City Manager's Comments
$177,952 of the $321,001 is coming from a California Natural Resources Agency grant. The project was originally awarded to another company but due to non- compliance and lack of communication, the award to HUR Flooring is being requested to be rescinded and an award to McWil Sports Surfaces in the amount of $256,800.60.
Executive Summary
Approving the termination of the Agreement with HUR Flooring Corp.—due to the contractor’s failure to secure the necessary bonds—and awarding the Agreement to McWil Sports Surfaces, the next lowest responsive bidder, will allow the City to move forward with the Rudy Hernandez Community Center Gym Flooring Replacement Project. This project will significantly enhance the safety, usability, and overall quality of the facility. As a vital hub for recreation and community engagement in the City of San Bernardino, the Rudy Hernandez Community Center plays an essential role in fostering physical activity, social interaction, and community well-being.
Background
Situated in a central location within San Bernardino, the Rudy Hernandez Community Center has various facilities and versatile spaces designed to accommodate a wide range of recreational, educational, and cultural activities. From multipurpose rooms and athletic facilities to computer labs and community gardens, the center offers a dynamic array of amenities that cater to the interests and preferences of community members of all ages and backgrounds.
The California Natural Resources Agency Department of Parks and Recreation Office of Grants and Local Services contacted Parks, Recreation and Community Services (PRCS) staff regarding miscommunication in regard to unallocated funds in 2019. Staff were notified of $177,952 to the city for the Per Capita Grant Program in Phase 1 of the Prop 68 grants. Department staff were granted an extension to submit the application for funding, and this was completed in March 2022.
On May 15, 2024, the Mayor and City Council of the City of San Bernardino approved the award of an Agreement with HUR Flooring Co. in the amount of $185,578.00 for Rudy Hernandez Community Center Gym Flooring Replacement.
On May 7, 2025, the Mayor and City Council of the City of San Bernardino approved Amendment No. 1 to the Construction Agreement with HUR Flooring Corporation for Rudy Hernandez Community Center Gym Flooring to revise the Contractor’s name from HUR Flooring Co. to HUR Flooring Corp and enable the Contractor to obtain the necessary bonds and continue with the Project.

On August 11, 2025, the City of San Bernardino Public Works Department issued a Final Notice of Intent to Terminate the contract with HUR Flooring for the Rudy Hernandez Community Center Gym Flooring Replacement Project. This action was taken due to the contractor’s failure to obtain the necessary bonds, as stipulated in the contract.
Discussion
The Project was advertised for public bidding on April 17, 2024, on PlanetBids, and later advertised in the San Bernardino Sun.
Five sealed bids were received, and opened on May 01, 2024, as follows:
Bidder City Base Bid
HUR Flooring Co. Van Nuys, CA $185,578.00
McWil Sports Surfaces Gardena, CA $256,800.60
Coastal Construction Team Encino, CA $319,620.00
California Flooring Winnetka, CA $370,851.00
Geary Floors, Inc. El Cajon, CA $374,000.00
The project was originally awarded to HUR Flooring Co. as the lowest responsive bidder. However, HUR Flooring was unable to provide the city with the necessary bonds and continue with the Project.
Despite multiple attempts by City staff to engage the contractor through various forms of communication, HUR Flooring ceased all responses. As a result of non-compliance and lack of communication, the City proceeded with steps toward contract termination in accordance with contractual and legal provisions.
The Project has a total existing budget of $225,000, comprised of $177,952 in Grant Funds and $47,048 in General Fund. The total cost for construction, including construction contingencies, construction management, and administrative costs, is $321,001.00. To fully fund the Project, an additional $96,001.00 will be provided through available Cultural Development Funds.
