BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this reference.
Resolution No. 2026-088
Resolution No. 2026-088
June 17, 2026
SECTION 2. The City Council hereby approves Cooperative Agreement No. 25-1003340 between the City of San Bernardino and the San Bernardino County Transportation Authority.
SECTION 3. The City Manager or designee is hereby authorized to execute the Cooperative Agreement and any necessary administrative documents to implement the project in accordance with the terms of the agreement.
SECTION 4. The Director of Finance & Management Services is authorized to amend the budget to include $1,277,600 from Measure I for FY 2027/28.
SECTION 5. The Mayor and City Council finds that approval of this Resolution and the Cooperative Agreement does not constitute a “project” within the meaning of the California Environmental Quality Act (CEQA) (Public Resources Code §21065) and CEQA Guidelines §15378(b)(5), because it involves administrative and fiscal activities, including funding allocation and interagency coordination, that will not result in a direct or reasonably foreseeable indirect physical change in the environment. In the alternative, even if the activity were deemed a project, it is exempt from CEQA pursuant to CEQA Guidelines §15061(b)(3) (the common sense exemption), because it can be seen with certainty that there is no possibility that approval of the Cooperative Agreement, which is limited to project development activit ies (including environmental review, design, and right -of-way planning), will have a significant effect on the environment. Environmental review for the Del Rosa Avenue / State Route 210 Interchange Improvements Project will be conducted at the appropriate time prior to any approval of physical construction or implementation activities.
SECTION 6. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
SECTION 7. Effective Date. This Resolution shall become effective immediately.
APPROVED and ADOPTED by the City Council and signed by the Mayor and attested by the City Clerk this 17th day of June 2026.
