RESOLUTION NO. 2025-329
RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA,
AUTHORIZING THE DIRECTOR OF FINANCE AND
MANAGEMENT SERVICES TO APPROVE THE BUDGET
AMENDMENT FOR FISCAL YEAR 2025/26 IN THE
AMOUNT OF EIGHTY THOUSAND DOLLARS ($80,000),
MOVING FUNDS FROM THE CULTURAL
DEVELOPMENT FUND TO THE ECONOMIC
DEVELOPMENT DEPARTMENT REAL PROPERTY
DIVISION PROFESSIONAL CONTRACTUAL SERVICES
PROGRAM NUMBER, FOR SECURITY SERVICES AT
THE REGAL THEATRE IN CONNECTION WITH THE
SECOND (2ND) AND FINAL EXTENSION OPTION FOR THE
PROFESSIONAL SERVICES AGREEMENT (PSA); AND
AUTHORIZING THE DIRECTOR OF FINANCE AND
MANAGEMENT SERVICES, OR DESIGNEE, TO ISSUE A
PURCHASE ORDER IN THE AMOUNT OF $80,000 TO
REDWOOD PRIVATE SECURITY, LP.
WHEREAS, pursuant to that Lease Agreement, dated January 4, 2012, Regal Cinemas rents property from the City of San Bernardino (“City”) in order to operate a movie theatre; and WHEREAS, pursuant to Section 9.02(7) of the Lease Agreement, the City must provide security services for the open-air areas adjacent to the movie theater (The “Regal Movie Theatre”);
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.The above recitals are true and correct and are incorporated herein by this reference.
SECTION 2. The Mayor and City Council hereby authorize the Director of Finance to approve the budget amendment for fiscal year 2025/26 in the amount of Eighty Thousand Dollars ($80,000), reallocating funds from the Cultural Development Fund to the Economic Development Department Real Property Division Professional Contractual Services Program Number 5502, for Security Services at The Regal Theatre in connection with the second (2 nd) and final extension option for the Professional Services Agreement (PSA); and authorize the Finance Department to issue a purchase order to Redwood Private Security, LP.
SECTION 3.That the Mayor and City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that Resolution No. 2025-329

the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
SECTION 4.Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
SECTION 5. Effective Date. This Resolution shall become effective immediately.
