WHEREAS, to ensure timely completion of the gym flooring replacement and continued access to this important community facility, staff recommends awarding a new construction agree- ment to McWil Sports Surfaces.

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The above recitals are true and correct and are incorporated herein by this reference.

SECTION 2. The Mayor and City Council hereby authorize the City Manager to termi- nate the agreement with HUR Flooring Corp for the Rudy Hernandez Community Center Gym Flooring Replacement Project.

SECTION 3. The Mayor and City Council hereby approve the award of an Agreement with McWil Sports Surfaces in the amount of $256,800.60 for Rudy Hernandez Community Center Gym Flooring Replacement and authorize the City Manager to execute any documents needed to enter into the Agreement with McWil Sports Surfaces .

SECTION 4. The Mayor and City Council hereby authorize project construction, con- struction contingencies, construction management, and administrative costs in the total amount of $321,601.00 for construction of the Project and authorize the City Manager to expend the con- tingency fund, if necessary, to complete the Project.

SECTION 5. The Mayor and City Council hereby authorize the Director of Finance and Management Services to amend the FY 2025/26 CIP budget with an additional $96,001.00 from available cultural development funds to bring the total project budget to $321,001.00.

SECTION 6. The Mayor and City Council finds that the proposed project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guide- lines Section 15301 (Class 1 – Existing Facilities). This exemption applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private struc- tures, facilities, mechanical equipment, or topographical features, involving negligible or no ex- pansion of existing or former use. The Rudy Hernandez Community Center Gym Flooring Re- placement Project consists of the removal and replacement of existing gymnasium flooring and related improvements within the existing building footprint, with no expansion of use, capacity, or change in purpose. The work will occur entirely within the interior of an existing facility and will not result in any significant environmental impacts. Accordingly, the project qualifies for a Class 1 Categorical Exemption under CEQA, and no further environmental review is required. In addi- tiona, the Mayor and City Council finds this R esolution is not subject to the California Environ- mental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
