1. Conduct a public hearing on Appeal 26-10; and

2. Adopt Resolution No. 2026-144 of the Mayor and City Council of the City of San Bernardino, California, denying Appeal 26-10 thereby upholding Planning Commission’s approval to adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program under the California Environmental Quality Act; approving Subdivision 25-01 (Tentative Tract Map No. 20707) allowing the subdivision of a project site comprised of six (6) parcels containing a total of approximately 107.7 acres into one hundred and five (105) single-family lots ranging in size from 10,000 to 24,891 square feet; located on the terminus of Antique Street; North of Verdemont Drive (APN: 0261-011-02, 03, and 10; and 0348-121- 14, 27, and 28) within the Residential Low (RL) Zone. (Attachment 1).

Mayor Tran opened the Quasi-Judicial Public Hearing at 5:18 p.m.

City Clerk Lopez swore-in the speakers.

In accordance with the requirements of a Quasi-Judicial hearing, the appellant, the developers representative and staff were given 15 minutes to speak and a five-minute rebuttal.

Mary Lanier Interim Director of Community Development and Housing and Chantel Choice Senior Planner presented Appeal 26-10 regarding Subdivision 25-01, Tentative Tract Map 20707. The project includes six new streets, access from Verdemont Drive, Regular Meeting Annotated Agenda September 2, 2026
Mayor and City Council of the City of San Bernardino Page 4 and two drainage basins. Staff stated that the Planning Commission approved the project and adopted the Mitigated Negative Declaration and Mitigation Monitoring Program on July 14, 2026. Staff recommended adoption of Resolution No. 2026-144 denying the appeal and upholding the Planning Commission’s approval of the project and associated environmental documents.

Hayley Uno representative of the appellant Supporters Alliance for Environmental Responsibility (“SAFER”) presented to the Mayor and City Council requesting that the City Council grant the appeal and not approve the Verdemont Heights project, asserting that the Mitigated Negative Declaration did not comply with CEQA. She stated that SAFER’s experts identified potentially significant impacts related to special-status species, air quality, greenhouse gas emissions, and construction noise, and contended that these impacts warranted preparation of an Environmental Impact Report (EIR).

Brent McManigal, representing the applicant, requested that the City Council deny the appeal and uphold the project approval. He disputed the appellant’s claims regarding biological resources, air quality, greenhouse gas emissions, and noise, stating that the analyses did not constitute substantial evidence of significant environmental impacts. He stated that the project’s environmental analysis used appropriate methodology and standards, included required mitigation measures, and had been reviewed by City staff and the Planning Commission. He further stated that recirculation of the environmental document and preparation of an Environmental Impact Report (EIR) were not required.

At this time, public comments were heard.

Claudia Cuevas spoke in support of the Verdemont Heights project, stating that responsible development could provide additional housing, businesses, services, and opportunities for future generations.

Valerie Perez spoke in support of the project, stating that additional housing could encourage investment and support local businesses.

Alejandra Gonzalez spoke in support of the project, stating that growth could provide families with greater access to local services, businesses, and activities.

Oscar Huerta expressed his support of the project, and stated that continued development and investment could contribute to economic growth.

Viviana Perez spoke in support of the project and stated that the City needs to focus on development.

Luis Ojeda spoke in support of the project and expressed concerns regarding outside environmental groups challenging development projects.

At this time, the quasi-judicial hearing resumed following the conclusion of public comments.

In rebuttal Hayley Uno, representing the appellant, stated that disagreements between the appellant’s experts and the City’s or developer’s experts regarding potential environmental impacts warranted preparation of an Environmental Impact Report (EIR).

Regular Meeting Annotated Agenda September 2, 2026
Mayor and City Council of the City of San Bernardino Page 5 She further stated that diesel particulate matter requires a separate analysis from particulate matter (PM2.5) and maintained that the City was responsible for conducting that analysis.

Council Member Ibarra questioned the appellant’s representative regarding the evidence of potential impacts to monarch butterflies and the timing of the appellant’s supporting documentation. The appellant’s representative stated that a wildlife survey identified monarch butterflies roosting on the project site and explained that the timing of the submittal was due to the time required for expert review of the project’s environmental documents.

Council Member Shorett expressed support for the project, citing the need for additional housing and raising concerns regarding challenges to development projects by outside organizations.

Council Member Fred Shorett made a motion to adopt Resolution No. 2026-144, seconded by Council member Ortiz.
