PREPARED BY: Peter Gilli, Community Development Director Michael Smith, Senior Planner
SUBJECT: Consider Adoption of an Ordinance Entitled “An Ordinance of the City Council of the City of San Bruno Amending the Planned Development (P- D) District Created by Ordinance No. 1087 to Add Multi-family Housing as a Permitted Use on the 11.28 Acre Site at 1178 El Camino Real, and to Amend the Boundaries of the P-D District Created by Ordinance No. 1087 to Include the 1.40 acre Parcel at 1292 Huntington Avenue with Multi- family Housing as a Permitted Use”
BACKGROUND:

On August 27, 2024, the City Council introduced, read by title only, and waived further reading of an ordinance amending the Planned Development (P-D) District Created by Ordinance No. 1087 to Add Multi-family Housing as a Permitted Use on the 11.28 Acre Site at 1178 El Camino Real, and to Amend the Boundaries of the P-D District Created by Ordinance No. 1087 to Include the 1.40 acre Parcel at 1292 Huntington Avenue with Multi-family Housing as a Permitted Use.

DISCUSSION:

The purpose of this consent calendar item is to consider adoption of the ordinances that allows housing on this site identified in the Sites Inventory of San Bruno’s amended 2023-2031 Housing Element. These rezonings fulfill Program 3.a. of the City’s 2023-2031 Housing Element and would ensure the City’s 2023-2031 Housing Element remains in substantial compliance with state Housing Element law.

FISCAL IMPACT:

There is no immediate fiscal impact of adoption of the ordinance. The proposed rezonings are necessary to maintain substantial compliance with State Housing Element law and have been included and approved as part of the City’s operating budget for FY22-23, FY23-24 and FY24- 25 for preparation of the Housing Element. Maintenance of a certified Housing Element will reduce the likelihood of State fines for housing law violations or lawsuits concerning housing issues.

12.245.010 Purpose

12.245.030 Ministerial Planning Permit Process

12.270.040 Action

12.245.010 Purpose.

The purpose of this chapter is to establish a streamlined review process for qualifying multi-family housing projects to facilitate housing development to meet local and regional housing needs, consistent with Government Code Section 65583.2(h) and (i). This chapter furthers the production of housing in the City by establishing a ministerial planning permit process for qualifying multi-family housing projects. This chapter allows and encourages mixed-use components of multi-family housing projects, by allowing mixed-use to be included in a qualifying multi-family housing project while maintaining the ministerial process. This allowance supports the provision of jobs, activities and services in close proximity to new housing.

12.245.020 Applicability; Mixed-Use Incentive.

A. A multi-family residential development that complies with all of the following criteria shall qualify for a ministerial planning permit process and shall be considered a “qualifying multi- family housing project” for the purpose of this chapter:

1. The project site is located in a zoning district that allows multi-family housing;

2. The project complies with all City objective development regulations, except for any objective development standard that is rendered inapplicable pursuant to State law, including State Density Bonus law; and,

3. The project includes a minimum of twenty percent (20%) of the units in the project as affordable and restricted to occupancy by very low income households, low-income households, or a combination thereof.

B. A mixed-use development that complies with all of the following criteria shall qualify for a ministerial planning permit process and shall be considered a “qualifying multi-family housing project” for the purpose of this chapter:

1. The project site is located in a zoning district that allows mixed-use development;

2. The project complies with all City objective development regulations, except for any objective development standard that is rendered inapplicable pursuant to State law, including State Density Bonus law;

3. The project includes a minimum of twenty percent (20%) of the residential units in the project as affordable and restricted to occupancy by very low income households, low-income households, or a combination thereof; and

37 of 65

3 2
6 4
1 4. A minimum of 50% of the total floor area of the project is used for residential uses. For the 50% total floor area calculation, total residential floor area shall include lobbies, indoor and outdoor common areas, hallways, utility rooms, and other similar above-ground level areas that are used solely to support the residential component of the project, as determined by the community development director. Above-grade parking area within the building shall be counted as non-residential floor area.

C. As an incentive, a mixed-use project that is also a “qualifying multi-family housing project” and is utilizing the ministerial process shall be required to pay the non-residential transportation impact fee only for non-residential floor area over 10,000 square feet. Further, the community development director is authorized to adjust the residential transportation impact fee based on a trip-generation analysis by a licensed transportation planner or traffic engineer demonstrating the proportionate reduction in residential trip generation due to the presence of the non-residential use(s).

12.245.030 Ministerial Planning Permit Process.

A. Submittal Requirements. Qualifying multi-family housing projects under this chapter shall require submittal of the same planning applications as a non-qualifying multi-family housing project based on the zoning district in which the project is located, the applicable regulations of the San Bruno Zoning Ordinance, and published application requirements by the Community Development Department. The City Council will establish a fee for ministerial versions of these applications.

B. Application Processing. The processing of the ministerial applications shall follow the City’s interdepartmental review process that is used for discretionary planning applications, including the application of conditions of approval, except that such conditions shall be based on objective standards only, there shall be no public noticing or public hearing requirements, and the community development director shall have the authority to render decisions on all qualifying multi-family housing project permit applications.

1. The community development director is authorized to render a decision on the following permits and approvals, if part of a qualifying multi-family housing project, as part of the ministerial approval process: architectural review permit, parking compliance permit, density bonus approval, lot line adjustment, temporary use permit, sign program or sign deviation, and other minor planning permits required by Title 12, Article III, that may be required for a qualifying multi-family housing project.

2. The community development director is not authorized to render a ministerial decision on a variance application, and projects that required a variance shall not be considered a “qualifying multi-family housing project” eligible for the ministerial planning permit process.

3. A proposed parcel or tract map associated with a qualifying multi-family housing project shall be processed pursuant to Chapter 12.32 or 12.36, as applicable, under a separate fee. The community development director is authorized to conditionally approve other permits for a qualifying multi-family housing project that includes a subdivision map, which approvals shall only become effective upon approval of the related subdivision map. Alternately, the applicant can elect to defer the director’s action on the related qualifying multi-family housing project permits and approvals until after the tentative subdivision map is approved.

38 of 65

4 2
6 4
1 4. Non-residential use(s) in a mixed-use project that require a conditional use permit shall be subject to the permit processed pursuant to Chapter 12.112 under a separate fee.

The conditional use permit process shall apply only to the proposed conditional use or uses, and not the balance of the qualifying multi-family housing project, however, any such conditional use permit shall not become effective unless and until the qualifying multi-family housing project is approved through the ministerial process.

12.245.040 Action.

The community development director shall approve the application or applications for a qualifying multi-family housing project upon finding that the project complies with this chapter, and the City’s objective development regulations, except where State law may override local regulations rendering an objective standard inapplicable. Conditions of approval may be placed on these applications. Except as otherwise stated in this chapter, all projects shall be subject to all applicable application fees, impact fees, and connection charges.

12.245.050 Appeal.

Decisions of the community development director on any permit or approval for a qualifying multi-family housing project may be appealed to the City Manager within a ten (10) calendar day period following issuance of the approval. Appeals must be in writing and clearly state the facts of the case and the ground for the appeal, which should be focused solely on whether or not the project constitutes a qualifying multi-family housing project, and whether the project complies with the objective standards applicable to the project. If the appeal is filed by any party other than the applicant for the project, the applicant shall be provided notice of the filing of the appeal, and shall be provided a ten (10) calendar day period in which to provide a written response to the appeal for consideration by the City Manager. The City Manager shall issue a written determination on the appeal within forty-five (45) calendar days of the City’s receipt of the appeal, and this written determination shall be final and not subject to any further appeal.

Notice of the City Manager’s decision shall be given to the appellant, and project applicant, if different from the appellant.”
SECTION 3. CEQA. The proposed ordinance has been reviewed according to the standards and requirements of the California Environmental Quality Act (CEQA) and the San Bruno environmental review procedures and is determined to be exempt from the requirements of CEQA pursuant to Title 14 of the California Code of Regulations, Sections 15061(b)(3) and 15378 (b)(5). Further, pursuant to CEQA Guidelines Section 15162, the City prepared an Addendum to the adopted Initial Study/Mitigated Negative Declaration that was prepared for the 2023-2031 Housing Element, which showed that amendments to the adopted Housing Element and the related implementing actions, including the zoning changes considered herein, will not cause any new significant impacts or other triggers that would require additional CEQA review, and that no substantial changes have occurred with respect to the circumstances under which the project is undertaken, and no new information of substantial importance has been submitted.

Further, on August 27, 2024, and prior to the adoption of this Resolution, the City Council adopted Resolution No. 2024-___, adopting the Addendum to the adopted Initial Study/Mitigated Negative Declaration for the Amended Housing Element Project and related implementing actions, including the zoning changes considered herein, and which is hereby incorporated by reference, and serves as the CEQA review for the changes considered herein.

If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, invalid or ineffective by a court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional, invalid or ineffective.

Staff Report

CITY OF SAN BRUNO
DATE: September 10, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Meghan Rosin, Recreation Services Manager
SUBJECT: Consider Adoption of a Resolution Authorizing the City Manager to Execute a Memorandum of Understanding with the Nutrition Site Council to Continue the Partnership in Support of Senior Programs Between the San Bruno Senior Center and Nutrition Site Council and Determining the Project is Exempt Under the California Environmental Quality Act BACKGROUND:

The Nutrition Site Council (NSC) was established in September 1993 to support programs and services for seniors. Since NSC’s inception, the Senior Center has worked collaboratively with the NSC to support programs and opportunities to seniors in the San Bruno community. The purpose for establishing a formal Memorandum of Understanding (“MOU”) is to define the working relationship clearly.

DISCUSSION:

The Community Services Department has oversight of the San Bruno Senior Center and endeavors to work in partnership with organizations such as the NSC. On-going programs are executed in partnership with the NSC such as bingo events, bread and pastry program, lunch entertainment, nutrition program, café operations, and other various fundraising events. In doing so, the NSC is able to help support and help offset funding for Senior Center programming.

Staff have held a series of meetings with the NSC to formalize the partnership. The MOU for FY 2024/25 formalizes the partnership between the City and NSC to work cooperatively to provide the following, as mutually agreed upon by both parties:
· Bingo
· Bread and Pastry Program
· Lunch entertainment
· Senior Nutrition Program
· Various fundraising events
· Café operations
The Senior Advisory Board has reviewed the agreement, and made a recommendation the City Council at their August 2024 meeting to approve the MOU, thereby continuing the partnership with the NSC.

Item 6h.

Honorable Mayor and Members of the City Council
September 10, 2024

Page 2 of 2 ends

FISCAL IMPACT:

The fiscal impact of executing the MOU is a loss of revenue in the amount of approximately $110,000 from rental fees and auxiliary rental charges. This amount does not include office space rental or storage. Approval of the MOU would generate up to $120,000 in earmarked funding supporting lunchtime entertainment, nutrition program, transportation and other senior programming.

ENVIRONMENTAL IMPACT:

There is no environmental impact with this item. The action is not a project subject to CEQA.

City Council’s action is not considered a “Project” per CEQA Guidelines and therefore no further environmental analysis is required.

RECOMMENDATION:

Adopt a resolution authorizing the City Manager to execute a Memorandum of Understanding with the Nutrition Site Council to continue the partnership in support of Senior Programs between the San Bruno Senior Center and Nutrition Site Council; and determining the project is exempt under the California Environmental Quality Act.

ALTERNATIVES:

1. Do not authorize the MOU with NSC and request NSC to pay full rental cost for space being used at the expense of the current working relationship.

CITY OF SAN BRUNO
DATE: September 10, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Travis M. Karlen, Community Services Director SUBJECT: Consider Adoption of a Resolution Authorizing an Expenditure Not to Exceed $8,546 to Design, Manufacture, and Install Three Historical Interpretative Panels at Recreation and Aquatic Center
BACKGROUND:

The City’s new Recreation and Aquatic Center (RAC) opened to the public on July 24, 2024.

As part of the Environmental Impact Report (EIR) prepared for the project, it was determined that the San Bruno Veterans Memorial Recreation Center (”Center”), built in two stages between 1946 and 1958, was eligible for inclusion in the California Register of Historical Resources at the local level of significance under Criteria 1 (events) and 3 (architecture). Thus, the EIR required certain mitigation measures, including photo-documentation of the building to be completed prior to demolition, according to the National Park Service’s Historic American Building Survey/Historic American Engineering Record/Historic American Landscapes Survey (HABS/HAER/HALS) Photography Guidelines.

The Center was associated with the Living Memorial Movement, a nationwide campaign that began after World War I and changed how Americans memorialized military sacrifice in light of the industrial scale of war. The Center was also associated with the development of institutional facilities in post-war San Bruno, and it represents the culmination of a decade-long to raise funds for its construction without relying on conventional methods, such as tax financing.

The Center was a representative example of International/Modern architecture, featuring an imposing barrel groin vaulted roof. A review of other community centers in the Bay Area and California found that the Center‘s roof design is a notable example of an uncommon roof design for this facility type. The person responsible for designing the Center was William Henry Rowe, an accomplished local architect who designed the San Bruno City Hall, Main Library, and Central Fire Station, and is regarded as important in the architectural profession.

Although there were no specific plans for art installations within the RAC at the time of project approval, the completion of construction has revealed areas that are well-suited for artistic displays. One such area is the north wall of the lobby near the reception desk, which presents an opportunity to honor the history of the Center through art. 50 of 65

DISCUSSION:

The Center served the community for over six decades before it was demolished in 2021 to make way for the new RAC. The City has a collection of photographs from the Veterans Memorial Recreation Center. To preserve and celebrate the legacy of the Center, staff proposes installing historical interpretive panels on the north lobby wall of the RAC. These panels would feature historical photos of the Center, creating a visual tribute to the past while enhancing the aesthetic of the new RAC.

The proposal includes installing three interpretive panels in the new RAC. An initial design of the panels is provided in Attachment 2.

After evaluating companies specializing in artistic interpretive panels, staff selected Takeform Signage + Experiential Graphics to design, fabricate, and install the panels. With over 20 years of experience, Takeform is known for creating and installing innovative signage of various scales.

Attachment 3 contains the quote from Takeform, totaling $7,768.32, which includes design, production, installation, shipping, and taxes. To account for any unforeseen circumstances, staff recommends a 10% contingency, bringing the total to $8,546. Funding for this project would be allocated from the City Art Fund.

FISCAL IMPACT:

Expenditure not to exceed $8,546 from the City Art Fund. As of June 30, 2024, the City Art Fund balance was $638,496.

ENVIRONMENTAL IMPACT:

The action is not a project subject to CEQA. City Council’s action is not considered a “Project” per CEQA Guidelines and therefore no further environmental analysis is required.

RECOMMENDATION:

Adopt a Resolution Authorizing an Expenditure Not to Exceed $8,546 to Design, Manufacture, and Install Three Historical Interpretive Panels at the Recreation and Aquatic Center.

ALTERNATIVES:

1. Do not adopt the Resolution and do not install interpretive panels at the Recreation and Aquatic Center.

City Council Agenda Item
Staff Report

CITY OF SAN BRUNO
DATE: September 10, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Peter Gilli, Community Development Director SUBJECT: Consider Adoption of a Resolution Amending the User Fee Schedule Related to Housing Element Implementation, and Additional Categories of Minor Planning Application Fees
BACKGROUND:

This agenda item introduces two categories of recommended adjustments to the user fee schedule:
 Housing Element Implementation. On August 27, 2024, the City Council adopted the amended Housing Element, which included programs and actions for reducing or waiving certain fees related to housing projects.
 Minor Planning Applications. Numerous planning application fees are based on a projected number of staff hours for a typical application. Additional categories are recommended for certain Temporary Use Permits and Architectural Review Permits.

DISCUSSION:

The following user fee schedule amendments are recommended and are highlighted in Exhibit A to the attached resolution.

Housing Element Implementation
 Revise the descriptive text associated with Ministerial Multi-Family Review Fee. There is no change to the actual fee.
 Add a note authorizing the Director to waive certain fees as required by Program 7a and 9b of the Housing Element.
 Add a note that the Affordable Housing Fee for residential is an “in-lieu fee” thus only applicable if the project does not fully provide the inclusionary units required by the Municipal Code within the project. This note avoids the potential for misinterpretation of this fee.
 Add note that Transportation Impact Fees may be adjusted pursuant to the Multi-family Ministerial Review Process (Chapter 12.245).

Minor Planning Applications
 Architectural Review Permits (ARP): The Municipal Code requires any exterior modification to a multi-family or non-residential site, building or landscaping requires an 59 of 65
Item 7a.

Honorable Mayor and Members of the City Council
September 10, 2024

Page 2 of 2 ends

architectural review permit. Currently, the fees for administrative ARPs range from $1,182 to $5,868 depending on the type of project and acreage of the site. Upon examining these ranges, staff concluded another category was needed for the smallest of architectural review applications. The recommended fee for an ARP for minimal changes is $410. This fee reflects 50% cost recovery, partially to avoid the fee being a constraint to owners and tenants of multi-family or non-residential properties from considering small improvements.
 Administrative Temporary Use Permits: Two changes are proposed for administrative Temporary Use Permits (TUP), which generally cover temporary uses that go up to 30 days:
o The regular Administrative TUP is recommended to be reduced from $2,004 to $787. The adopted $2,004 fee includes inspection hours by the Fire Department. But not all administrative TUPs will require the same amount of Fire Department review. The recommendation is to set the administrative TUP fee at $787, which covers the cost of City staff reviewing the TUP. Proposals that require additional Fire Department time would pay for the additional Fire Department review separately (the separate fee exists in the Fire Department’s portion of the fee schedule). This change makes the fees more equitable, while still covering the costs of services provided.
o Similar to the Architectural Review Permit fee recommendation above, staff recommends a lower category of TUP fees. An administrative TUP generally can be up to 30 days. Many events are for shorter periods, like an extended weekend. Those shorter events do not require the same level of analysis. New proposals for TUPs for up to 5 days are recommended to have a base fee of $359. A recurring proposal, one that the applicant has held with permits in the past, would have a base fee of $241. Any additional inspections would be handled through separate, existing fees.

FISCAL IMPACT:

There is a minor fiscal impact of reducing or waiving certain fees for certain housing projects. However, the proposed fee adjustment was necessary to sufficiently reduce governmental constraints to the development of housing in order to achieve the City’s regional housing needs allocation (RHNA) to satisfy the State. Staff projects the actual fiscal impact of implementing this Housing Element program will be no more than $15,000 (2024 dollars) per year through 2031.

Fee adjustments for minor applications reflect actual costs, therefore there is no fiscal impact.

ENVIRONMENTAL IMPACT:

The action is not a project subject to CEQA. City Council’s action is not considered a “Project” per CEQA Guidelines and therefore no further environmental analysis is required.
