Item 2.3: Ordinance to Repeal Title 9, Chapter 23, Sales of Residential Property: Reports of Residential Building Records
Honorable Mayor Burdo and members of the San Anselmo Town Council, On behalf of the leadership and membership of the Marin Association of REALTORS®, we would like to express our sincere appreciation for your thoughtful consideration of the proposed ordinance to repeal the Residential Building Records report requirement in the Town of San Anselmo.

We commend the Council for carefully reviewing the program and recognizing the concerns raised regarding the cost, complexity, and time required to conduct these inspections and prepare the associated reports. As noted in the staff report and discussed during your February 24 meeting, the existing program can create additional administrative burdens and may duplicate services that are already routinely provided through private real estate inspections and disclosures.

Eliminating this requirement represents an important step toward streamlining residential transactions while maintaining the strong consumer protections that already exist in California’s real estate marketplace. Licensed home inspectors, mandatory disclosures, and negotiated inspections between buyers and sellers provide thorough review and transparency for all parties involved.

We are also grateful for the Council’s willingness to consider the broader impacts on homeowners, buyers, and housing mobility within the community. Reducing unnecessary costs and procedural hurdles helps ensure that San Anselmo remains accessible for families, seniors, and residents navigating life transitions such as downsizing or relocation. In addition to alleviating staff from this redundant inspection, we suggest that the Council reallocate staff time to improving the permitting process as outlined in the Marin Builders report from February. That is a very worthy endeavor, and we applaud you for taking those steps to improve that process.

The Marin Association of REALTORS® appreciates the collaborative and open dialogue that the Town has engaged in throughout this process. We respectfully encourage the Council to adopt the ordinance repealing Chapter 23 of Title 9 and we thank you for your leadership and commitment to practical, thoughtful local governance.

We appreciate your thoughtful consideration and your continued leadership on housing and community issues.

Sincerely,
591
Elizabeth Pedrick

STAFF REPORT
TOWN OF SAN ANSELMO Item #: 2.4
MEETING DATE: March 10th, 2026
AGENDA TITLE: Receive an Update on an Easement for Sorich Pedestrian Trail
FROM: Marc Matundan, Assistant Engineer, Department of
Public Works
RECOMMENDATION: Staff recommends that the Town Council receive an update for Sorich Pedestrian Trail

SUMMARY
Staff proposes the development of a new pedestrian-only trail connecting Sorich Trail to Memorial Ridge Trail, which would require the acquisition of an easement from the Mt.

Tamalpais Cemetery (APN 177-220-61)

BACKGROUND
In September 2024, the San Anselmo Town Council approved the conversion of the Sorich Park Trail from “pedestrian” to “multi-modal.” Recognizing that some community members wish to maintain the pedestrian-only experience in Sorich Park, the Council directed staff to explore alternative options for a nearby dedicated pedestrian trail.

Sorich Park and the surrounding area currently provide four primary trail connections to Ridgewood Fire Road: Sorich–Tomahawk Trail, Dean–Nyberg Trail, Memorial Ridge Trail, and Sorich Park Trail. The most recently constructed of these, Memorial Ridge Trail, was completed in 2018. It traverses Mount Tamalpais Cemetery via an easement and connects to Marin County Open Space District lands. 593
Item #: 2.4

DISCUSSION/ANALYSIS
The proposed hiking trail connects the Sorich Trail to the Memorial Ridge Trail. It cuts through Marin County Open Space and Mt. Tamalpais Cemetery.

The Town has approval from Marin County Open Space to utilize a 100-foot section of County Open Space land for designated future trail usage. Construction in this section will require a future right-to-enter agreement with Marin County Open Space.

The Town will request an easement from the owner of the cemetery for hiking use, including the right to construct, maintain, repair, and operate trails, signs, gates, protective barriers, fixtures, and facilities as necessary.

Staff is requesting support to continue with this effort. If the Cemetery owner grants the Town the requested Easement, the Council must approve a certificate of acceptance for the easement deed before it can be recorded with the Marin County Recorder’s Office.

The proposed trail map can be seen in Attachment 1. The draft Survey for the pedestrian trail easement has been performed and is attached (Attachment 2).

FISCAL IMPACT
Other than staff time and surveyor fees, there are no immediate costs associated with this action; however, the future cost of trail construction is estimated at $50,000.

GENERAL PLAN CONSISTENCY
This item is consistent with San Anselmo Circulation Element C and Public Open Space Element I-17.

CEQA AND CLIMATE ACTION PLAN CONSISTENCY
The Town finds this project to be categorically exempt from the requirement to prepare environmental documents under the CEQA pursuant to CEQA Guidelines Section 15301, Class 1, as it involves the maintenance and minor alteration of an existing facility with negligible or no expansion of use. If the easement deed is granted to allow for the construction of the trail, Town staff will prepare a notice of exemption for this project.

The proposed pedestrian trail is consistent with the goals and objectives of the adopted San Anselmo Climate Action Plan Measure T-3.
