PRESENTATION
1. Mayor and City Council Workshop
(a) The Role of the City Council Members and Mayor under the City Charter as a matter of law and understanding municipal corporations, responsibilities to the corporation and confidentiality;
(b) Conducting meetings;
(c) An introduction to Conflict of Interests laws, including the California Political Reform Act, California Government Code Section 1090 and Common Law Bias and Fair Process; and
(d) Understanding the City’s potential liability, including tort claims, employment claims and consequences of policy making.
City Attorney Sonia Carvalho provided a legal training presentation for the Mayor and City Council regarding their roles and responsibilities. The presentation covered the City Charter and council-manager form of government, applicable federal and state laws, municipal ordinances and policies, conducting meetings, conflict-of-interest and fiduciary responsibilities, confidentiality requirements, and an overview of pending litigation. City Attorney Carvalho emphasized the importance of understanding the legal framework governing the City and maintaining clear roles between the Council as policymakers and the City Manager as the administrator responsible for day-to-day operations. City Attorney reviewed conflict-of-interest laws, including the Political Reform Act and Government Code Section 1090, and discussed requirements for disclosure, disqualification, and recusal when financial interests were involved. She also addressed common-law bias and fair-process requirements for quasi-judicial matters, emphasizing the need for impartiality, attention to the record, and avoiding the appearance of bias. Further discussed municipal liability, including claims involving personal and property damage, dangerous conditions, employee matters, and permit applicants, and advised Council Members to report potentially dangerous conditions to staff so they could be addressed and liability reduced.
Mayor Pro-Tem and City Council had no questions or discussion regarding the presentation.
