Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino, California adopt Resolution 2025-363 approving the Measure I Five-Year Capital Improvement Plan for Fiscal Year 2025/26 through Fiscal Year 2029/30 and Measure I Expenditure Strategy.
Executive Summary
Adoption of Resolution No. 2025-363 satisfies the requirements to receive Measure I Local Street Program Funds payments (Local Funds). The projects identified in Exhibit A of the Resolution have been previously identified in the City’s Capital Improvement Plan. Only projects listed in Exhibit A are eligible for Local Fund expenditures in the current fiscal year. The Expenditure Strategy included in Exhibit B States that at least 50% of the City’s Local Funds will be earmarked for specific capital projects. Additionally, the City may use up to 50% of the Local Funds for Public Works maintenance activities.
Total projected Measure I funds to be received in FY 2024/25 is $5,905,854. City of San Bernardino’s base year level Maintenance of Effort is projected to be $1,075,643, which can be met by through delivery of previously approved City CIP projects.
Background
In November 1989, voters approved Measure I, which authorized the San Bernardino County Transportation Authority (SBCTA) to impose a one-half of one percent retail transaction and use tax. This tax was applicable throughout the County for a period of 20 years beginning April 1, 1990, and extending to March 31, 2010, and is commonly known as the 1/2-Cent Sales and Road Tax (Measure I). In November 2004, voters 2 8

approved an extension of the 1/2-cent sales tax for an additional 30 years from April 1, 2010, through March 31, 2040.
Discussion
The Five-Year MICIP only relates to the expenditure of Measure I Local Funds, and each agency is required to update their plan annually. This plan identifies projects and the estimated Measure I Local Fund expenditures. Local Funds can be spent on any eligible transportation purpose determined to be a local priority. This includes improvements for local streets, major highways, state highways, transit, and other improvements that maximize the use of transportation facilities.
The proposed Resolution includes language asserting that the City of San Bernardino will meet its base year level Maintenance of Effort of approximately $1,075,643 for FY 2024/25. The requirement can be met through the delivery of previously approved City CIP projects.
Pursuant to Policy VLS-25 of the Measure I Strategic Plan, jurisdictions provide an annual statement in the resolution of the governing body adopting the Five-Year MICIP which acknowledges that the jurisdiction will maintain General Fund expenditures for transportation related construction and maintenance activities at the required base year level within the fiscal year.
The City is projected to receive $5,905,854 in Measure I Local Funds for fiscal year 2025/26. The five-year MICIP (Exhibit A) of the Resolution indicates the way those funds are anticipated to be spent. The projects included in Exhibit A reflect the street projects also included in the City's current Capital Improvement Plan, and include street planning, maintenance, and construction projects.
The list of included projects are as follows:
Citywide Pavement Rehabilitation
Citywide Pavement Rejuvenation
H St. Widening from Kendall Dr. to 40th St.
Pavement Management Program
SB County Joint Rehabilitation Projects
State Highway CA-210 Interchange Improvements at Waterman Avenue State HWY I-215 and University Parkway Interchange Improvements Street Improvements at 50 Locations
SBCTA also requires the local agencies to provide an "Expenditure Strategy", included as Exhibit B of the Resolution. Changes to the MICIP during the year are permitted, subject to approval of plan amendments by Resolution of the Mayor and City Council.
