during grading and trenching during the construction of the Project. Therefore, the following mitigation is required.
Mitigation Measures
MM CUL-1 Discovery of Archaeological Resources. The Applicant shall retain an archaeologist who meets the requirements of the Secretary of the Interior (SOI) Professional Qualifications Standards (“Qualified Archaeologist”) prior to the issuance of grading permits. If archaeological resources are discovered at the Project site, they will be handled as described below. All artifacts discovered shall be inventoried and analyzed by the SOI Archaeologist. If any artifacts of Native American origin are discovered, all activities in the immediate vicinity of the find (within a 50-foot radius) shall stop, and the SOI Archaeologist shall notify the Applicant, City, and the Yuhaaviatam of San Manuel Nation (YSMN), the AB 52 consulting tribe for the Project, as detailed in MM TCR-1. A designated Native American representative from YSMN shall be retained to help analyze the Native American artifacts for identification as everyday life and/or religious or sacred items, cultural affiliation, temporal placement, and function, as deemed possible. The significance of Native American resources shall be evaluated in accordance with CEQA and shall consider the religious beliefs, customs, and practices of the affiliated tribes. All items found in association with Native American human remains shall be regarded as grave goods or sacred in origin and subject to special handling.
Native American artifacts relocated or reinterred at the Project site would be subject to a fully executed relocation/reburial agreement with the assisting Native American tribes or bands. This shall include measures and provisions to protect the reburial area from any future impacts. Relocation/reburial shall not occur until all cataloging and basic recordation are complete. Native American artifacts that cannot be avoided or relocated at the Project site shall be prepared in a manner for curation at either a Native American facility or an accredited curation facility in San Bernardino County that meets federal standards per 36 CFR Part 79 and makes the artifacts available to other archaeologists/researchers/ Native American community members for further study. The SOI Archaeologist shall deliver the Native American artifacts, including title, to the accredited curation facility within a reasonable amount of time, along with the fees necessary for permanent curation.
Non-Native American artifacts shall be inventoried, assessed, and analyzed for cultural affiliation, personal affiliation (prior ownership), function, and temporal placement. After analysis and reporting, these artifacts will be either curated or returned to the property owner, as deemed appropriate. All artifacts, except for human remains and related grave goods or sacred/ceremonial objects, belong to the property owner.
MM CUL-2 In the event that cultural resources are discovered during project activities, all work in the immediate vicinity of the find (within a 60-foot buffer) shall cease, and a qualified archaeologist meeting Secretary of the Interior standards shall be hired to assess the find.
Work on the other portions of the project outside of the buffered area may continue during this assessment period. Additionally, the Yuhaaviatam of San Manuel Nation Cultural Resources Department (YSMN) shall be contacted, as detailed within TCR-1, regarding any pre-contact finds and be provided information after the archaeologist makes his/her initial assessment of the nature of the find, so as to provide Tribal input with regards to significance and treatment.

MM CUL-3 If significant pre-contact cultural resources, as defined by CEQA (as amended, 2015), are discovered and avoidance cannot be ensured, the archaeologist shall develop a Monitoring and Treatment Plan, the drafts of which shall be provided to YSMN for review and comment, as detailed within TCR-1. The archaeologist shall monitor the remainder of the project and implement the Plan accordingly.
c) Would the project disturb any human remains, including those interred outside of formal cemeteries?
Impact Analysis – Less Than Significant
The Project site does not contain a cemetery, and no known formal cemeteries are located within the immediate site vicinity. If human remains are discovered during Project grading or other ground-disturbing activities, the Project would be required to comply with the applicable provisions of California Health and Safety Code §7050.5 and Public Resources Code §5097 et seq., as required by CEQA Guidelines Section 15064.5(e). With mandatory compliance with these existing statutory requirements, impacts under Threshold 4.5(c) would be less than significant.

Little Mountain Residential 4.18 Tribal Cultural Resources City of San Bernardino 107
As discussed in Section 4.5, Cultural Resources, the Phase I Archaeological and Paleontological Resources Study (Appendix C) did not identify any historical or archaeological resources on the Project site. A Sacred Lands File (SLF) search was conducted by Psomas on April 6, 2025 from the Native American Heritage Commission (NAHC). The NAHC SLF search came back positive for sacred lands important to the Native American community. The City conducted AB 52 consultation with the Yuhaaviatam of San Manuel Nation (YSMN) (discussed below), which did not identify any tribal cultural resources that are listed or eligible for listing in the CRHR. However, because there is a possibility of encountering subsurface resources during grading that could qualify as both historical and tribal cultural resources, Mitigation Measures MM CUL-1 through MM CUL-3 require retention of a qualified archaeologist, notification of YSMN upon any pre-contact discovery, and preparation of a Monitoring and Treatment Plan if significant resources are found. With implementation of these measures, impacts would be less than significant with mitigation.
b) A resource determined by the lead agency, in its discretion and supported by substantial evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public Resources Code Section 5024.1. In applying the criteria set forth in subdivision (c) of Public Resource Code Section 5024.1, the lead agency shall consider the significance of the resource to a California Native American tribe? Impact Analysis – Less Than Significant Impact with Mitigation Assembly Bill (AB) 52 created a process for consultation with California Native American Tribes in the CEQA process. Tribal Governments can request consultation with a lead agency and give input into potential impacts on tribal cultural resources before the agency decides what kind of environmental assessment is appropriate for a proposed Project.
The City of San Bernardino commenced the AB 52 process by sending consultation invitation letters to tribes that had previously requested notification pursuant to Public Resources Code § 21080.3.1. The Yuhaaviatam of San Manuel Nation (YSMN) responded August 27, 2026 and asked that the following mitigation measures be incorporated.
Mitigation Measures
MM TCR-1 The Yuhaaviatam of San Manuel Nation Cultural Resources Management Department (YSMN) shall be contacted, as detailed in CUL-2, of any pre-contact cultural resources discovered during project implementation, and be provided information regarding the nature of the find, so as to provide Tribal input with regard to significance and treatment. Should the find be deemed significant, as defined by CEQA (as amended, 2015), a Cultural Resources Monitoring and Treatment Plan shall be created by the archaeologist, in coordination with YSMN, and all subsequent finds shall be subject to this Plan. This Plan shall allow for a monitor to be present that represents YSMN for the remainder of the project, should YSMN elect to place a monitor on-site.
MM TCR-2: Any archaeological/cultural documents created as a part of the project (isolated records, site records, survey reports, testing reports, etc.) shall be supplied to the applicant and Lead Agency for dissemination to YSMN. The Lead Agency and/or applicant shall, in good faith, coordinate with YSMN throughout all ground-disturbing activities associated with project construction, consistent with the mitigation measures adopted for the project pursuant to Public Resources Code Section 21082.3.
