Subject: Adoption of Ordinance No. MC-1668 -CFD No. 2019-1 (Maintenance Service) - Annexation No. 54 - Quick Quack Car Wash (Ward 2)
Recommendation:

It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Ordinance No. MC-1668 amending Ordinance No. MC-1522 and levying special taxes to be collected during Fiscal Year 2026-2027 to pay the annual costs of the maintenance and servicing of lighting, streets, drainage and a reserve fund for capital replacement, and administrative expenses with respect to City of San Bernardino Community Facilities District No. 2019-1 (Maintenance Services).

City Manager's Comments
This is a second reading and adoption of Ordinance No. MC-1668-CFD No. 2019-1.

Executive Summary
The recommended action is the final step in annexation No. 54 to the Community Facilities District (CFD) No. 2019-1 (Maintenance Services) for the Quick Quack Car Wash development located south of Highland Avenue and west of Del Rosa Avenue.

Annexation No. 54 consists of one parcel, APN 0147-271-38, owned by 1435 East Highland, LLC.

On August 5, 2026, the Mayor and City Council considered the continued public hearing, conducted the special landowner election, adopted Resolutions Nos. 2026- 098 and 2026-099, and introduced Ordinance No. MC-1668 for first reading. Adoption of Ordinance No. MC-1668 is the final Council action to authorize levy of the special tax within the annexed property. Special tax revenues will be used to fund eligible maintenance costs for public improvements within and benefiting the development.

The property owner has petitioned the City to annex into the City’s CFD to mitigate its impact for maintenance service of public facilities as a result of the new development.

The Public Hearing was held on July 15, 2026, approving the annexation and conducted the first reading of the Ordinance. The special taxes will be levied annually to offset general fund expenditures related to maintenance of public improvements within and for the benefit of the development.

Background
On June 3, 2026, the Mayor and City Council adopted Resolution No. 2026-060, a Resolution of Intention to annex territory into Community Facilities District No. 2019-1 (Maintenance Services) of the City of San Bernardino (the “Resolution of Intention”), pursuant to the provisions of the “Mello-Roos Community Facilities Act of 1982”.
