Executive Summary
Approval of the updates to the Memorandum of Understanding include corrections and clarifications to titles and other provisions in order to more accurately reflect the agreement that was negotiated and agreed to by the City and SBPOA.
Background
The California Meyers-Millias-Brown-Act (MMBA) requires the City to meet and confer, in good faith, with its bargaining groups on all matters relating to employment conditions and employer-employee relations including but not limited to wages, hours, and other terms and conditions of employment.
The City has long recognized the San Bernardino Police Officers Association (SBPOA) as the authorized representative for Police Safety employees in matters related to wages, hours, and other terms and conditions of employment. The most recent Memorandum of Understanding (MOU) between the City and the SBPOA was adopted on August 6, 2025. Subsequent review identified language requiring clarification and correction. The parties have since met to address these revisions, and the updated MOU is now presented to the City Council for consideration and approval.
Discussion
The San Bernardino Police Officers Association (SBPOA) Memorandum of Understanding (MOU) covers the period from July 1, 2025, through June 30, 2029. The updated agreement includes several language revisions intended to clarify existing provisions. The following summarizes the changes made:

Article III, Section 11: The term “Union” was changed to “Association.” Article V, Section 5: This section was inadvertently revised. The language has been restored to the original version, with the addition of the new 320-hour sell- back provision.
Article VII, Section 1: Corrected the term of the MOU. 2021-2025 Strategic Targets and Goals
Authorization of these agreements aligns with Key Target No. 2a: Focused, Aligned Leadership and Unified Community by building a culture that attracts, retains, and motivates the highest quality talent.
