1.0 INTRODUCTIONAn Initial Study for the proposed Foothill and Macy Route 66 Residential Development (herein referred to as the Proposed Project or Project) has been prepared in accordance with the California Environmental Quality Act (CEQA), the Guidelines for Implementation of the California Environmental Quality Act (State CEQA Guidelines), and the City of San Bernardino policies for implementing CEQA. The City of San Bernardino issued a Notice of Intent to Adopt a Mitigated Negative Declaration (MND) (SCH# 202412025) for the Proposed Project. The Notice of Intent indicated that the City, acting as the lead agency for the Project under CEQA, was notifying public agencies and interested parties of a 30-day public review period to commence on January 30, 2025, and close on February 28, 2025, and that the City plans to adopt an MND for the Project. The Notice of Intent for the Proposed Project was sent to trustee and responsible agencies, members of the public, other interested parties, and the California Office of Planning and Research, State Clearinghouse for the required 30-day public review period. During the review period, public agencies and members of the public had the opportunity to respond to the Notice of Intent and provide comments on the MND. Public comments were received by the City of San Bernardino Community Housing and Development Department and have been responded to herein by the City in accordance with CEQA requirements. The City received three (3) letters from the following agencies or organizations commenting on the Initial Study/MND: 1. Caltrans January 31, 2025 email 2. Department of Toxic Substances Control January 30, 2025 letter 3. Southern California Gas Company Southeast Region January 29, 2025 email Section 2.0, Comments and Responses, of this MND, includes the comments received by the City of San Bernardino on the circulated Initial Study/MND. Copies of these comment letters, as well as the responses from the City, are included in Section 2.0. Pursuant to Article 6, Negative Declaration Process, of the State CEQA Guidelines, the City is not required to respond to comments received on an MND. However, the City has chosen to respond to the comments received on the Initial Study/MND and provide those responses to the commenters. It should be noted that responses to comments did not result in any editorial clarifications or corrections to the original Initial Study/MND text. Additionally, none of the comments resulted in changes to the data, analysis, conclusions, or mitigation present in this Initial Study/MND. The comments and information provided by these agencies and organizations do not constitute significant new information and therefore do not trigger a need to recirculate the Initial Study/MND for additional public review and comments. CEQA was amended in 1989 to add Section 21081.6, which requires a public agency to adopt a mitigation monitoring and reporting program for assessing and ensuring compliance with any required mitigation measures applied to a proposed development. Section 4.0 contains the Mitigation Monitoring and Reporting Program for the Project.

RESPONSES TO DEPARTMENT OF TOXIC SUBSTANCES CONTROL LETTER DATED JANUARY 30, 2025 The City of San Bernardino received a letter from the Department of Toxic Substances Control dated January 30, 2025 requesting the City identify pesticide levels in the soils as the Project Site was historically used for agriculture. Based on the change of use of the Site from commercial to residential, DTSC recommended that soil at the Site be analyzed for possible agricultural chemicals including chlorinated pesticides, chlorinated herbicides, organophosphorus pesticides, and arsenic. Response to Letter 2: The letter does not provide any comments on the circulated Initial Study/Mitigated Negative Declaration, however the City provided the letter to the Applicant and the Applicant subsequently contracted for soils testing. The February 27, 2025 letter of testing results from Hazard Management Consulting states that based on the results of the soil survey, it appears that trace amounts of chlorinated pesticides (alphachlordane -DDE) and chlorinated herbicides (pentachlorophenol) are present in shallow soil at the Site. However, the concentrations of chlorinated pesticides and herbicides were reported at concentrations well below applicable screening criteria for a residential land use scenario. No further response is required and no changes to the IS/MND are required.

Errata 3.0 ERRATA No errata to the Initial Study are required as a result of the comments received as noted in Section 2.0. However, subsequent reviews of the project design by Caltrans and City Departments resulted in changes to the Site Plan that have been reviewed in the context of the Initial Study. Subsequent to the Public Review, the City Fire and Water Departments provided minor changes to the project design and infrastructure sizing. Page 1 of the Initial Study incorrectly identified the western access driveway being along Macy Street and the eastern access driveway being along Dallas Avenue; the locations are reversed. The Fire Department is requiring that the westerly access on Dallas Avenue be available as entrance/exit for emergency response vehicles and as exit only for residents. This does not result in a need to amend the Initial Study. Page 61 states that the Site Plan shows access to the Project Site via two access driveways, which include a 26-foot wide accessway at Macy Street and a 26-foot wide accessway at Foothill Boulevard. The Site Plan has been reviewed by the City of San Bernardino and County Fire Marshal and suggested revisions have been incorporated to ensure that emergency access will not be blocked during project construction or operation. The San Bernardino Municipal Water Department is requesting that a connection between on the south side of Foothill Blvd. be installed as a part of the Proposed Project. The point of connection or size of existing water lines in Foothill Blvd. was not discussed in the Initial Study and no change is required. Additionally, four lots have been added to the Tentative Tract Map since circulation of the Initial Study, for a new total of 138 lots. The additional lots resulted from Caltrans request for additional right-of-These changes provided additional developable area within the TTM boundaries and thus the addition of four lots. This increase has been reviewed by the Traffic Impact Analysis and Air Quality Assessment preparers who found no changes would occur to the level of significance of impacts. The Traffic Engineer concluded that based on the trip generation, trip distribution, level of service and queueing evaluation, the revised project site plan making the Dallas Avenue driveway an emergency vehicle assess and redistributing the project traffic to Macy Street does not significantly affect the level of service or queuing capacity at either the project driveways or Macy Street. Therefore, project-related traffic operational impacts for the revised project would be the same as or less than those identified in the previous analysis. The Air Quality Assessment preparer concluded that the operational mobile source emissions (both criteria pollutants and greenhouse gases) resulting from the additional four residential units and associated trip generation would not result in an increase in the level of significance as emissions resulting from the project previously analyzed were substantially under SCAQMD Thresholds. The updated project review memos are on-file with the City. The City also reviewed other environmental resource areas potentially impacted by the additional four lots that were not previously reviewed. Additional impacts would potentially occur in the areas of Energy Use, Land Use/Planning, Noise, Population/Housing, Public Services, and Utility Service Systems. The additional population generated from the four

Erratalots would be 14 persons and would not result in a change to the percentage increase of projected City growth. Impacts related to Public Services are mitigated through the payment of Developer Impact Fees per housing unit or square footage. Impacts related to any increases in Utility Services such as water, wastewater treatment, storm water drainage, electric power, natural gas, or telecommunications would be nominal and remain less than significant. Mitigation Measures required for Noise impacts from project-generated traffic and the location of residences adjacent to Foothill Boulevard would continue to maintain impacts levels at less than significant. Other technical studies appended to the circulated Initial Study including all Biological Resources Reports, Phase I ESA, Cultural Resources Study, Paleontological Assessment, Geotechnical Investigation, Preliminary Hydrology and Preliminary WQMP would not require any updates related to the additional four lots as these studies evaluated development of the property as a whole. Changes to the Initial Study that was circulated for public review are noted below. Deleted text is shown as strike through and new text is shown as double-underline. The City has determined that none of the findings of the Initial Study have changed and no new mitigation measures are required; therefore, recirculation of the document is not warranted. The Project Description on Page 1 is amended to read as presented below. The number of TTM lots being 138 is a noted change throughout the document where called out. approval of a Tentative Tract Map No. 20695 that includes 134 138 single-family dwelling units on a 15.71--041-09, 10, 11, 17, 18, 20, 21, 32, 33, 34, 37, 44, and 0142-521-01, -02, and -03 (Proposed Project). The Proposed Project involves a request to change the General Plan land use designation from Commercial to Residential Medium, zone change from Commercial General (CG-1) to Residential Medium (RM), Tentative Tract Map No. 20695 to subdivide fifteen (15) lots of fourteen parcels totaling approximately 15.71 acres into 134 138 single-family lots and site and architectural review of 134 138 single family homes consisting of detached and motor court style development along with associated site improvements. To implement the Project, the Project Applicant submitted applications to the City of San Bernardino for a General Plan Amendment (GPA No. 24-01), Development Code/Zoning Map Amendment (DCA No. 24-02), Subdivision (SUB No. 24-04) and Development Permit Type-P (DP-P No. 24-04). The Project Site is located on the northwest corner of West Foothill Boulevard and Macy Street in the City of San Bernardino. The Proposed Project, referred to as Foothill and Macy Route 66 Residential Project would provide two (2) gated access driveways. The western eastern access driveway would be along Macy Street and eastern the western access driveway would be along Dallas Avenue. The access at Macy would be full access and the access at Dallas would be residents out only and emergency vehicles both directions. Refer to Figure 1 and Figure 2 for the Regional Location Map and Vicinity Map, respectively. The Site Plan provided as Page 7 of the Initial Study is updated and attached hereto.
