STAFF REPORT
TOWN OF SAN ANSELMO Item #: 1.3
MEETING DATE: April 14, 2026
AGENDA TITLE: Adopt an Ordinance Amendment to Title 10 “Planning and Zoning”, Section 10-3.302, Land Use Regulations Table 3A and Section 10-6.103, ADU and JADU Approvals.
FROM: Community Development Department
RECOMMENDATION Adopt the attached Ordinance entitled, “An Ordinance of the Town Council of the Town of San Anselmo Amending Title 10 “Planning and Zoning, Section 10-3.302, Land Use Regulations Table 3A for Consistency with State Law and Housing Element and for Ministerial Error Correction; Section 10-6.103, ADU and JADU Approvals; and making associated CEQA Exemption Findings.” (Attachment 1)
BACKGROUND AND DISCUSSION
On March 24, 2026, the Town Council conducted a duly noticed public meeting to review proposed ordinance amendments to the Zoning Code to ensure consistency with State housing law and implementation of the 2023–2031 Housing Element. The amendments clarify provisions in the Land Use Regulations Table 3A to avoid unintended constraints on by-right multifamily housing, correct prior drafting errors, and reinstate previously permitted residential uses in commercial zones. The Council also considered updates to the Town’s ADU regulations to round fractional unit calculations up, consistent with State law and local inclusionary housing practices. Collectively, these changes are intended to remove barriers to housing production and support compliance with the Town’s Regional Housing Needs Allocation (RHNA).
Following the hearing, the Town Council unanimously: (1) approved a motion to read the Ordinance by title only, with the Town Manager reading the full title; and (2) approved the first reading of the Ordinance amendments and waived further reading of the Ordinance in its entirety.
FISCAL IMPACT
No new fiscal impacts.
GENERAL PLAN AND CLIMATE ACTION PLAN CONSISTENCY
The proposed Ordinance Amendments are consistent with the General Plan Housing Element because they make Zoning Code changes to align with the Housing Element and encourage the development of housing at all income levels. The Ordinance 45 Item #:1.3
Amendments are consistent with the Town’s Climate Action Plan Policy T-9 (Smart Growth Development).
CEQA AND CLIMATE ACTION PLAN
The Ordinance Amendment is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guideline section 15061(b)(3) (the “common sense” exemption) because it can be seen with certainty that there is no possibility that the Ordinance Amendments may have a significant effect on the environment, as they do not authorize new development, significantly expand existing uses, or significantly increase the intensity of activity; CEQA Guidelines section 15301 involving minor alteration to existing facilities involving negligible or no expansion of use beyond that already in existence and CEQA Guidelines section 15303 involving new construction or conversion of small structures, since they make no or minimal changes to land use, development intensities, and the rate at which development is expected to occur. The Ordinance Amendments are also exempt from CEQA pursuant to Public Resources Code section 21080.17, which exempts the adoption of local ordinances regarding second units in a single or multi-family residential zone. The Climate Action Plan is not implicated.

ORDINANCE NO.
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF SAN ANSELMO AMENDING TITLE 10 “PLANNING AND ZONING”, SECTION 10-3.302 LAND USE REGULATIONS TABLE 3A FOR CONSISTENCY WITH STATE LAW AND HOUSING ELEMENT AND FOR MINISTERIAL ERROR CORRECTION; SECTION 10-6.103, ADU AND JADU APPROVALS;
AND MAKING ASSOCIATED CEQA EXEMPTION FINDINGS
WHEREAS, the Town Council adopted the 2023-2031 Housing Element in 2023 pursuant to State Housing Element Law (Government Code section 65580 et seq.), which Housing Element was subsequently approved by the California Department of Housing and Community Development; and WHEREAS, Housing Element law requires that a municipality’s Housing Element accommodate the Town’s regional housing need allocation (“RHNA”) and ensures the provision of housing at all income levels; and
WHEREAS, to encourage the development of housing, State Housing law requires ministerial or “by-right” approvals for certain development projects if objective requirements are satisfied; and WHEREAS, in the Spring of 2025, the Town Council amended various sections of the Zoning Code to implement the Housing Element and ensure compliance with State housing law, including amendments to the Land Use Regulations Table, Table 3A and accompanying “Notes” that provide more information and requirements related to the allowable land uses set forth in the Table; and
WHEREAS, Government Code sections 65583.2(i) and (h) require ministerial, “by-right” approval of multi-family projects that comply with objective standards and reserve at least 20% of the units for lower-income households; and
WHEREAS, certain Notes in the Land Use Regulations Table, Table 3A, can mistakenly be interpreted to be inconsistent with the above-mentioned State law and the proposed Ordinance Amendments corrects this inconsistency; and
WHEREAS, the Ordinance Amendments also correct an inadvertent ministerial error in Table 3A and allow attached residential uses in commercial districts; and WHEREAS, State law, Government Code section 66323(a)(3)(B), and Town Municipal Code section 10-6.103, requires that in an existing multifamily dwelling structure, at least one Accessory Dwelling Unit (ADU), and up to 25% of the existing multifamily dwelling units, must be approved if requirements are satisfied, and when the 25% calculation results in a fractional unit, the Town rounds number of allowable ADUs down; and
WHEREAS, the Town seeks to round the number of allowable ADUs up when the 25% calculation for an existing multifamily structure results in fractional unit, thereby increasing the potential number of ADUs in the Town consistent with other State housing laws and the policy of encouraging housing; and
WHEREAS, the Ordinance Amendments are exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15301 involving the minor alteration of existing 47 Attachment 1
facilities involving negligible or no expansion of use beyond that already in existence; CEQA Guidelines Section 15303 involving new construction or conversion of small structures; CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility they would have a significant effect on the environment; the amendments make no or minimal changes to land uses, development intensities, or the rate at which development is expected to occur; and Public Resources Code section 21080.17, which exempts the adoption of local ordinances regarding second units in a single or multi-family residential zone; and WHEREAS, the Ordinance Amendments are consistent with the Climate Action Plan 2030 Action T-9 (Smart Growth Development); and
WHEREAS, the proposed Ordinance Amendments are consistent with the General Plan Housing Element because they make Zoning Code changes to align with the Housing Element and encourage the development of housing at all income levels; and WHEREAS, on March 16, 2026, the Planning Commission held a duly noticed public hearing and voted to recommend that the Town Council approve the proposed Ordinance Amendments; WHEREAS, the Town Clerk caused notice of a public hearing regarding the Town Council’s consideration of the Ordinance Amendments as required by State law; and WHEREAS, the Town Council held a duly noticed public hearing on March 24, 2026, and voted to introduce the Ordinance Amendments.
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF SAN ANSELMO DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: The above recitals are true and correct and are incorporated as findings herein.
SECTION 2: The Ordinance Amendments are exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15301 involving the minor alteration of existing facilities involving negligible or no expansion of use beyond that already in existence; CEQA Guidelines Section 15303 involving new construction or conversion of small structures; CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility they would have a significant effect on the environment; the amendments make no or minimal changes to land uses, development intensities, or the rate at which development is expected to occur; and Public Resources Code section 21080.17, which exempts the adoption of local ordinances regarding second units in a single or multi-family residential zone.
SECTION 3: The Ordinance Amendment is consistent with the General Plan Housing Element because it makes Zoning Code changes to align with the Housing Element and encourage the development of housing at all income levels, and ensures consistency with State Housing law.
SECTION 4: Ordinance Amendment. Town of San Anselmo Municipal Code Section 10-3.302, Land Use Regulations Table 3A, is hereby amended as follows with deletions in strikeout and additions in underline:

The Land Use Regulations Table, referred to as Table 3A, lists uses of the land and indicates whether or not each use is permitted (P), conditionally permitted (C), or not permitted (-) in each Zoning District. Uses not specifically listed in the Land Use Regulations Table are specifically prohibited unless a Use Determination by the Community Development Director or designee is made which finds the use not specifically listed is similar to another use permitted or conditionally permitted within the District.
The Residential Housing Opportunities (R-HO), Public Facilities (PF), and Open Space (OS) are not included on the Land Use Regulations Matrix. The R-HO District is an overlay District and generally allows for higher residential densities. The R-HO District is not yet designated on the zoning map and, therefore, is not currently regulated. The PF District does not include any lands not currently developed with major public facilities. Any expansion of the PF District would be preceded by the Town's acquisition of the land for a specific use or purpose, a General Plan Amendment, and a zone change. The OS District is limited to passive recreation uses. See also Title 11, Chapter 1 "Regulations for Parks and Playgrounds."

STAFF REPORT
TOWN OF SAN ANSELMO Item # 1.4
MEETING DATE: April 14, 2026
AGENDA TITLE: Transportation Authority of Marin (TAM) Measure AA Expenditure Plan
FROM: David P. Donery, Town Manager
RECOMMENDATION: Staff recommends that the Town Council approve the amended Measure AA Expenditure Plan (Attachment 1) as adopted by the Transportation Authority of Marin (TAM) Board on March 26, 2026, following a comprehensive public outreach and review process.
BACKGROUND
The TAM is the congestion management agency and transportation sales tax authority for Marin County. TAM is an independent agency, and the TAM Board is composed of one elected official (councilperson) from every town and city in Marin and all five members of the Board of Supervisors. TAM was established by Marin County voters to support transportation infrastructure projects, programs, funding and planning efforts.
TAM manages the Marin ½-Cent Transportation Sales tax, the Marin Vehicle Registration Fee, and coordinates other regional, state and federal funding sources for transportation improvements throughout the County.
On November 6, 2018, Marin voters approved Measure AA (76.7%) to renew and extend Measure A, the countywide ½-Cent Transportation Sales Tax. The Measure AA Expenditure Plan (“Expenditure Plan”) funds core transportation needs, including local streets and roads, Safe Routes to Schools, transit services, and highway improvements.
Measure AA generates approximately $35 million annually, and since 2004, the ½-Cent Transportation Sales Tax has generated over $500 million in funding for Marin’s transportation needs.
Measure AA requires the Expenditure Plan to be reviewed every six years to ensure funding reflects evolving transportation needs, community priorities, and emerging challenges. Transportation funding is dynamic, and the past six years since Measure AA was approved have seen significant changes in transportation, in part due to the COVID-19 global pandemic, including the rise of work from home, changes to the transit network, and fluctuating regional, state and federal funding frameworks.
A. Expenditure Plan Review Process
57 Item # 1.4
As a new requirement in the 2018 Measure AA Expenditure Plan, this review is the first of its kind. TAM staff began the Expenditure Pplan review in October 2024. The process involved extensive public outreach and agency coordination with funding recipients, including public works directors, local agency management, and advisory committees.
Outreach included over 30 meetings with stakeholders, working groups, and community members, as well as pop-up public engagement events held throughout Marin County.
TAM staff have held multiple Board discussions on the process and have convened an ad-hoc committee of TAM board members to guide the review process and development of the recommended Expenditure Plan amendments. Specific milestones in the review process included:
October 2024 – the TAM Board approved the process and schedule for the Measure AA Expenditure Plan Review
April 2025 – the TAM Board was briefed on the initial findings after discussions with recipients of the measure, including public works directors and transit operators, and the Ad Hoc Committee. These discussions focused on what has worked well, and what changes should be considered in the Expenditure Plan. During these meetings, TAM staff was asked to consider changes to multiple plan categories, including providing funding for large local roadway projects.
July 2025 – the TAM Board received an update on financial projections for Measure AA revenue, and a discussion on the idea of a “Reimagined Roadways” category to address project development of major roadway projects funded through a funding shift within the local roads category of the measure. The Board also received an update on the financial forecasts for the crossing guard program and public outreach process.
September 2025 – based on the July discussion, feedback from public outreach, and Ad Hoc Committee input, an initial discussion on proposed amendments to the Expenditure Plan were presented to the TAM Board for input and discussion. December 2025 – an informational item was presented to the TAM Board to summarize the final proposed changes to the Expenditure Plan and provide greater details of those changes to each affected category of the Expenditure Plan. Feedback from the TAM Board was heard and further considered for incorporation. January 2026 – The TAM Board presented draft amendments to the Expenditure Plan and opened a 45-day public comment period.
March 2026 – At the conclusion of the 45-day comment period, the TAM Board adopted the Amended Expenditure Plan included as Attachment B.
In addition to the TAM Board discussions, TAM staff conducted multiple meetings to receive input and coordinate with the following agency and advisory groups:
Marin Public Works Association
58 Item # 1.4
TAM Community Oversight Committee (COC)
TAM Bicycle/Pedestrian Advisory Committee
TAM Technical Advisory Working Group
TAM Equity Working Group
TAM/Marin Managers Association Subcommittee
TAM Measure AA Expenditure Plan Review Ad Hoc Committee B. Expenditure Plan Amendments
Amendments to the Expenditure Plan must be approved by the following process:
A two-thirds vote of the TAM Board following a public hearing and 45-day public comment period; and
Approval by a majority of jurisdictions representing a majority of the incorporated population, as well as approval by the Board of Supervisors.
On January 22, 2026, the TAM Board opened a 45-day public comment period on the proposed amendments to the Expenditure Plan. A public hearing was held on March 26, 2026, after which the TAM Board adopted the following amendments by the requisite 2/3 vote:

DISCUSSION
The proposed amendments to the Expenditure Plan are limited and targeted.
Approximately 95% of Measure AA funding remains unchanged, with updates to approximately 5% based on input received from the public and partner agencies. The amendments are intended to improve flexibility in tackling local transportation demands, addressing funding gaps, and responding to emerging transportation needs while maintaining the intent of the voter-approved measure.
The proposed changes respond to local concerns and provide the following:
Funding for five additional crossing guards – Measure AA provides dedicated ongoing funding for crossing guards in Marin County. The crossing guard program annual operations currently exceed annual revenues and additional revenue is needed to maintain 96 guards identified in the Measure AA Expenditure plan. TAM has instituted several cost reductions for the program and the increase in ongoing funding will help maintain five guarded locations in the county. TAM is also providing additional one-time funding outside of the Measure AA amendments to maintain guards in the field.
Funds for “Reimagined Roadways” category – To respond to requests from local jurisdictions, the Expenditure Plan Amendment includes dedicated funding to advance project development on major roadways and intersections; for which no dedicated measure funds currently exist. Under the previous Expenditure Plan (Measure A), local road improvements were funded through local formula funding and through a Major Road category. This change would reintroduce funding for major road improvements to allow TAM and local agencies to respond to infrastructure needs in these major roadway corridors.
Funds for local road improvements – The measure continues to provide approximately $5.8 million/year to jurisdictions for local streets and roads from TAM in addition to approximately $22 million/year for roadway maintenance from other funding sources. Roadway elements which include integrated environmental protections and mitigation are an eligible use of this funding.

COC Membership

Review Timeline
Align with Measure B Expenditure Plan for
concurrent review processes.
60 Item # 1.4
Maintains current project development process for interchange program - The amendment to the Expenditure Plan maintains the current project development process for interchange improvements, providing ongoing funding for project development of key interchange improvements on US 101.
Additional amendments – The remaining Expenditure Plan amendments do not directly impact funding and include updating program eligibility and administrative provisions, specifically: changes to eligible recipients in two categories (sea level rise and ferries & regional transit), COC membership (allows TAM Board to add members from underrepresented groups), and frequency of future reviews (to align timing with required reviews for the Vehicle Registration Fee, Measure B).
Additional information about Measure AA and the review process is also available on TAM’s website at: https://www.tam.ca.gov/funding/measure-a-renewal/.
The TAM Board has completed its required review, public outreach, and adoption process. TAM is now seeking approval from local jurisdictions, including San Anselmo, as required under Measure AA.
CONCLUSION
Town of San Anselmo staff have been involved in the discussions regarding the proposed amendments to the Expenditure Plan and are supportive of the shift of a small portion of the local road funding to the newly created Reimagine Roadways category.
FISCAL IMPACT
The Town Council’s discussion and approval of the amended Measure AA Expenditure Plan results in a reduction in local funding due to the shift of 4% from Local Transportation Infrastructure (Category 2.1) to the new Reimagine Roadways (Category
2.4).
CEQA AND CLIMATE ACTION PLAN CONSISTENCY
The Council’s discussion and approval of the amended Measure AA Expenditure Plan is not a “project” under the California Environmental Quality Act, because it does not involve an activity which has the potential to cause a direct or reasonably foreseeable indirect physical change in the environment. (Cal. Pub. Res. Code § 21065).
ATTACHMENT 1: Measure AA Expenditure Plan - Amendment #1 61 1 of 3
Measure AA Expenditure Plan
Amendment #1
March 26, 2026 (adopted), July 1, 2026 (effective date) Pursuant to the actions of the participating jurisdictions and the TAM Board of Commissioners as defined by the Measure AA Expenditure Plan approved by the voters of Marin County in November 2018, the following amendments to said Expenditure Plan are hereby incorporated into the Expenditure Plan effective XXXXXXXX.
CATEGORY 1 (Change in funding distribution)
The following change in funding distribution shall supersede previous funding distribution language:
Percentage of Sales Tax Funds equal to 7% 6.5% of the total collected net of existing obligations and administration to be used in Category 1, with 3% 2.5% dedicated to “Improve Highway 101 local interchanges and freeway access routes to reduce congestion, improve local traffic flow, and address flooding impacts throughout the county.”
CATEGORY 2 (Multiple Changes)
The following change in funding distribution shall supersede previous funding distribution language:
Percentage of Sales Tax Funds equal to 22% 18% of the total collected net of existing obligations and administration to be dedicated to “Maintain and manage local roads to provide safe and wellmaintained streets for all users. All investments will consider the needs of all users in accordance with local practices (i.e. “Complete Streets” practices) that have been adopted in each city, town, and the County. Improvements to maximize the efficiency, effectiveness, and resiliency of our transportation system to be determined by local jurisdictions and may include:
• Paving, reconstruction, roadway repair, drainage, lighting, landscaping, and other roadways system components including integrated environmental protections and mitigations. • Bike lanes and paths
• Safe pathways to transit and bus stop improvements
• System enhancements to accommodate new technologies such as signal coordination, real time information
• Investments to address congestion on local street and road corridors • Facilities and support including project management, technical services and outreach to support alternative fuel vehicles, electric vehicles, zero emission vehicles and autonomous vehicles
• Municipal fleet conversion to alternative fuel vehicles including electric vehicles • Improvements to address sea level rise and flooding on local streets 62 2 of 3
The following change in description shall supersede all previous language:
Sea Level Rise and Resiliency
Marin’s transportation infrastructure is sited along vulnerable bay frontage that is at increasing risk of flooding and erosion from sea level rise and king tide events. This funding would be utilized to support protecting and adapting Marin’s roadways and related infrastructure to the effects of sea level rise and flooding. These funds can be used to serve as seed money to find solutions, attract matching grants and leverage private investments to meet the challenges and vulnerabilities identified in numerous planning efforts including those of Bay Wave, and CSMART. The funds can also be utilized for facilities to support alternative fuel vehicles including electric vehicles. Sea Level Rise and Resiliency funds shall be available to TAM and to eligible recipients including local jurisdictions through a process defined by TAM.
The following change in funding distribution and description related to Innovation Technology shall be deleted and replaced with:
Percentage of Sales Tax Funds equal to 4.5% of the total collected net of existing obligations and administration to be dedicated to “Reimagined Roadways: Provide planning and project development activities for large roadway capital projects.”
Description: “With traffic and land use changes in Marin County, there is a growing need to advance large roadway capital projects, specifically roadway corridors or intersections, to support multijurisdictional travel and multiple modes of travel. This category would support the identification and planning of roadway projects of countywide significance. The funds would be used by TAM to advance prioritized projects through the initial project delivery phases and compete for construction funding.
TAM would work with local jurisdictions to determine corridor needs in alignment with the Countywide Transportation Plan (CTP) and the ability to leverage outside grants from regional, state or federal funding sources.”
CATEGORY 3 (Change in funding distribution)
The following change in funding distribution shall supersede previous funding distribution language:
Percentage of Sales Tax Funds equal to 11.5% 12.0% of the total collected net of existing obligations and administration to be used in Category 3, with 7.0% 7.5% of the total collected net of existing obligations and administration to be dedicated to “Maintain the crossing guard program, providing funding for crossing guards throughout Marin County”.
The following description change will supersede all previous description language:
All references to number of sites and/or intersections will be replaced with number of crossing guards.
CATEGORY 4 (Modified description)
The following description change will supersede all previous description language:
Expand access to Rail and Ferry Stations through first and last mile programs or services. Expand and maintain shared mobility services, and new transit connections to address first and last mile connections to rail and ferry stations.
63 3 of 3
Marin County residents and workers now have expanded regional transportation options to improve regional mobility, particularly during commute hours. Local residents and workers often require first and last mile connections to make these regional options accessible, including access to the ferry and express bus services. This category helps to expand and maintain first and last mile solutions that provide access to regional transit stops for Marin’s residents and commuters. The funds can be accessed by TAM, Marin Transit, or Golden Gate Bridge, Highway, and Transportation District as sponsors of shared mobility services such as bikeshare systems or new first/last mile connections (e.g. Shuttle service, new transit connections, or other shared mobility services) at major transit stops working in coordination with TAM.
COMMUNITY OVERSIGHT COMMITTEE (Additional language)
The following description change is in addition to all previous description language:
To accurately represent the voices of the communities in Marin, especially to timely address the needs and voices of the Equity Priority Communities (EPCs), the TAM Board has the authority to review and amend the COC membership structure when necessary.
AMENDMENTS TO EXPENDITURE PLAN (Modified and additional language) The following description change will supersede the previous description of the frequency of reviews (the remaining amendment description language is unchanged):
The Expenditure Plan must be reviewed periodically following passage to ensure that it responds to a rapidly evolving transportation landscape, incorporates innovations, and reflects current priorities.
The TAM Board may also consider an amendment, adhering to the process below, at the point of the scheduled review or at any time deemed necessary during the life of the Expenditure Plan.
The timing of the Measure AA Expenditure Plan review and the Measure B Expenditure Plan review will occur together for one consolidated, concurrent review for efficiency and effectiveness. The timing of the two review processes will occur concurrently during the second scheduled review for both Measures B and AA in 2032 to 2033 and will establish an eight-year cycle for both thereafter. This would provide four review cycles for Measure AA, including a final one the year before the measure is due to sunset in 2049.

STAFF REPORT
TOWN OF SAN ANSELMO Item #: 2.1
MEETING DATE: April 14, 2026
AGENDA TITLE: Discuss New Potential Downtown Resident Parking Program FROM: Scott Schneider, P.E., Assistant Public Works Director RECOMMENDATION: Receive update on potential program related to resident daytime parking in time-restricted areas in Downtown San Anselmo, and review and provide input on draft recommendations. Following this discussion, staff will return with the regulatory changes required to implement the Council’s direction.
BACKGROUND
Following the rollout of parking changes in downtown San Anselmo in the summer of 2025, the Town received input from residents living near downtown relating their experiences of increased street parking by downtown business customers and merchant parking permitholders. Most side streets adjacent to San Anselmo Avenue have timed parking restrictions.
On January 28, 2026 the Town Manager held a public forum on downtown resident neighborhood parking issues, with about 10 virtual attendees and 31 in-person attendees. The Town hosted this forum to listen to residents’ concerns related to parking impacts in downtown neighborhoods. The meeting focused on merchant parking, Live on the Avenue (LOTA), and the resident overnight parking program.
Issues discussed were merchant parking in the neighborhood and changes to allow more merchant parking on SFD and Creek Park lot, Live On The Avenue parking on Friday/Saturday evenings that block the edges of driveways, and parking in front of homes with time limits. Residents asked if they could be eligible to purchase a daytime permit similar to the Merchant Parking Permit, enabling them to park in front of their residence longer than the 4-hour time limit.
The following streets adjacent to downtown have timed restrictions:
Sycamore Avenue – 4-hour parking
San Anselmo Ave (Center Blvd to Grove Lane) 4-hour parking San Rafael Avenue – 4 hour parking
Tamalpais Avenue – 2 and 4 hour parking
65 Item #: 2.1
Magnolia Avenue – 4 hour parking
Tunstead Avenue – 2 and 4 hour parking
Pine Street – 2 hour parking*
Woodland Avenue – 2 and 4 hour parking
Ross Avenue – 2 and unregulated parking
Mariposa Avenue – 2 hour and unregulated parking
Belle Avenue – 2 hour and unregulated parking
Note: Pine Street is the only street near downtown that doesn’t have 4-hour or unregulated parking. Some residents requested changing the residential portion of Pine Street to 4-hour parking.
Merchant Parking Program
In 1989, the Town Council created the merchant parking program to “make parking spaces accessible to customers of business[es] in the downtown area” by allowing employees of the downtown businesses to park all day in four-hour parking zones adjacent to the downtown area.
The merchant parking program has been successful by encouraging employees to park farther away from their shop, restaurant or office, and freeing up closer parking for customers or other visitors. One consequence, however, has been increased merchant parking on residential streets near downtown, which has created inconvenience for residents who are often forced to park farther from their homes. To date, approximately 240 merchant stickers have been sold.
On October 14, 2025, the Town Council approved changes to parking zones in Creek Park and on Sir Francis Drake Boulevard to provide additional spaces available to merchant parkers with the intent of reducing the number of merchants parking in the residential neighborhood streets. The Town sent updated maps and communication to the merchants and encouraged them to park in Creek Park and on Sir Francis Drake Boulevard to relieve congestion in the residential neighborhoods. Recent counts show that Creek Park is well used by merchant permit holders. See next section for table with counts by street.
Please note that California State Law requires that vehicles be moved every 72 hours regardless of local parking restrictions.
DISCUSSION
Staff proposes that a Downtown Resident Overnight/Daytime Permit be made available to those residents living within the boundaries of the downtown district who qualify for the Resident Overnight parking permits, and reside on streets that have timed parking restrictions. The proposed Downtown Resident Overnight/Daytime Permit would allow all-day parking in 4-hour on-street parking zones, similar to the Merchant parking rules. 66 Item #: 2.1
The proposed boundaries include Sycamore Avenue on the north, San Rafael Avenue, Cedar Avenue on the west, Ross Avenue on the south and San Anselmo Avenue between Ross Avenue and Grove Lane on the east (see Attachment 1 - Map Showing Downtown Residential District).
The proposed cost for a Downtown Resident Permit is $25 per fiscal year, matching the Merchant permit fee. A $50 overnight permit would also be required.
The proposed Downtown Resident Permit would be a new combination Overnight/Daytime Resident Parking Permit that this year (2026) would cost $75 ($50 overnight + $25 daytime). Only residents in this special zone who qualify for the Overnight (hardship) parking permit would be eligible to apply for this new permit. The permit would be valid on an annual basis (January 1 – December 31) regardless of when it is purchased. (Existing Overnight permit holders would only pay $25 for 2026, as they have already paid the $50 fee).
The number of existing Overnight permit holders in the Downtown zone is approximately 47.
The table below shows the number of 2-hour, 4-hour, and unregulated parking spaces on residential streets near downtown, along with counts of parked vehicles displaying Merchant permits. Counts taken between 3 pm and 5 pm on weekdays.

RECOMMENDATIONS
In an effort to further fine-tune the downtown parking regulations, the Town Council is being asked to review and provide feedback on the following staff recommendations:
R1: Residents who live in the defined zone would be eligible for a Resident Overnight/Daytime Parking permit if they are also eligible for an Overnight (hardship) permit. The Resident Overnight/Daytime Parking Permit would allow all-day parking in 4-hour zones near their home, as well as parking in a legal parking spot between 2:00am – 6:00am. The proposed annual cost of the permit in 2026 would be $75/year.
R2: The residential stretch of Pine Street (west of 130 Pine Street) be changed to 4- hour parking, which would allow Downtown Resident Parking Permit holders (as well as Merchants) to park all-day.
Staff will return with the regulatory changes required to implement the Council’s direction.
FISCAL IMPACT
The costs to create and run this program include staff time and the production of the permit clings. The production costs and a portion of staff costs would be offset by the annual permit fee revenue.
CEQA AND GENERAL PLAN/CLIMATE ACTION PLAN CONSISTENCY
The Town finds the discussion of potential modifications to parking restrictions, is not a project under the California Environmental Quality Act because it does not involve an activity which has the potential to cause a direct or reasonably foreseeable indirect physical change in the environment. (Cal. Pub. Res. Code § 21065).
The Parking Study recommendations propose improvements to downtown parking that eases parking and allows for reducing minimum parking requirement for downtown businesses - San Anselmo’s Climate Action Plan 2030, specifically CAP Measures T-7 (parking).
The General Plan’s Land Use Element, F. Implementation, recommends a Central Commercial Circulation and Parking Study to inform any recommended changes.
