City Manager’s Comments
The City Manager recommends extending the lease for 5 years to 2032.
Executive Summary
The proposed lease amendment will extend a current lease agreement between the San Bernardino Police Department and Inland Center Mall which has been in place for nearly the past seven years. The lease agreement is due to expire in January 2027. The police department substation is a valuable tool and serves various critical functions. The police department and the Inland Center Mall wish to extend the lease agreement with no contract changes for an additional five years.
Background
On January 15 th, 2020, The Mayor and City Council adopted Resolution 2020-12, authorizing the City Manager to execute a lease agreement for a police sub-station at the Inland Center mall at a cost of $1 annually. The original lease agreement was for a term of seven (7) years, from February 1st, 2020, to January 31st, 2027. This lease is due to expire and both parties desire to extend the lease for an additional five (5) years until January 2032 under the same terms and conditions.
Discussion
In July 2019, the City was approached by Santa Monica based Macerich (NYSE:
MAC), a publicly traded Real Estate Investment and Trust (REIT) and property owner and operator of 48 regional shopping centers located across the nation, including Inland Center Mall, with a proposal for a San Bernardino Police Department sub-station to be located within the Inland Center Mall. Macerich proposed conducting hundreds of thousands of dollars in tenant improvement to renovate the interior and exterior office space at the Inland Center Mall at no cost to the City of San Bernardino. Macerich offered to cover all utility costs associated with staffing the substation.
In 2020, the City Council approved the Inland Center Mall sub-station, and the police department has occupied the location since then. The substation is currently staffed with the Community Affairs division. The sub-station has also been used as a District resource office for sworn personnel and officers assigned to department specific grants as well as an auxiliary command post during large scale special events at the National Orange Show. Retail theft operations conducted inside of the mall also utilize the substation for logistics.
Sworn personnel and professional staff have hosted and participated in dozens community events inside of the mall including business pop-up events, quarterly craft with a cop events, incorporating both volunteer and explorer programs. With the presence of the community affairs division at the Inland center mall, these events will continue to occur and expanded upon.
Both the Inland Center Mall and the San Bernardino Police Department have benefited from this relationship. With the increased police presence, mall personnel and patrons have expressed an increase in safety and security along with a decrease in crime, specifically theft. Both parties wish to extend the original lease for an additional five (5) years under the same terms and conditions. The first lease amendment would extend the San Bernardino Police Department lease to January 31st, 2032.
2021-2025 Strategic Targets and Goals
The request to enter into an agreement with the Inland Center Mall to extend the lease for a police sub-station aligns with Goal No. 2: Provide for the safety of City residents and businesses. Improving the effectiveness of the police department will enable the City to improve public safety and better serve the City’s residents and businesses.
Fiscal Impact
The funds are available in the adopted Fiscal Year Budget and there is no additional fiscal impact to the general fund.
Conclusion
It is recommended that the Mayor and City Council of the City of San Bernardino, California, approve the First Amendment to the Inland Center Mall Substation Lease Agreement extending the lease to January 2032 under the same terms and conditions.
