Subject: Staff recommendation for Agenda Item 7a
Dear Mayor Medina and members of the City Council,
Agenda item 7a is package of City-initiated amendments to the Transit Corridor Plan, zoning map and zoning ordinances, as well as the cancellation of the Mills Park development agreement.
Three of the zoning ordinance amendments are proposed for the City’s commercial cannabis regulations. These were introduced to staƯ by Embarc, but most of the language proposed was rewritten by staƯ to be as minor of a change as possible, in order to justify bundling the amendments with the City- initiated minor amendment package.
The Planning Commission did not recommend one of the amendments related to additional signage, for reasons described in the report. StaƯ supports the Planning Commission’s rationale for not supporting the change. But staƯ purposely wrote the proposed signage language to be a very minor allowance, therefore staƯ does not believe there will be an issue if the signage change is adopted. StaƯ also does not believe there will be a major issue if the signage change is not adopted.
The report provides one ordinance that does not include the signage change (attachment 3) and one ordinance that does include the signage change (attachment 4) to allow City Council to select the approach they wish to take.
But, the staƯ report ends with a recommendation to:
Hold public hearing and adopt the resolution and ordinances as recommended by the Planning Commission.
As written, that language means staƯ recommends against adopting the commercial cannabis signage change. As staƯ is neutral on this signage change, this e-mail is being provided to clarify to City Council that staƯ’s intent was for the recommendation to read:
Hold public hearing and adopt the resolution and ordinances as recommended by the Planning Commission, except that the City Council decide on whether to allow the amendment to the commercial cannabis signage regulation.
The staƯ presentation for this agenda item will emphasize this point.
Please let us know if you have any questions about this.
Peter
