Executive Summary
Amending the Professional Services Agreement for Encanto Community Center would allow Miller Architectural Corporation to complete the necessary work to bid the project for construction. It will also extend the term through project construction and closeout.
The additional services will be paid for using previously allocated Project funding sources.
Background
The Encanto Community Center is a 24,660 square foot city-owned facility that was constructed in 1968 to support programs focused on providing physical, educational, vocational, rehabilitative, preventative, and recreational services to the community.
Due to the age and condition of the building, the City decided to complete improvements to the facility to address deferred maintenance needs and redesign existing spaces to allow for the restoration and expansion of recreational services at the facility.
On January 20, 2021, the Mayor and City Council adopted Resolution 2021-01 the Mayor and City Council of the City of San Bernardino, California, adopt Resolution No. 2021-1:
oApproving the use of donated funds from the Estate of Sharell Paramo to support a project for renovation of the Encanto Community Center; and oAuthorizing the Director of Finance to appropriate funds in the amount of $2,236,622 from Donations Fund No. 006 to the Encanto Community Center Improvements Project (“Project”) and amend the FY 2020-21 Capital Improvement Plan to include the Project; and
oApproving the award of a Professional Services Agreement with Miller Architectural Corporation for Project design services in the amount of $178,385 from Encanto Community Center Improvements Project Fund No. 006-380-8748.
On November 15, 2023, the Mayor and City Council approved Amendment No 1. To the Professional Services Agreement with Miller Architectural Corporation in the amount of $77,795, increasing the not to exceed amount to $256,180.

Kitchen renovation
Gymnasium renovation
Restroom renovation
As a result of the permitting and review process, more items than previously anticipated will need to be revised in order to meet current code requirements. Additionally, the estimated project cost ($9M to 10M) significantly exceeds the current project budget.
To help proceed with the most critical elements of the project, City staff have directed the design team to prepare a phased approach to the project. This helps provide the flexibility necessary to construct portions of the project separately as additional funding sources are made available.
Amendment No. 2 provides an additional $73,400 to complete the design plans and specifications and extends the term through July 31, 2027. The extended term allows Miller Architectural Corporation to continue to provide their services through the end of the construction and project closeout process. It will also allow Miller Architectural Corporation to remain under contract in anticipation of the next phase of the Project.
An additional $33,000 is recommended for professional services contingencies.
The Project currently has an available Fund balance of $3,179,040.26 from all sources, which is sufficient to cover the cost of the additional professional services and professional services contingency total of $106,400.
