Application For Appeal
Required Information For An Appeal
Specific Action Being Appealed and the Date of That Action:
Denial of Subdivision 26-03 (tentative Parcel map No. 21096) & Conditional Use Permit 25-02 on March 10, 2026 Specific Grounds for the Appeal: Firstly, Only 5 of the 9 Planning Commissioner were in attendance and the 3-2 denial. Had a full commission been present we feel the case may have been different for approval. Secondly, the denial seemed to be primarily predicated on assumption that a "better" or "higher" mixed-use/TOD could be imagined/discovered/pursued instead somewhere/somehow down the line. The subject site is 6 parcels, on only roughly 0.75 acres and rests at the very edge of the TOD overlay. It has been vacant for years and the land owner found McDonald's to be an ideal, proactive, and responsible partner to revitalize this corner and the only viable entitlement that has even been pursued here in some time. Thirdly, teh TOD allows this use in cases where it is economically beneficial which this proposal is. There are other opportunities in the TOD to achieve the goal of the TOD besides this location.
Action Sought:
Appeal of Subdivision 26-03 (tentative Parcel map No. 21096) & Conditional Use Permit 25-02 to the city council for further review.
Additional Information: This is intended to be a major business investment by a multinational company in the City of San Bernardino with millions of dollars in food sales projected annually, 60-80 new jobs anticipated, an emphasis on general site improvements (landscaping, high quality on-site lighting, a contemporary elevated design, offsite work, and much more) on a dilapidated site and most importantly, would be managed with a determined emphasis on maintenance, longevity, and community benefit.
