RESOLUTION NO. 2026-175

RESOLUTION OF THE MAYOR AND CITY COUNCIL OF

THE CITY OF SAN BERNARDINO, CALIFORNIA,
APPROVING A SIDE LETTER AGREEMENT TO THE 2025-
2028 MEMORANDUM OF UNDERSTANDING (MOU)

BETWEEN THE CITY OF SAN BERNARDINO AND

GENERAL UNIT EMPLOYEES REPRESENTED BY
TEAMSTERS, LOCAL 1932, AMENDING ARTICLE III -
COMPENSATION: SECTION 10 – HAZARD PAY
WHEREAS, On January 17, 2024, the City Council approved side letter agreements with various bargaining groups authorizing hazard pay for employees assigned to the Public Works Encampment Cleanup Crew. At the time, the crew consisted of two (2) Maintenance Supervisors, two (2) Lead Maintenance Workers, and eight (8) Maintenance Worker I employees; and WHEREAS, Following the designation of the classifications eligible for hazard pay, it was determined that the original designation of the Maintenance Worker I classification did not account for employees who flex into the Maintenance Worker II classification; and WHEREAS, Adding the classification designation Maintenance Worker I/II Flex will ensure that employees assigned to the Cleanup Crew remain eligible to receive hazard pay while performing the duties of the crew; and
WHEREAS, a side letter agreement with the General Unit and the City was tentatively agreed upon approval of its terms by City Council.

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The above recitals are true and correct and are incorporated herein by this reference.

SECTION 2. The City Manager or their designee is hereby authorized to execute the Side Letter Agreement attached hereto and incorporated herein, marked as Exhibit A.

SECTION 3. Employees who promoted to Maintenance Worker II and subsequently became ineligible for hazard pay will be retroactively compensated for the hazard pay beginning on the date they became ineligible.

SECTION 4. CEQA. The Mayor and City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
