UBJECT: Consider Adoption of a Resolution Authorizing the City Manager to Execute a Construction Contract with Silver Fox Electric Inc. for the City Park Field Light Upgrade Project #51025 in an Amount Not to Exceed $213,582; Approving a Project Contingency of $40,000; and Determining the Project is Exempt Under the California Environmental Quality Act BA
CKGROUND:

A
s part of the approved FY 2024–25 Capital Improvement Program (CIP) budget, the Citywide Baseball Field Upgrades Phase 1 project was initiated. This phase focused on Diamond 3, where the scope included replacing the existing metal halide field lights with modern LED fixtures and installing a new pole to replace one that had failed during a 2023 storm. A mandatory pre-bid meeting was held on March 11, 2025, and was well attended, showing significant interest from potential contractors. However, when bidding closed on March 27, 2025, no bids were received.

To move this important initiative forward, the FY 2025–26 CIP budget consolidated the prior year’s Phase 1 work with a new Phase 2 effort. This expanded project now includes upgrades at Diamond 3, Diamond 2, and Tom Lara Field. The planned improvements will replace outdated metal halide lights with energy-efficient LED systems across the facilities, providing enhanced visibility, reduced maintenance needs, and improved safety for evening practices and games.

These upgrades are essential to maximizing field utilization, supporting organized sports, and providing opportunities for youth in the community. By transitioning to LED lighting and improving field infrastructure, the City ensures alignment with best practices in modern sports facility design while enhancing the safety and overall experience for players, coaches, and the community.

DISCUSSION:

O
n August 20, 2025, staff conducted the bid opening for the City Park Field Light Upgrade project and received one bid.

The bi
d received was from Silver Fox Electric, Inc. in the amount of $213,582. Silver Fox Electric, Inc. has completed similar projects for public agencies. Based on their experience and performance with public agencies, staff determined that Silver Fox Electric, Inc. meets the qualifications to perform the work for the Field Lighting Upgrades as specified in the contract documents.

Should the project be awarded, Staff anticipates that work will commence in mid-fall 2025 and will be completed by the start of the 2026 season.
.

FISCAL IMPACT:

The adopted CIP budget balance is $448,658 for the Citywide Baseball Field Lighting and Fencing Project. The total estimated cost to complete the project is $213,582. In addition, staff recommend including a $40,000 contingency to cover unforeseen expenses.

ENVIRONMENTAL IMPACT:

The Project is exempt from the California Environmental Quality Act (CEQA).

RECOMMENDATION:

Adopt a Resolution:
• Authorizing the City Manager to Execute a Construction Contract with Silver Fox Electric Inc. for the City Park Field Light Upgrade Project #51025 in an amount not to exceed $213,582;
• Approving a project contingency of $40,000; and
• Determining the project is exempt under the California Environmental Quality Act.

ALTERNATIVES:

Reject the bid and halt the project.

CONTRACT AGREEMENT
THIS AGREEMENT was executed this day of , 20
by and between Silverfox Electric Inc., whose place of business is located at Kingsburg, California (“Contractor”), and the CITY OF SAN BRUNO (“City”), acting under and by virtue of the authority vested in the City by the laws of the State of California.

NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, Contractor and City agree as follows:

Article 1. Work

1.1 Contractor shall complete all Work specified in the Contract Documents, in accordance with the Plans, Specifications, and all other terms and conditions of the Contract Documents.

Article 2. Architect/Engineer and Project Manager

2.1 The City Engineer and its authorized vendor designed the Project and furnished the Plans and Specifications. The City Engineer shall have the rights assigned to Architect/Engineer in the Contract Documents.

2.2 City has designated the Director of Community Services as its Project Manager to act as City’s point of contact relating to the Contract Documents and to determine whether the work performed is in conformance with the Contract Documents.

2.3 The City may assign all or part of the Project Manager’s rights, responsibilities and duties to a Construction Manager.

Article 3. Contract Time and Liquidated Damages

3.1 Contract Time
Contractor shall commence work on the date established in the Notice to Proceed. City reserves the right to modify or alter the commencement date of the Work.

Contractor shall achieve Substantial Completion of the entire Work within One Hundred Fifty (100) Working Days from the date when the contract time 22 of 62

commences to run as provided in Document 00 72 00 (General Conditions).

Contractor shall achieve Final Completion of the entire Work and be ready for Final Payment in accordance with Section 01 77 00 (Closeout Procedures) 20 Working Days from the date when Substantial Completion was established.

3.2 Liquidated Damages
City and Contractor recognize that time is of the essence of this Agreement and that City will suffer financial loss in the form of Contract administration expenses (such as project management and consultant expenses), if all or any part of the Work is not completed within the times specified above, plus any extensions thereof allowed in accordance with the Contract Documents. Contractor and City agree that because of the nature of the Project, it would be impractical or extremely difficult to fix the amount of actual damages incurred by City because of a delay in completion of all or any part of the Work. Accordingly, City and Contractor agree that as liquidated damages for delay Contractor shall pay City:

3.2.1Five Hundred dollars ($500.00) for each Day that expires after the time specified herein for Contractor to achieve Substantial Completion of the entire Work, until achieved.

3.2.2Five Hundred dollars ($500.00) for each Day that expires after the time specified herein for Contractor to achieve Final Completion of the entire Work, until achieved.

These measures of liquidated damages shall apply cumulatively and except as provided below, shall be presumed to be the damages suffered by City resulting from delay in completion of the Work.

3.3 Liquidated damages for delay shall only cover administrative, overhead, interest on bonds, and general loss of public use damages suffered by City as a result of delay. Liquidated damages shall not cover the cost of completion of the Work, damages resulting from defective work, lost revenues or costs of substitute facilities, or damages suffered by others who then seek to recover their damages from City (for example, delay claims of other contractors, subcontractors, tenants, or other third-parties), and defense costs thereof.

3.4 It is further agreed that prior to issuance of a Notice of Completion under the terms of this Contract, and as a condition precedent to the City’s obligation for the issuance of the Notice of Completion and Final Payment, the Contractor shall submit to the City a “Maintenance and Warranty Bond” to be valued at ten percent (10%) of the final contract amount. Such Bond

City Council Agenda Item
Staff Report

CITY OF SAN BRUNO
DATE: September 9, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Travis M. Karlen, Community Services Director SUBJECT: Consider Adoption of a Resolution Authorizing the City Manager to Execute a Partner Location Agreement with Tivity Health Services, LLC to Offer the Silver Sneakers and Prime Wellness Programs, and Determining the Contract is Exempt under the California Environmental Quality Act
BACKGROUND:

The City of San Bruno is committed to providing comprehensive wellness services for its senior residents and is dedicated to fostering active aging within our community. Building upon existing successful senior programs, the City is proposing a Partner Location Agreement with Tivity Health Services, LLC, a recognized leading provider of senior wellness programs, including the nationally recognized SilverSneakers and Prime program. Tivity Health offers members access to an extensive network of gyms and fitness facilities.

Tivity Health has a proven track record of partnering with municipalities and community organizations to improve the health and well-being of seniors and adults. Their programs are designed to be accessible, engaging, and evidence-based, with a focus on promoting both physical and social well-being. Participation in these programs will be available to eligible participants for no cost, as participation is covered through their existing health plan benefits.

Compensation for the member visits are directly reimbursed to the City.

DISCUSSION
:

SilverSneakers is included at no additional cost for eligible individuals enrolled in participating Medicare Advantage or Medicare Supplement plans. Members receive a SilverSneakers ID granting unlimited access to participating facilities, group fitness classes tailored for older adults, and online wellness resources. Payments to the RAC are made directly by Tivity Health, which reimburses the facility on a per-visit basis. Members will incur no out-of-pocket expense for the benefit of a base membership with amenities that are equivalent to our established Senior Membership option.

Prime Fitness operates similarly but is offered as an employer-sponsored or health plan– sponsored benefit for adults of all ages. The sponsoring employer or health plan pays Tivity Health, which in turn reimburses the facility based on member usage. As with SilverSneakers, base membership is provided at no cost to participants, with the ability to charge for additional optional paid upgrades such as specialty classes.

Both programs promote an active lifestyle without the burden of traditional membership fees, while participating facilities receive predictable reimbursement for their services.

Authorizing the City Manager to execute the agreement will allow the City to leverage Tivity Health’s established expertise and infrastructure, maximizing the reach and impact of local senior wellness initiatives while fostering a healthier, more engaged community. This program also aligns with the goals of the Age Friendly City Initiative of improving access to the facility for senior residents.

The City can expand its offerings by introducing SilverSneakers classes. Certified SilverSneakers instructors, trained to work with older adults and provide appropriate modifications, would be onboarded through the City’s contract instructor process or as a part- time employee.

Operationally, front-desk staff will be trained to:
Verify membership and process check-ins.
Track attendance for accurate Tivity Health reimbursement. Promote available classes and wellness opportunities.

Consistent marketing, proactive communication with Tivity Health, and a welcoming, socially supportive environment will drive participation, maintain program compliance, and strengthen the City’s commitment to healthy aging. The City’s recreation facility will be added to their directory of eligible facilities. In addition, individuals who do not qualify for the program may access SilverSneakers fitness classes by paying the applicable daily rate, secure a punchcard, or sign up for a traditional membership.

The initial term of this Agreement shall continue until December 31, 2028, and shall automatically renew for successive one-year periods thereafter, unless either party provides notice of non-renewal.

FISCAL IMPACT:

Approval of the proposed Partner Location Agreement with Tivity Health is anticipated to result in revenue generation for the City through per-participant reimbursements in the amount of $3.50 per visit for the SilverSneakers® Program and $4.00 per visit for the Prime® Program.

Based on conservative participation estimates, staff projects first-year revenue of approximately $45,600. Revenue estimates for subsequent years will be developed and presented as part of future budget forecast processes.

ENVIRONMENTAL IMPACT:

The action is not a project subject to CEQA. City Council’s action is not considered a “Project” per CEQA Guidelines and therefore no further environmental analysis is required.

Staff Report

CITY OF SAN BRUNO
DATE: September 9, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Scott Truong, Human Resources Manager
SUBJECT: Consider Adoption of a Resolution Approving an Updated Publicly Available Pay Schedule Effective September 9, 2025 Pursuant to the Public Employees’ Retirement Law (PERL), Public Employees’ Pension Reform Act of 2013 (PEPRA), and Title 2 of the California Code of Regulations (CCR)
BACKGROUND:

The most recent City Council approved Pay Schedule was adopted on August 26, 2025. The schedule incorporated compensation adjustments for a few classifications.

The City Manager has authority to establish the position classifications as the Personnel Officer, in accordance with the San Bruno Municipal Code section titled 2.36 Personnel System. The City Council retains authority to approve the budget staffing plan and pay plan, including the City’s salary schedule.

DISCUSSION
:

The City of San Bruno is a California Public Employees’ Retirement System (CalPERS) contracted agency. The recommended action updates the salary schedule to ensure that the City’s pay schedule complies with PERL and meets the eight (8) requirements for a publicly available Pay Schedule for it to be used to determine pay rates by CalPERS.

The recommended pay schedule adjusts the Assistant City Manager’s (ACM) salary range to establish internal equity among the City's executive leadership. This recommendation aligns with the City’s compensation guidelines, which call for decisions that balance internal alignment of duties and responsibilities, external market data, and job-related competencies.

The proposed new range for the Assistant City Manager is $253,046 to $305,000. The current salary schedule has the ACM’s range maximum, $269,911, which is 11.25% below the highest department head range. Given the ACM’s organizational role, the recommended increase to $305,000, places the classification at 1.7% higher than the highest department head range and approximately 12% below the City Manager.

The ACM position is currently vacant and in the recruitment process, and the salary offered to the selected candidate will be based on their qualifications. The pay schedule is attached to the resolution as Exhibit A, and the changes are highlighted for reference. 41 of 62
Item 6f.

FISCAL IMPACT:

The fiscal impact from the change to the salary schedule is expected to be offset by higher than budgeted salary savings in fiscal year 2025-26. Future years will be budgeted accordingly.

ENVIRONMENTAL IMPACT:

The action is not a project subject to CEQA.  City Council’s action is not considered a “Project” per CEQA Guidelines and therefore no further environmental analysis is required.

RECOMMENDATION:

Consider Adoption of a Resolution Approving an Updated Publicly Available Pay Schedule Effective September 9, 2025 Pursuant to the Public Employees’ Retirement Law (PERL), Public Employees’ Pension Reform Act of 2013 (PEPRA), and Title 2 of the California Code of Regulations (CCR).

ALTERNATIVES:

1. Do not amend the salary schedule.

2. Amend the Pay Schedule different from staff recommendations.

CITY OF SAN BRUNO
DATE: September 9, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Pamela Antil, Interim Senior Special Projects Manager SUBJECT: Consider Introducing, Reading by Title Only and Waiving Further Reading of an Ordinance Entitled “An Ordinance of the City Council of the City of San Bruno Amending Section 2.04.140 of the San Bruno Municipal Code to Increase City Council Member Salaries”
BACKGROUND:

At its August 26, 2025 meeting, the City Council directed staff to bring back an ordinance to raise the City Council salary from $486 to $890 per month, effective at the beginning of the City Council members’ terms following the November 2026 general election.

DISCUSSION
:

The San Bruno City Council is provided a $486 per month salary for serving on the City Council.

The City Council last updated the monthly salary in 2001 with the adoption of Ordinance No. 1649 (attached). This amount has been unchanged for 24 years.

Cities are able to raise City Council salaries under the provisions of SB 329, Government Code 36516.(a), which became effective on January 1, 2024. This legislation increased the maximum salary amounts for city council members as follows:
(1) A city council may enact an ordinance providing that each member of the city council shall receive a salary based on the population of the city as set forth in paragraph (2). (2) The salaries approved by ordinance under paragraph (1) shall be as follows:
(A) In cities up to and including 35,000 in population, up to and including nine hundred fifty dollars ($950) per month.
(B) In cities over 35,000 up to and including 50,000 in population, up to and including one thousand two hundred seventy-five dollars ($1,275) per month. (C) In cities over 50,000 up to and including 75,000 in population, up to and including one thousand six hundred dollars ($1,600) per month.

Since the effective date of SB 329, several cities have increased their city council salaries.

Staff surveyed the San Mateo County cities regarding their current salaries, and the findings are as follows:
