TITLE: MASTER AGREEMENT FOR THE USE OF REGIONAL

TRANSPORATION FUNDS
RECOMMENDED MOTION:

A motion authorizing the City Manager to execute an agreement with the Transportation Agency for Monterey County (TAMC) for the use of TAMC-administered transportation funds.

EXECUTIVE SUMMARY:

The Transportation Agency for Monterey County (TAMC) administers several transportation funding programs including the Regional Surface Transportation Program (RSTP), Transportation Development Act funds (TDA), and funding from the Regional Development Impact Fee Program (RDIF). These programs provide funding for various transportation projects for TAMC’s member agencies. The Master Agreement between TAMC and the City of Salinas for the use of these regional funds is expiring. In order to continue to receive reimbursement of City costs, it is recommended the attached Master Agreement be executed by the City.

BACKGROUND:

The Transportation Agency for Monterey County (TAMC) administers several transportation funding programs including the Regional Surface Transportation Program (RSTP), Transportation Development Act funds (TDA), and funding from the Regional Development Impact Fee Program (RDIF). These programs provide funding for various transportation projects for TAMC’s member agencies. Currently, the City is working on projects that have received RSTP funding. The City receives a fair share portion of RSTP funds according to population and lane miles of city streets.

The remainder of available RSTP funds are made available through a competitive grant process. As listed in Attachment 2 (Exhibit A of the TAMC Master Funding Agreement), RSTP Competitive funds have been awarded for the Downtown Complete Streets Improvements, Bardin Safe Routes to School Enhancement Project, Pedestrian Crossing Enhancement Project, and, most recently, Harden Parkway Path and SRTS Project. An RSTP Quick-build was awarded for the East Market Street Cycle Track Quick Build. RSTP fair share funds have been used to fund the Garner Avenue Bus Bulb Out. The Boronda Road Congestion Relief Project (Phase 1) has received RSTP fair share, RSTP competitive and RSTP mid-cycle funds. These various RSTP funds provided approximately $6.7 million for the Boronda Road Congestion Relief Project and over $14 million for all projects listed above.

RSTP funds are distributed by the State to regional transportation agencies. TAMC, in support of member agencies, makes portions of the fund available to member agencies for their use in local projects that support regional travel goals. The State therefore has oversight over the use of RSTP funds which are administered by TAMC. The State requires TAMC to enter into agreements with each member agency for the use of the RSTP funds. TAMC reimburses local agencies for their costs for TAMC-approved local projects. The attached list shows the Salinas Projects that have received funding from RSTP.

To continue receiving reimbursement of City costs, the Master Agreement (attached to this report) must be executed by the City. The agreement details State requirements for the use of these regional funds distributed by TAMC and includes provisions required to comply with State and Federal regulations. Existing and future projects funded by the RSTP program and other TAMC-administered funds are covered under the agreement for a three-year term.

CEQA CONSIDERATION:

Not a Project.  The City of Salinas has determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CEQA Guidelines Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment.  Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.  Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project.  Because the matter does not cause a direct or foreseeable indirect physical change on or in the environment, this matter is not a project.  Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.

CALIFORNIA GOVERNMENT CODE §84308 APPLIES:

No.

STRATEGIC PLAN INITIATIVE:

Funding local projects and securing funding for them supports the Council’s goals of “Public Safety” and “Infrastructure”.

DEPARTMENTAL COORDINATION:

The Public Works Department and Finance Department coordinate the use and reimbursement of RSTP funds, and other TAMC-administered funds.

FISCAL AND SUSTAINABILITY IMPACT:

There is no impact on the General Fund. Executing the agreement will allow the City to be reimbursed for work on eligible projects and maintain the City’s eligibility to use TAMC-administered funds.
