7pm Regular Meeting

Items 6d

1. Hello, I intend to pull item 6d from consent to confirm the following:

I see that Cherry Avenue between Bayhill Drive and Sneath is on the list. I want to make sure for our constituents that maintenance and repair of this and other affected roads related to damage caused by construction of large projects is covered under the impact fees that we collect for those projects, so in other words although we will be outlaying funds to repair this road, we have already received funds in the form of impact fees from YouTube that cover this and other infrastructure-related impacts. I do understand that it's all general fund money and there's not a specific line item in the impact fees collected earmarked to pay X dollars to fix Cherry Avenue.

Item 6d, Attachment 3, lists two segments of Cherry Avenue that are included in the City’s upcoming pavement evaluation effort. These are streets that may be failing or near failed based on the pavement condition index (PCI). The two segments of Cherry Avenue identified are between Niles Avenue and Jenevein Avenue, and between Park Avenue and San Bruno Avenue. It does not include the portion of Cherry Avenue between Bayhill Drive and Sneath.

Cherry Avenue in that location currently has a higher PCI, in the good/very good range currently. The repair of pavement damage caused by construction related activities is covered under the project Conditions of Approval, which require the developer to conduct pre- and post-construction pavement condition surveys and make roadway repairs to achieve pre-construction conditions if any damage occurs during construction. Roads to be assessed by the YouTube construction project include along the project frontage at Cherry Avenue and Bayhill Drive and the approved haul routes, which includes the portion of Cherry Avenue between Bayhill Drive and Sneath Lane. As described in the Bayhill Area Development Impact Fees staff report (Item 7a), development impact fees are one-time charges on new development projects collected and used by the City to cover the cost of public facilities needed to serve new development. Development impact fees cannot be used to address existing deficiencies or ongoing maintenance projects, or damage caused during construction.

2. I intend to pull this item to better understand the scope and criteria for the streets selected for this item.

There are seventy-four streets identified in the staff report and seven streets are identified on the east side of El Camino.

The criteria for streets needing reconstruction are based on PCI less than 40, which are considered failed and near failed.
