The City reserves the right to request additional information which, in the City’s opinion, is necessary to assure that the Proposer’s competence, number of qualified employees, business organization, and financial resources are adequate to perform according to the Agreement.

2. Preparation: Proposals should be prepared in such a way as to provide a straightforward, concise delineation of capabilities to satisfy the

Page 14 of 41 ends

requirements of this RFP. Responses should emphasize the Proposer’s demonstrated capability to perform the Services. Expensive bindings and promotional materials, etc., are not necessary or desired. However, technical literature that supports the approach to providing the Services and work plan should be forwarded as part of the proposal. Emphasis should be concentrated on completeness, approach to the work and clarity of proposal.

3. Site Examination: Proposers may visit the City and its physical facilities to determine the local conditions which may in any way affect the performance of the work; familiarize themselves with all federal, state and local laws, ordinances, rules, regulations, and codes affecting the performance of the work; make such investigations, as it may deem necessary for performance of the Services at its proposal price within the terms of the Agreement; and correlate its observations, investigations, and determinations with the requirements of the Agreement.

4. Authorization: The proposal shall be signed by an individual, partner, officer or officers authorized to execute legal documents on behalf of the Proposer.

5. Confidentiality of Proposal: Pursuant to Michaelis, Montanari, & Johnson v. Superior Court (2006) 38 Cal.4th 1065, proposals submitted in response to this RFP shall be held confidential by City and shall not be subject to disclosure under the California Public Records Act (Cal. Government Code section 6250 et seq.) until after either City and the successful Proposer have completed negotiations and entered into an Agreement or City has rejected all proposals. All correspondence with the City including responses to this RFP shall become the exclusive property of the City and shall become public records under the California Public Records Act.

Furthermore, the City shall have no liability to the Proposer or other party as a result of any public disclosure of any proposal or the Agreement.

If a Proposer desires to exclude a portion of its proposal from disclosure under the California Public Records Act, the Proposer must mark it as such and state the specific provision in the California Public Records Act which provides the exemption as well as the factual basis for claiming the exemption. For example, if a Proposer submits trade secret information, the Proposer must plainly mark the information as “Trade Secret” and refer to the appropriate section of the California Public Records Act which provides the exemption as well as the factual basis for claiming the exemption. Although the California Public Records Act recognizes that certain confidential trade secret information may be protected from disclosure, the City may not be in a position to establish that the information that a Proposer submits is a trade secret. If a request is made for information marked “Confidential”, “Trade Secret” or “Proprietary” (“Proprietary Information”), the City will provide Proposers who submitted the information with reasonable notice to seek protection from disclosure by a court of competent jurisdiction. Proposer shall have five (5) working

Page 15 of 41 ends

days after receipt of such notice to give City written notice of Proposer's objection to the City's release of Proprietary Information. Proposer shall indemnify, defend and hold harmless the City, and its officers, directors, employees, and agents from and against all liability, loss, cost or expense (including attorney's fees) arising out of a legal action brought to compel the release of Proprietary Information.

Proposals which indiscriminately identify all or most of the proposal as exempt from disclosure without justification may be deemed unresponsive and disqualified from further participation in this procurement.

6. Submittal Instructions: Electronic PDF file format via Planetbids. Please allow time for system to process your proposal. The proposal must be received before 3:00pm local time, on or before June 2, 2026. The City shall not be responsible for proposals that are not received on time. The City will not be responsible for and will not accept late bids due to slow internet connections, or incomplete transmissions.

K. General Conditions

1. Federal Requirements: If the Services are funded through a federal funding source, the successful Proposer and its subcontractors shall be required to take cognizance of and comply with all requirements set forth in the Federal Requirements, attached hereto as Exhibit “C”, and incorporated herein by this reference.

2. Amendments to RFP: The City reserves the right to amend the RFP and issue to all Proposers an addendum.

3. Amendments to Proposals: Unless specifically requested by the City, no amendment, addendum or modification shall be accepted after a proposal has been submitted to City. If a change to a proposal that has been submitted is desired, the submitted proposal must be withdrawn and the replacement proposal submitted prior to the deadline stated herein for receiving proposals.

4. Non-Responsive Proposals: A proposal may be considered nonresponsive if conditional, incomplete, or if it contains alterations of form, additions not called for, or other irregularities that may constitute a material change to the proposal.

5. Costs for Preparing: The City shall not compensate any Proposer for the cost of preparing any proposal, and all materials submitted with a proposal shall become the property of the City. The City will retain all proposals submitted and may use any idea in a proposal regardless of whether that proposal is selected.

6. Cancellation of RFP: City reserves the right to cancel this RFP at any time prior to contract award without obligation in any manner for proposal preparation, interview, fee negotiation or other marketing costs associated with this RFP.

Page 16 of 41 ends

7. Price Validity: Prices provided by Proposers in response to this RFP are valid 45 days from the proposal due date. The City intends to award the contract within this time but may request an extension from the Proposers to hold pricing, until negotiations are complete, and the contract is awarded.

8. No Commitment to Award: Issuance of this RFP and receipt of proposals does not commit the City to award a contract. City expressly reserves the right to postpone the proposal for its own convenience, to accept or reject any or all proposals received in response to this RFP, to negotiate with more than one Proposer concurrently, or to cancel all or part of this RFP.

9. Right to Negotiate and/or Reject Proposals: City reserves the right to negotiate any price or provision, task order or service, accept any part or all of any proposals, waive any irregularities, and to reject any and all, or parts of any and all proposals, whenever, in the sole opinion of City, such action shall serve its best interests and those of the tax-paying public. The Proposers are encouraged to submit their best prices in their proposals, and City intends to negotiate only with the Proposer(s) whose proposal most closely meets City’s requirements at the lowest estimated cost. The Agreement, if any is awarded, shall go to the Proposer whose proposal best meets City’s requirements.

10. Non-Discrimination: The City does not discriminate on the basis of race, color, national origin, religion, age, ancestry, medical condition, disability or gender in consideration for an award of contract.

11. Minor Irregularities: The City reserves the right to waive any minor irregularity, informality, or non-substantive deficiency in a proposal. A minor irregularity is one that:
a. Does not affect the responsiveness of the proposal;
b. Is merely a matter of form or format;
c. Does not change the relative standing or otherwise prejudice other proposals;
d. Does not change the meaning or scope of the RFP;
e. Is trivial, negligible, or immaterial in nature;
f. Does not reflect a material change in the work; or
g. Does not constitute a substantial reservation against a requirement or provision.

In such cases, the Proposer may be notified of the deficiency and provided an opportunity to correct the irregularity, defect, or variation, or the City may elect to waive the deficiency and accept the proposal. The decision to waive a deficiency shall not modify or compromise the overall intent of the RFP or excuse the Proposer from full compliance with all material requirements if awarded a contract.

HOSS issues each applicant a secure, personalised online invitation. The applicant completes a customised intake form capturing all information required for the agreed screening package, including FCRA-required disclosures, written authorisation, and California ICRAA-specific consent language. Biometric identity validation (TrustID) occurs at this stage. All data is encrypted in transit and at rest from submission.

SSN Verification, Name/Address Trace, Date of Birth (Exhibit A, Section II(II)(a-c)) Horus verifies each applicant's Social Security Number through an SSN-based name and address history database, confirming the SSN was issued and associating it with the applicant's name. The address trace identifies current and prior addresses for seven years, driving jurisdiction selection for downstream checks. Aliases identified through the trace are researched accordingly. Date of birth is confirmed against identity research and government-issued ID.

Criminal Records - Seven Years, County, State, Federal (Exhibit A, Section II(II)(d)) Live searches of official government records - county court indices, statewide criminal repositories, state incarceration records, state sex offender registries, and federal PACER - in every jurisdiction associated with the applicant during the past seven years. Private databases are used only as investigative leads; all records are verified with the originating government entity. Minimum twoidentifier matching. Two-stage quality review before release to the City.

Current and Previous Residences - Seven Years (Exhibit A, Section II(II)(e)) Seven-year residence history identified through the SSN / identity research trace. Every associated county and state jurisdiction is then searched for criminal history, ensuring comprehensive geographic coverage of the applicant's residential history throughout the reporting period.

Driving Record - Lifetime Criminal / Seven-Year Violations / Licence Validity (Exhibit A, Section II(II)(fh)) MVRs obtained from the appropriate state DMV or MVR provider. Records include: (a) lifetime criminal driving history and out-of-state convictions; (b) moving violations for up to seven years; and (c) current validity of all motor vehicle licences held. Configurable as a standard or optional add-on per role type.

Intrepida Group Inc | RFP F-26-1055 - Pre-Employment Background Screening | City of San Bernardino CONFIDENTIAL | Document No. 1 - Technical Proposal
Risk Management Scan (Exhibit A, Section II(II)(i))
Analytical review of the applicant's screening results as a whole to identify inconsistencies, gaps, or potential misrepresentation across identity, employment, education, criminal history, and public records. Identified inconsistencies are flagged in the report with a clear summary of the discrepancy and, where possible, the source data. Included as a standard component of every screening package at no additional charge.

Employment Verification (Exhibit A, Section II(II)(j))
Direct verification with employer HR departments or authorised verification sources for current employment and the two most recent prior employers, covering up to seven years. Discrepancies between applicant-provided and employer-verified information are clearly identified in the report.

Where an employer is unresponsive, Horus documents contact attempts on three separate business days and reopens on City request.

Credit Information (Exhibit A, Section II(II)(k))
FCRA-compliant credit reports covering up to seven years of credit history, obtained only for roles with financial responsibilities, with applicant's specific written authorisation consistent with FCRA and California ICRAA. Not obtained for roles where financial responsibility is absent.

Professional Licence Verification (Exhibit A, Section II(II)(l)) Validity and current status of all professional, trade, or government-issued licences verified directly with the issuing authority. Expired, suspended, or revoked licences are flagged in the report with current status.

Sex Offender Registry (Exhibit A, Section II(II))
National Sex Offender Registry check included in every screening package. State-level sex offender registry searches conducted in every state associated with the applicant.

Authorised Users (Exhibit A, Section III)
HOSS implements role-based access control. HR will designate Primary Authorised Users, who manage additional Authorised Users within the system. Additional users can only be added with written approval from a Primary Authorised User, enforced within the HOSS configuration.

Turnaround - Five Business Days (Exhibit A, Section 5)
Every request is acknowledged same business day and processed promptly. Complete reports delivered within five (5) business days of the official request. Individual checks are released through HOSS as soon as verified, providing real-time visibility. Where delay is anticipated, the City is notified immediately with a revised delivery estimate and justification.

Initial Consultation on Results (Exhibit A, Section VI) Horus will perform an initial consultation with a City HR representative for screening results meeting specific criteria outlined by the City. Consultation led by Doni Whitlow; covers the nature of the Intrepida Group Inc | RFP F-26-1055 - Pre-Employment Background Screening | City of San Bernardino CONFIDENTIAL | Document No. 1 - Technical Proposal
finding, its relevance to the role, and FCRA / California ICRAA adverse action options. Included at no additional charge.

Identity Theft Red Flags (Exhibit A, Section VI(i))
Horus implements policies and procedures to detect, prevent, and mitigate identity theft risk per 16 CFR Part 681 (Identity Theft Red Flags Rules). The SSN validation, address history, and TrustID biometric identity verification workflow is specifically designed to identify synthetic identity fraud, impersonation, and misrepresentation red flags. Where a red flag is identified, Horus follows documented mitigation procedures and notifies the City with recommended next steps.

NEOGOV Integration (Exhibit A, Section 6)
Integration of HOSS with the City's NEOGOV system is a mandatory requirement included in Horus's scope. The integration will achieve seamless data synchronisation, user management, and workflow automation across HR and recruitment processes, enabling the City to initiate screening orders, monitor status, and receive completed results within the NEOGOV environment. Horus confirms that the NEOGOV Open API integration approach has been technically validated and that Horus has reviewed NEOGOV's integration documentation. Horus's integration will follow a fourphase delivery model:
• Discovery (Weeks 5-6 from contract start). Joint workshop with the City's HR Technology team to confirm NEOGOV tenant configuration, in-scope screening packages, and field-level mapping. • Build (Weeks 7-9). Build of the HOSS / NEOGOV integration endpoints in development and test environments on both sides.
• Joint User Acceptance Testing (Weeks 10-11). UAT across a representative sample of orders and result types, including failure paths, with documented test cases. • Production Cutover (Week 12). Production cutover with a documented back-out path to manual HOSS portal entry. Full integration live by end of Week 12 from contract commencement.

Additional Services Offered
In addition to the services listed in Exhibit A, Horus offers the following complementary services that may benefit the City:
• Open-Source Intelligence (OSINT) Checks - detailed open-source and adverse-media background checks; particularly valuable for senior, safety-sensitive, or public-facing City roles. • Ongoing / Periodic Employee Rescreening - annual criminal record updates, MVR refresh for driving roles, and national sex offender registry rechecks for existing City employees. • Consulting and Policy Development - Horus's risk consultants can advise the City on background screening policy, risk-based criminal history evaluation, and FCRA / California ICRAA adverse action workflow design.
• Volunteer-Specific Screening Packages - cost-effective packages designed for City volunteer screening, compliant with California ICRAA requirements. • Drug Testing Coordination - coordination of pre-employment drug testing through the City's nominated laboratory, with results captured in HOSS.

CRITICAL ENTITIES
Animal Liberation Worldwide seek to publicise and aid the efforts of the ‘Animal Liberation Front’ (ALF) as well as related Animal Rights groups that engage in direct action.

Camp Beagle are at the heart of the UK AR movement with its permanent encampment outside laboratory beagle breeding facility, MBR Acres, Cambridgeshire.

PETA is an Animal Rights organisation that is opposed to animal research and is known to have promoted undercover investigations of animal research facilities for lobbying and animal liberation purposes.

INTREPIDA GROUP INC.
108 HAMBURG TPKE
BLOOMINGDALE, NJ 07403
Dear Mr. Rzucidlo,
Congratulations! I am pleased to inform you that INTREPIDA GROUP INC. has been approved for the following U.S. Small Business Administration (SBA) certification(s):
·         Veteran-Owned Small Business (VOSB)
·         Service-Disabled Veteran-Owned Small Business (SDVOSB) INTREPIDA GROUP INC. is eligible for VOSB / SDVOSB contracts and will be identified as a certified VOSB / SDVOSB program participant SBS as of the date of this letter, 09/11/2025.

To align with your existing certification, your effective date for recertification for all of your SBA certifications is 09/11. Your first certification renewal will be due 9/11/2028.

Responsibilities
The information below sets forth requirements related to your business’ continued eligibility and its responsibilities as a certified program participant:
·         Reporting Changes: You are required to notify SBA in writing of changes to your business that could affect its eligibility. Please refer to the attached supplemental pages for more details and examples. ·         System for Award Management (SAM.gov): You must keep the business' SAM.gov profile records up-to-date and active for the business to receive benefits from our Programs (i.e., to be identified by contracting officers as eligible to be awarded small business set-aside contracts and to be paid under any such contracts). You must validate your business’ SAM.gov information at least annually or your SAM.gov registration will become inactive. If you need assistance in updating the business' SAM.gov, please go to the SAM.gov Help Desk at https://FSD.gov/gSAfsd_sp. ·         SBA’s Small Business Search (SBS.gov): A SBS profile is automatically created when your SAM.gov registration has been fully validated and activated by SAM.gov. Currently, you are not able to access the SBS Supplemental Pages directly from SAM.gov. Once your profile is active you will be able to add supplemental information to enhance your SBS profile. If you need assistance in accessing and updating the business’s SBS.gov profile, instruction can be found at the SBS Wiki or please go to SBS Support Portal at https://sbaone.atlassian.net/servicedesk/customer/ portal/8.
·         Notices from SBA: You are responsible for responding to notices from SBA, including, but not limited to: notices regarding certification renewals, eligibility reviews, protests, proposed decertification and termination actions, and recertification requirements. All SBA Programs send such notices to the business' email address listed in its MySBA Profile.

If the business fails to respond to these notices, SBA will propose the business for decertification or termination, and may subsequently decertify or terminate it from participation in SBA Programs. Therefore, it is critical that you keep the business' SAM.gov and MySBA profiles current, including listing an active email address for contacting the business, and check your email's SPAM folder to make sure that you are receiving emails from SBA. ·         Contracting Requirements: You are required to comply with the "prime-contractor limitations on subcontracting" rule when performing any small business set-aside contracts (see 13 CFR 125.6).

Resources and More Information
As a certified program participant, there are valuable free resources available to you, including:
·         SBA Resource Partners: For general assistance on various topics, information on SBA programs, and upcoming small business events in your area. You can find your local resource partner by visiting: https:// www.sba.gov/tools/local-assistance.
·         The “Contract Opportunities” function in SAM.gov (https://sam.gov/ content/opportunities) serves as a central listing for Federal procurement opportunities. Anyone interested in doing business with the government can use this system to search opportunities. In addition, the “Contract Data” function in SAM.gov (https://sam.gov/content/contract-data) is a database accessible to the public at no cost and you may use it to learn about contract awards to businesses in various socioeconomic categories. ·         SBA’s Surety Bond Guarantee Program helps small businesses establish or increase bonding capacity. Bond guarantees increase eligibility for contracts up to $10M. Go to https://www.sba.gov/osg to find an SBA authorized agent.
·         APEX Accelerators are an official government contracting resource for small businesses. Find your local APEX Accelerator for free government expertise related to contract opportunities by visiting our website: https:// www.apexaccelerators.us.

Downloading Certification Icons
As a certified business participating in the program(s), you may visit SBA’s website to download SBA-approved digital icons that indicate your certification status for use on your business’ website, business cards, social media profiles, and in your capability statements and proposal bids.

However, you cannot use the digital icon to express or imply endorsement of any goods, services, entities, or individuals.  Thus, the digital icon cannot be used on a company’s letterhead, marketing materials or advertising, paid or public service announcements, in traditional or digital format.

Misrepresentation
Any business found to have willfully misrepresented its certification status in obtaining an SBA program set-aside or sole source award may be subject to a range of civil and criminal penalties, treble damages under the False Claims Act, and/or suspension or debarment from federal contracting.

Next Steps
It is important that you review the attached supplemental pages carefully.

These pages contain vital details about the program(s) you are now certified in, including period of eligibility, next steps, guidelines, and additional resources.

Our SBA team is here to support you and your business as you pursue new growth and build capacity. Please keep a copy of this letter to confirm INTREPIDA GROUP INC.'s continued program eligibility. Wishing you much success!
Sincerely,
Brittany Sickler
