP 9346) WHEREAS, on December 17, 2023, the City published a Request for Proposals (RFP) for the Natividad Creek Park Restroom Rehabilitation Project – CIP 9346 (Project); and WHEREAS, on April 4, 2023, the City published a second RFP and received no bids for the Project; and WHEREAS, on May 23, 2023, following a review of CDBG regulations and consultation with the City Attorney, City staff-initiated contact with two previous RFP bidders to directly submit an updated Project bid proposal by June 6, 2023; and WHEREAS, on June 20, 2023, the City awarded the construction contract to HA Construction (General Contractor) for the Project in an amount not to exceed $181,200, inclusive of the $151,000 construction contract amount and an approved 20% contingency of $30,200; and WHEREAS, Project construction began on November 20, 2023, and the Contractor had 90 workings days to complete the construction; and WHEREAS, on March 12, 2024, per Resolution 22916, the City Council approved contract change orders 3, 4, 5, 6, 7, and 8 to the HA Construction contract in the amount $39,465.19 and increase of the Project’s contingency to $44,070.81; and WHEREAS, on August 14, 2024, due to significant project delays, construction work below industry standards, labor compliance discrepancies, unauthorized subcontractors, falsification of records, and after multiple punch lists, the City made the hard determination to terminate the construction contract with the General Contractor; and WHEREAS, the remaining funding in the Project is $58,195.27; and WHEREAS, the City of Salinas determined that the Project is exempt from the California Environmental Quality Act (CEQA) Guidelines Section 15301 Existing Facilities, Class I (a)(c)(d)(g) as the Project proposes rehabilitation of an existing public restroom facility. The Notice of Exemption was completed and filed with the County of Monterey on April 6, 2021.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby partially accepts the ADA parking stalls and driveway approach elements of the Natividad Creek Park Restroom Rehabilitation Project CIP 9346, for maintenance and responsibility.
