A RESOLUTION FINDING ADJUSTMENTS TO REPUBLIC SERVICES OF SALINAS’ SCHEDULE OF RATES FOR RESIDENTIAL AND COMMERCIAL CUSTOMERS TO BE WITHIN THE TERMS OF THE COLLECITON SERVICES AGREEMENT AND APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE COLLECTION SERVICES AGREEMENT RELATED TO STREET SWEEPING SERVICES WHEREAS, Section 14-01.10 of the City of Salinas Code, and California Public Resources Code, Section 40059 allows the City to enter into a contract for collection, removal, and disposal of all garbage, wet garbage, rubbish or commercial rubbish; and WHEREAS, the City of Salinas and Allied Waste Services of North America, LLC dba Republic Services of Salinas (“Republic Services”) are parties to an Amended and Restated Collection Services Agreement for Residential and Commercial Solid Waste, Recyclable Materials and Organic Waste Collection, Transfer, Processing and Disposal Services (“Collection Services Agreement”) pursuant to which Republic Services provides solid waste, recycling, organics collection, and other services for the City; and WHEREAS, pursuant to Article 4 of the Collection Services Agreement Republic Services may adjust the rates charged to customers on an annual basis; and WHEREAS, pursuant to Salinas Municipal Code Section 14-01.10, the City Council reviews proposed rate increases for reasonableness and consistency with the Collection Services Agreement; and WHEREAS, City of Salinas staff have reviewed Republic Services’ proposed rate adjustments as set forth in Exhibit 1 – “Schedule of Approved Rates” and have determined they are within the Maximum Service Rates set forth in the Collection Services Agreement; and WHEREAS, Republic Services currently provides street sweeping services. The City of Salinas and would like the option to resume responsibility for these services in order to provide a greater level of service to the community.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds and determines that the above recitals and accompanying staff report are true and correct and have served as the basis, in part, for the actions of the City Council set forth below; and BE IT FURTHER RESOLVED that Exhibit 1 - “Schedule of Approved Rates” attached hereto and incorporated herein by reference, is hereby approved and determined to be consistent with the Maximum Service Rates that Republic Services may charge under the Collection Services Agreement; and BE IT FURTHER RESOLVED that the First Amendment to the Collection Services Agreement is hereby approved and the Mayor of Salinas is hereby authorized to execute Amendment 1 on behalf of the City of Salinas.
