2 2.1
Approve the Transition of Merchant Permits from a Fiscal Year to a Calendar Year Schedule.

Shifting Merchant Permits is not a “project” under the California Environmental Quality Act, because it does not involve an activity that has the potential to cause a direct or reasonably foreseeable indirect physical change in the environment. (Cal. Pub. Res. Code § 21065).

2.2 Appoint a New Councilmember or Designate Another Party to the Marin Clean Energy (MCE) Board for the Remainder of 2026. Appointing a Council member or designating another Party to serve on committees is not a “project” under the California Environmental Quality Act, because it does not involve an activity that has the potential to cause a direct or reasonably foreseeable indirect physical change in the environment. (Cal. Pub. Res. Code § 21065).

2.3 Appoint a Councilmember to the Bicycle and Pedestrian Advisory Committee. Appointing a Councilmember to a board is exempt from the California Environmental Quality Act (CEQA), under the “common sense” exemption, because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. (Cal. Code Regs. tit. 14, § 15061).
