Town Council Agenda March 26, 2024
2 2. Council Business Items (Part 1):
2.1 Review and Approve the Arts Commission’s Hub Beautification Public Art Project. The Ordinance Amendment is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) because it is not a “project’ under CEQA; CEQA Guidelines section 15061(b)(3), the “common sense exemption”, because the Ordinance Amendment will not have a significant environmental effect; and CEQA Guidelines section 15307 and 15308 as an action taken by a regulatory agency to protect the environment. The Ordinance Amendment and implementing regulations are consistent with the Town’s Climate Action Plan because murals do not impact the environment.
3. Public Hearing:
3.1 Public Hearing to Consider Adoption of Amendments to the General Plan Land Use Designation Map and Amendments to Title 10, Chapter 3, Article 3 “Land Use Regulations” and Title 10, Chapter 3, Article 17 “Definitions” of the Municipal Code and the Zoning Map.
An Initial Study/Mitigated Negative Declaration related to the Housing Element and associated amendments was prepared pursuant to the California Environmental Quality Act (CEQA) and certified by the Town Council on July 25, 2023. This project is exempt from further environmental review pursuant to CEQA Guidelines Section 15162.

2. Council Business Items (Part 2):
2.2 Consider to Approve the FY25 Appropriation Request for the San Anselmo Hub Congestion Reduction and Active Transportation Project. Adoption of the attached resolution supporting an Appropriation Request for the HUB conceptual design does not constitute a “project” within the meaning of Public Resources Code section 21065, and California Environmental Quality Act (CEQA) Guidelines sections 15060(c)(2), 15060(c)(3), or 15378 because there is no potential that this action will cause a reasonably foreseeable direct or indirect physical change in the environment. If funding is approved for further project design, CEQA analysis will be included in the project scope.
