FIRST AMENDMENT TO
AGREEMENT FOR MUNICIPAL LEGAL SERVICES AND CITY ATTORNEY
SERVICES BETWEEN CITY OF SAN BERNARDINO AND BEST BEST & KRIEGER LLP
This First Amendment to the Agreement for Municipal Legal Services and City Attorney Servicesbetween the City of SanBernardino, a California charter city (" City") and Best Best & Krieger LLP, a limited liability partnership engaged in the practice of law (" BB& K") is dated June 19, 2019. The City and BB& K may hereafter be referred to individually as Party and collectively as Parties.
RECITALS
WHEREAS, on August 1, 2018, the City and BB& K entered into an Agreement for Municipal Legal Services and City Attorney Services (" Agreement"); and WHEREAS, under the Agreement, BB& K may provide the City with advice on code enforcement matters, which could include as -needed prosecution services; and WHEREAS, under the Agreement, code enforcement matters are treated as special legal services and are provided at the following current rates: $ 310 per hour for Partners and Of Counsel; $ 260 per hour for Associates; and $ 155 per hour for Paralegals and Law Clerks; and WHEREAS, the City currently has an agreement for City Prosecutor services with another law firm through June 30, 2019 and will require City Prosecutor services in addition to code enforcement assistance beyond that date should that current agreement not be renewed; and WHEREAS, the Parties now wish to amend the Agreement to establish a reduced rate for as -needed code enforcement legal services and City Prosecutor services.
AGREEMENT
Subdivision J of Section 3 of Exhibit A to the Agreement is hereby deleted.
2. Section 8 is hereby addedto Exhibit A to the Agreement to read in its entirety asfollows:
8. Cite Prosecutor and Code Enforcement. BB& K shall provide Client with code enforcement legal services and City Prosecutor services, if required, at the following rates:
All Attorneys $ 220. 00 per hour
Paralegals $ 155. 00 per hour
Law Clerks $ 155. 00 per hour
The above rates shall be subject to Section 5 of this Exhibit A."
3. This First Amendment shall be effective beginning July 1, 2019.
4. Except as specifically stated herein, all other provisions of the Agreement remain in full force and effect.
5. This First Amendment may be signed in counterparts, each of which shall constitute an original.
