The basis of that protest was information provided to us by Val’s Plumbing & Heating, including written statements asserting that their bid could not be divided by scope. We have since been informed that the statements provided to us by Val’s were inconsistent with the proposals actually submitted by Val’s to Precision Construction Services on bid day. We were unaware of these discrepancies at the time the protest was filed. Because the protest relied on information that we now understand to be factually inconsistent, Marvulli respectfully withdraws the protest in its entirety. We believe this action is appropriate to ensure the accuracy and integrity of the City’s procurement process. We appreciate the City’s attention to this matter and apologize for any inconvenience caused by our reliance on information that was subsequently shown to be incorrect.
