This includes reducing the total number of residential units from 980 to 327, increasing the amount of preserved open space from 235 acres to 300 acres, and providing additional emergency access to the development for first responders. Background

On December 10, 2025, the City of San Bernardino Development and Environmental Review Committee (DERC) voted to forward the project to the Planning Commission for consideration. On January 13, 2026, the Planning Commission recommended approval of the project to the Mayor and City Council.

On May 6, 2026, the Mayor and City Council considered Resolution No. 2026-042 for Subdivision 23-05, adoption of the Addendum to the Final Subsequent Environmental Impact Report and Mitigation Monitoring and Reporting Program (SCH #2007071155), and Ordinance No. 1664 dissolving Development Agreement 08-02. Following public testimony, the Mayor and City Council unanimously continued the item to the June 3, 2026, regular meeting.

On June 3, 2026, the Mayor and City Council reconsidered Resolution No. 2026-042, the Addendum to the Final Subsequent Environmental Impact Report and Mitigation Monitoring and Reporting Program (SCH #2007071155), and Ordinance No. 1664 dissolving Development Agreement 08-02. Following public testimony, the item was unanimously continued to the July 15, 2026, meeting.

At the public hearing held on July 15, 2026, the Mayor and City Council considered Resolution No. 2026-042 regarding Tract Map No. 20595 for Subdivision No. 23-05.

Following public testimony from the Applicant, Encore, and representatives of the Crestline Soaring Society, Council Member Ortiz made a substitute motion, seconded by Council Member Knaus, to amend the tract map by relocating two residential lots into the Lot B Open Space parcel and adding the following Condition of Approval:
"Prior to Final Map recordation, two lots (with at least one of them being Lot 327 of Tract Map No. 20595 presented to the Mayor and City Council on July 15, 2026) shall be removed from the tract map and may be relocated and incorporated into the Lot B Open Space parcel. Street lights shall be placed on the opposite side of the right-of- way from Lot B to encourage a safe hang-glider approach zone." The substitute motion also directed staff to prepare a policy pursuant to the authority in Chapter 12.88 of the San Bernardino Municipal Code (Streets, Sidewalks, and Public Places – Hand Gliding) to establish a designated flight path for the Crestline Soaring Society's hang-gliding activities. Staff plans to bring back to the August 19, 2026 regular meeting of the Mayor and City Council a resolution adopting such a policy.

During the public hearing, both the Applicant, Encore, and the Crestline Soaring Society expressed their agreement with the proposed Condition of Approval. The substitute motion was subsequently approved by a 5-1 vote, with Council Members Ibarra, Figueroa, Knaus, Flores, and Ortiz voting in favor and Council Member Shorett voting in opposition.

Discussion
On May 6, 2026 and continued to the June 3, 2026 and then continued again to the July 15, 2026 meeting; the Mayor and City Council introduced Ordinance No. MC – 1664 to amend the development standards and guidelines of the original development 2 8

of the University Hills Specific Plan, reduce the number of proposed single-family residential lots from 980 to 327, and dissolve Development Agreement 08-02. Pursuant to Section 19.74.040 (Council Action on Amendments), amendments shall be adopted by ordinance and therefore become effective thirty (30) days after the second reading and adoption. Specifically, the amendment would include the following changes:
•Reduce the number of Planning Areas from 24 to 4.
•Reduce the residential density of the Project from a maximum of 20 dwelling units per acre (du/acre) to 3 du/acre.
•Increase the amount of land preserved in perpetuity as open space from approximately 235 acres to approximately 300 acres, to better accommodate environmental site constraints, such as seismic and biological constraints. •Reduce the number of allowed residential dwelling units (DU) from 980 DU to 327 DU.
•Redesign of the conceptual park plans.
•Update the circulation plan to connect Badger Canyon Road south to Campus Drive and add additional emergency vehicle access roads. •Update of development standards and design guidelines to focus on single- family residential development.

In Addition, the applicant has requested that Development Agreement 08-02 be dissolved and removed from the property title. The previous developer failed to satisfy the required obligations of the 5-Year Performance Plan under Section 3.1.1, including acquiring off-site rights-of-way and submitting required construction and development plans. As a result, the agreement shall be terminated pursuant to Section 3.2.

Furthermore, the provisions of Development Agreement 08-02 are no longer applicable to the proposed Specific Plan Amendment. A Memorandum of Understanding will replace the expired agreement, and Planning Conditions of Approval have been incorporated into the Resolution to preserve California State University, San Bernardino's interests regarding access, maintenance, open space, and campus facilities.
2021-2025 Strategic Targets and Goals
Specific Plan Amendment 23-01 will add needed attainable housing in the City of San Bernardino. This aligns with Goal No. 3: Improved Quality of Life.

Fiscal Impact
Community Development and Housing fees in conjunction with Public Works fees come to approximately $1,606,930.00 in permits (base); and Community Fee District (CFD) fees will generate approximately $141,615 annually.

Conclusion
It is recommended that the Mayor and City Council of the City of San Bernardino, California, 1) Adopt Ordinance No. MC – 1664 approving Specific Plan Amendment 23-01 amending the development standards and guidelines of the original 2 8
