RESOLUTION NO. 2026-150

RESOLUTION OF THE MAYOR AND CITY COUNCIL OF

THE CITY OF SAN BERNARDINO, CALIFORNIA,

AUTHORIZING THE DIRECTOR OF FINANCE AND
MANAGEMENT SERVICES TO AMEND THE FY 2026/27

CAPITAL IMPROVEMENT PLAN BUDGET WITH AN
ADDITIONAL $250,000 FROM MEASURE S FUND FOR THE

PROJECT, APPROVING AN INCREASE IN THE TOTAL

BUDGET FOR THE ANIMAL SHELTER IMPROVEMENT

PROJECT, AND AUTHORIZING THE CITY MANAGER OR

DESIGNEE TO EXPEND THE CONTINGENCY FUNDS
WHEREAS, on June 4, 2025, the Mayor and City Council approved the award of a Construction Agreement with Leonida Builders Inc. in the amount of $1,075,370.00 for the construction of concrete pads, utility connections, and other site improvements necessary for the installation of twelve modular buildings and associated parking lot improvements for the Animal Shelter Improvement Project. The City Council also authorized $500,000.00 for construction contingencies, construction management, and administrative costs associated with the project; and WHEREAS, additional project costs associated with revised utility requirements, site improvements, and project closeout have increased the projected cost of the Animal Shelter Improvement Project beyond the previously authorized project budget; and WHEREAS, an additional appropriation of $250,000 from the Measure S Fund is necessary to increase the project total budget from $1,575,370.00 to $1,825,370.00 and provide sufficient funding to complete and close out the Project.

WHEREAS, an additional $250,000 allocation is needed to increase the Project fund and complete the Project.

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The above recitals are true and correct and are incorporated herein by this reference.

SECTION 2. The Director of Finance and Management Services is hereby authorized to amend the FY2026/27 CIP Budget Capital Improvement Plan with an additional $250,000 from the Measure S Fund for the Project.

SECTION 3. The Mayor and City Council hereby approve an increase of $250,000 in the total budget for the Animal Shelter Improvement Project, increasing the total budget from $1,575,370.00 to $1,825,370.00.

SECTION 4. The City Manager or designee is hereby authorized to expend the additional funds, as necessary, to complete and close out the Animal Shelter Improvement Project, subject to Resolution No. 2026-150

the terms of the applicable construction agreement, the approved project scope, and applicable City contracting and purchasing requirements.

SECTION 5.CEQA. The City Council finds that the Animal Shelter Improvement Project is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines section 15302, Replacement or Reconstruction (“Class 2”).

The Class 2 exemption applies to the replacement or reconstruction of existing structures or facilities where the new structure or facility will be located on the same site as the structure or facility replaced and will have substantially the same purpose and capacity. The Project consists of minor improvements to and reconstruction of animal shelter facilities located on the existing Animal Shelter site.

The City Council has also considered whether any exception to the Class 2 categorical exemption set forth in State CEQA Guidelines section 15300.2 applies to the Project and finds that no exception applies for the following reasons:

A. Location. The location exception set forth in State CEQA Guidelines section 15300.2(a) applies only to projects relying on the Class 3, Class 4, Class 5, Class 6, or Class 11 categorical exemptions. Because the City is relying on the Class 2 exemption, the location exception does not apply.

B. Cumulative Impact. The Project would not result in a significant cumulative impact on the environment. There are no successive projects of the same type in the same place that, over time, would result in a significant cumulative impact, and the Project would not make a cumulatively considerable contribution to any significant environmental effect.

C. Unusual Circumstances. The Project does not involve unusual circumstances, and there is no reasonable possibility that the Project will have a significant effect on the environment due to unusual circumstances.

D. Scenic Highways. The Project would not result in damage to scenic resources, including trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway.

E. Hazardous Waste Sites. The Project site is not included on any list of hazardous waste and substance sites compiled pursuant to Government Code section 65962.5.

F. Historical Resources. The Project would not cause a substantial adverse change in the significance of a historical resource. The Project site does not contain a historical resource, as defined by CEQA.

The City Council further finds that the determination that the Project is exempt from CEQA reflects the City Council’s independent judgment and analysis.

SECTION 6.Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
