Executive Summary
Amendment No. 2 to the Design Services Agreement expands the scope of work of 3 0

the project to include additional lighting improvements, ADA accessibility features, parking lot renovations, utility connections, and structural details for new dugouts and bleachers. Additionally, the Amendment divides the design plans into multiple smaller sets so that the City can take a phased approach for construction, which will allow the City to strategically group improvements for construction as funding becomes available. No budget amendment is required to fund this amendment as sufficient Measure S and Cultural Development funding already exists in the project’s approved FY 2025/2026 CIP budget.
Background
Speicher Memorial Park is a 29-acre facility, which includes five baseballs fields. The project will revitalize the park with improved amenities, and restoration of existing infrastructure. The first phase of the project is currently under construction.
On March 1, 2023, the Mayor and City Council approved Resolution No. 2023-036 rejecting construction bids for Speicher Park Renovation. Since the City received only one construction bid and the received bid amount was significantly above the Engineer’s overall estimate, Public Works staff recommended that the City Council reject the bid submitted for the subject project and allow staff to re-evaluate the project, coordinating with the Parks and Recreations Department to revise the scope of work to stay within the available budget.
On June 21, 2023, the Mayor and City Council awarded a Design Services Agreement to IDS Group, Inc. in the amount of $180,943. The scope of work included, but is not limited to, lighting, ADA accessibility, parking lot rehabilitation, new restrooms, and improvements to Huchabaa, Mason, and Montgomery Baseball Fields.
On March 6, 2024, the Mayor and City Council Approved Amendment No. 1 to the Design Services Agreement with IDS Group, Inc. in the amount of $209,179. An additional $39,000 for project contingencies was also authorized.
Discussion
Additional services are recommended to complete a multi-phase approach to the improvements at Speicher Memorial Park. When the Design for the Ballfields Improvements Project was completed, the estimated project cost was approximately $12 million. As a result, only a portion of the design was advertised for bidding and is currently under construction.
To make the best use of the remaining design plans, the project is being transitioned to a phase approach that will allow strategically grouped improvements to be constructed as funding becomes available. This requires additional work from IDS Group, Inc. to divide the existing plan set into multiple smaller plan sets.
Additionally, the items listed below will be added to the new design plans sets:

Additional lighting

Additional ADA Accessibility
Additional utility connections
New multipurpose field
New dugout pads and benches
Additional Fencing

The current project design cost is as follows:
Current Design Cost
Original Design Fee $180,943
Amendment No. 1 $209,179
Original Contingency $39,000
Total Current Design Costs $429,122
The cost to prepare the proposed plan set revisions is $206,626. An additional $11,000 is also recommended to increase the project contingency budget from $39,000 to $50,000.
The revised Design Cost would be as follows:
Revised Design Costs
Original Design Fee $180,943
Amendment No. 1 $209,179
Original Contingency $39,000
Amendment No. 2 $206,626
Additional Contingency $11,000
Total Revised Design Costs $646,748
The existing not to exceed contract amount would be increased from $429,122 to $646,748 to account for the proposed design costs and additional contingency budget.
The available project budget from all sources is approximately $2,089,778, which is sufficient to cover the additional design costs.
Available Project Budget
Measure S $1,300,000
Cultural Development Fund 789,778
Remaining Project Budget $2,089,778
To provide sufficient time for the additional design work, the term would also be extended through July 31, 2027. Once the additional design work is completed, the future phases of the project can be put out to bid as additional funding becomes available. 2021-2025 Strategic Targets and Goals
Execution of this amendment aligns with Key Target No. 4: Economic Growth & 3 0

Development. The additional amenities to Speicher Memorial Park will improve community participation for recreational activities and provide a safe and well- maintained community park.
Fiscal Impact
There is no General Fund impact associated with this action. There is sufficient budget in FY 25/26 CIP Budget within the existing Measure S and Cultural development allocations.
Conclusion
It is recommended that the Mayor and City Council of the City of San Bernardino, California:
1. Approve Amendment No. 2 to the Design Services Agreement with IDS Group Inc, Inc. in the amount of $206,626 for the Speicher Park Ballfields Project (Project), and authorize additional contingencies for unforeseen conditions in the total amount of $11,000, increasing the total contingency budget from $39,000 to $50,000, increasing the total not to exceed amount to $646,748, and extending the term through July 31, 2027; and
2. Authorize the City Manager or designee to execute all documents with IDS Group Inc.; and
3. Authorize the City Manager or designee to expend the contingency fund, if necessary, to complete the project.
