Resolution No. 2026-008
February 4, 2026
WHEREAS, as exempt surplus land, the Properties are not subject to the Notice of Availability and negotiation requirements under the Act; and WHEREAS, the designation of the Properties as exempt surplus land does not authorize or approve their sale or disposition but allows the City to proceed in compliance with applicable laws.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this reference as findings of the City Council.
SECTION 2. The City Council hereby rescinds Resolution No. 2025- 362 and replaces it with this Resolution No. 2026- 008. The City Council finds and declares that the Properties are exempt surplus land under Government Code Section 54221(f)(1) (B) because they are smaller than one-half acre, are not contiguous to land owned by a state or local agency used for open-space or low- and moderate-income housing purposes.
SECTION 3. The City Council hereby authorizes the City Manager or designee to take all necessary actions to comply with the Surplus Land Act for exempt surplus land and to facilitate the disposition of the Properties in accordance with applicable laws.
SECTION 4. This Resolution does not authorize the sale or disposition of the Properties at this time. Any future sale or transfer of the Properties shall be subject to applicable legal and environmental review.
SECTION 5. The City has reviewed this action in accordance with the California Environmental Quality Act (CEQA) and has determined that:
• The declaration of the Properties as exempt surplus land does not constitute a “project” under CEQA Guidelines Section 15378.
• Alternatively, if considered a project, it qualifies for a Class 12 categorical exemption (CEQA Guidelines Section 15312) as the sale of surplus government property with no significant environmental impact.
SECTION 6. Severability. If any provision of this Resolution or its application is held invalid, such invalidity shall not affect other provisions, which shall remain in full force and effect.
SECTION 7. Effective Date. This Resolution shall become effective immediately upon adoption.
