Staff Report
CITY OF SAN BRUNO
DATE: September 8, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Matthew Lee, P.E., Public Works Director
Ana Morales, Management Analyst
SUBJECT: Consider Adoption of a Resolution Authorizing the City Manager to Execute a Services Agreement with Recology San Bruno for Illegal Dumping Collection Services on Caltrans-Owned Property in an Amount Not to Exceed $200,000 for a One-Year Term and Determining the Project is Exempt Under the California Environmental Quality Act
BACKGROUND:
At the August 25, 2026, Regular Meeting, City Council pulled Consent Item 5.j. for questions and discussion. The staff report with attachments is provided as Attachment 2. The item was continued by City Council to the September 8, 2026, Regular Meeting, in order for staff to respond to the questions posed.
DISCUSSION:
On August 25, 2026, staff presented to City Council a resolution authorizing the City Manager to execute a services agreement with Recology San Bruno for illegal dumping collection services on Caltrans-owned property in an amount not to exceed $200,000. Questions were presented by City Council. Below are the questions posed, followed by staff’s responses.
1. Can the service levels and cost be adjusted? Can Recology provide service on an as-needed basis rather than a set weekly schedule?
The service level can be adjusted; however, any reduction in cost would correspond with a reduction in the time available for Recology to monitor and remove abandoned waste from the 13 identified Caltrans hotspots.
The proposed $200,000 amount is a not-to-exceed contract authority and is higher than the anticipated annual cost of the regularly scheduled service. The current service level and approximately $162,000 annual cost were negotiated between the City and Recology in Fiscal Year 2025-26 when the Clean-Up San Bruno City Council Initiative (Initiative) was implemented.
The remaining contract authority provides capacity for additional crew time or disposal costs if site conditions require service beyond the standard daily allocation. As of August 2026, the City has incurred no overage charges and has paid only the regularly scheduled service cost. 17 of 52 Item 6e.

The current two-person crew reflects the most cost-effective operational approach identified by Recology. Rather than establish a separate route dedicated solely to the Caltrans locations, Recology incorporated the work into its existing Bulky Pickup/Abandoned Waste route. That route is staffed by two employees because of the size and weight of the materials routinely collected.
Recology has advised that creating a separate one-person route specifically for the Caltrans work would require additional dedicated routing and equipment and would be substantially more costly than utilizing the existing two-person operation.
Recology has been providing the current level of service since September 2025 as part of the Initiative. Based on discussions with Recology, the City could consider the following service options:
Option 1:
Maintain Current Service Level
Option 2:
Reduce Service Level
Daily Service Two-person crew and two vehicles
for up to 2.0 hours
Two-person crew and two vehicles
for up to 1.5 hours
Included Cost Labor, vehicles/trucks, and disposal Labor, vehicles/trucks, and disposal Daily Cost $675 $550
Estimated Annual Cost Approximately $162,000 Approximately $143,000 Not-to-Exceed Amount $200,000 $200,000
Service Impact
Continues substantially the same
level of service provided since
September 2025 and maintains the
level of monitoring and cleanup
observed over the past year.
Reduces the amount of daily service
time available to monitor and clean
the 13 hotspots, resulting in reduced
cleanliness on Caltrans right-of-way
and potentially longer pickup
response times and increased
accumulation of abandoned waste.
On days with higher volumes of
debris, the reduced 1.5-hour service
allocation may also require
additional crew time to complete
collection, which would be charged
against the unanticipated overage
capacity within the $200,000 not-to-
exceed amount.
Under either option, staff recommends retaining the $200,000 not-to-exceed amount to provide sufficient authority for unanticipated overages associated with additional crew time or disposal needs. Under Option 2, use of this overage capacity may be more likely because the reduced 1.5- hour daily allocation provides less flexibility to accommodate days with higher volumes of abandoned waste. Under the current two-hour service model, the City has not incurred any overage charges since services began in September 2025. The distinction between the options is therefore the anticipated annual operating cost and corresponding level of service, rather than the maximum contract authority.
Option 1 would continue the existing service level that has been in place since September 2025 and maintain the conditions observed along the Caltrans right-of-way over the past year. Option 2 would reduce the anticipated annual cost by approximately $19,000, but would also reduce the amount of time available each day for monitoring and cleanup, with a corresponding potential increase in accumulated abandoned waste and response times. Any additional crew time required

on higher-volume days under Option 2 would be charged as an overage and could reduce the anticipated annual savings.
Staff does not recommend pursuing a service level below Option 2, as further reductions would materially limit Recology’s ability to proactively monitor and remove abandoned waste from the 13 hotspots and would likely result in a visible decline in conditions along Caltrans right-of-way.
2. How was the initial Recology staffing level and monitoring frequency for the Caltrans hotspots determined?
The current service model was negotiated as part of the Initiative to address recurring illegal dumping on Caltrans-owned property. When the Initiative was formalized in Fiscal Year 2025-26, the City and Recology established a proactive and dedicated service model consisting of two staff, two vehicles, and weekday coverage of the 13 identified hotspots based on the level of service needed at these locations.
Concurrently with these efforts, the City worked with Caltrans to establish an appropriate mechanism for Recology to access and perform cleanup on Caltrans property. Recology initially operated under an interim process established by Caltrans and, following issuance of the City’s encroachment permit in Fall 2025, continued the work as an authorized contractor under that permit. The permit also allowed the City to continue cleanup activities within Caltrans’ right-of-way while the City and Caltrans continued negotiations regarding an update to the 1998 Highway Maintenance Agreement; after multiple meetings and discussions, the parties ultimately reached an impasse, and no amended agreement was executed.
The City’s existing maintenance agreements with Caltrans allocate certain maintenance responsibilities between the City and the State but do not establish a specific Caltrans service frequency for litter or abandoned-waste removal. The agreements do not require Caltrans to inspect or clean these locations on a daily, weekly, or other defined schedule.
Therefore, the proposed Agreement does not establish a new service level. Rather, it formalizes the operational arrangement that has been in place since September 2025 and provides a separate contractual framework for services that are outside the scope of Recology’s existing Franchise Agreement.
FISCAL IMPACT:
The proposed Agreement has a one-year term and a total not-to-exceed amount of $200,000.
Funding is available within the City Council-approved Clean-Up San Bruno Initiative budget for abatement services. Expenditures will be based on actual services performed.
ENVIRONMENTAL IMPACT:
The action is not a project subject to CEQA. City Council’s action is not considered a “project” per CEQA Guidelines and therefore no further environmental analysis is required.
RECOMMENDATION:
Adopt a Resolution Authorizing the City Manager to Execute a Services Agreement with Recology San Bruno for Illegal Dumping Collection Services on Caltrans-Owned Property in an Amount Not

to Exceed $200,000 for a One-Year Term and Determine the Project is Exempt Under the California Environmental Quality Act

1. Negotiate the reduced service level described as Option 2.
2. Discontinue or further reduce Recology’s service level on Caltrans property.

Staff Report
CITY OF SAN BRUNO
DATE: August 25, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Matthew Lee, P.E., Public Works Director
Ana Morales, Management Analyst
SUBJECT: Consider Adoption of a Resolution Authorizing the City Manager to Execute a Services Agreement with Recology San Bruno for Illegal Dumping Collection Services on Caltrans-Owned Property in an Amount Not to Exceed $200,000 for a One-Year Term and Determining the Project is Exempt Under the California Environmental Quality Act BACKGROUND:
In Fiscal Year 2025-26, the City Council identified litter and illegal dumping as a priority and initiated the Clean-Up San Bruno Initiative (Initiative) as a coordinated, multi-departmental effort focused on abatement, prevention, enforcement, public education, and interagency coordination. The Initiative was created in response to recurring illegal dumping at City of San Bruno (City) and non-City-owned locations, including the California Department of Transportation (Caltrans)-owned property, where jurisdictional boundaries and access requirements oftentimes delay removal and create visible impacts to surrounding neighborhoods and commercial corridors.
The Initiative budget included dedicated funding for abatement services. As part of the Initiative, the City has worked with Caltrans and Recology San Bruno (Recology) to improve response at recurring locations on Caltrans-owned property.
The City and Recology are parties to an Amended and Restated Solid Waste Collection Services Agreement, effective January 1, 2023, as subsequently amended (Franchise Agreement). The Franchise Agreement requires Recology to provide an abandoned waste and illegal dumping program on City property and within City rights-of-way. It does not require Recology to provide those services on Caltrans-owned property. A separate agreement is therefore needed for the City to procure these additional services.
In November 2025, Caltrans issued the City an encroachment permit authorizing the removal and collection of garbage and debris from designated Caltrans-owned properties within San Bruno. Recology is identified as an authorized contractor under the permit. As the Initiative continues, the City will continue to comply with all applicable permit requirements and obtain any necessary extensions, renewals, or successor authorizations to ensure uninterrupted lawful access throughout the term of the proposed agreement.

ATTACHMENT 2
Honorable Mayor and Members of the City Council
August 25, 2026
DISCUSSION:
The proposed services agreement (Agreement) is a separate Initiative-funded agreement and does not amend the Franchise Agreement or expand the services funded through solid waste customer rates.
Proposed Services
The agreement establishes a dedicated and predictable service level for 13 designated Caltrans hotspots located along and near I-380, El Camino Real, Skyline Boulevard, the I-280 access roads, and the Crestmoor Drive overpass. Key service requirements include:
A single crew consisting of two workers and two vehicles, including one flatbed truck and one rear-loader.
Inspection of each designated hotspot once each workday, Monday through Friday, with reasonable good-faith efforts to remove observed abandoned waste by the end of the same day.
Response to complaints and reasonable good-faith efforts to remove qualifying abandoned waste by the end of the next workday.
Daily monitoring and documentation through the San Bruno Responds platform, including logging completed collections.
Transportation of collected material to the transfer station and lawful disposal.
The proposed services are intended to address readily accessible abandoned waste and bulky items commonly found at the designated locations, including mattresses, furniture, appliances, electronics, bagged trash, wood, and tires without rims. For operational and safety reasons, the Agreement excludes loose or windblown litter, shopping carts, encampment-related property, sharps, biohazardous waste, non-containerized liquids, and materials that cannot be safely handled by a two-person crew. Public Works and Caltrans will continue to coordinate the removal of excluded materials and address conditions outside Recology’s scope through the appropriate agency personnel or specialized contractors.
Compensation and Program Administration
The proposed pricing structure is designed to provide the City with a predictable base cost while allowing service levels to increase when site conditions require additional time or disposal capacity. The $675 minimum daily charge covers the standard deployment of a two-person crew and two vehicles for up to two hours, including disposal of the first ton of material. Additional crew time would be billed at $286 per hour, and disposal quantities exceeding one ton would be billed at $103 per ton. Recology would invoice the City monthly based on actual services provided, subject to a total agreement limit of $200,000 unless additional authorization is obtained.
Agreement Form and City Council Authorization
The proposed Agreement was negotiated specifically for this service arrangement and therefore does not use the City’s standard General Services Agreement form. It coordinates the new services with Recology’s existing Franchise Agreement by relying on the insurance coverage maintained under that agreement, while separately addressing authorization to perform work at the designated Caltrans-owned locations and allocating the associated responsibilities and risks. The Agreement also establishes the applicable compensation terms, termination rights, and indemnification obligations. The City Attorney’s Office has reviewed and approved the final Agreement as to form.

Honorable Mayor and Members of the City Council
August 25, 2026
The City's current Award of Contract Policy requires advance City Council approval for agreements that do not conform to the City's standard form. The policy also establishes City Manager signing authority of $99,000, effective July 1, 2026. Because the Agreement uses a non-standard form and has a not-to-exceed amount of $200,000, City Council authorization is required.
Future Amendments and Other Non-City-Owned Properties
The Agreement allows Recology to provide the services at additional sites within the City upon the mutual written agreement of the parties. Before adding a site, the City will confirm lawful access and compliance with any applicable permitting and operational requirements. Any expansion of services will remain subject to available appropriations, the agreement’s authorized not-to-exceed amount, and the City’s financial policies. Any amendment that increases total compensation or otherwise exceeds delegated authority will be presented to the City Council for consideration.
The Agreement is limited to the authorized collection services and does not alter ownership of the covered properties or transfer Caltrans’ broader property maintenance responsibilities to the City. It provides a practical mechanism for the City to address visible and recurring illegal dumping where Caltrans has authorized access and where conditions directly affect the San Bruno community.
CONCLUSION:
The Agreement closes a service gap between the City's existing illegal dumping program and recurring conditions on Caltrans-owned property. It establishes defined routes, response expectations, documentation, and compensation while preserving the City's permit and legal access requirements. Authorizing the Agreement will support the Clean-Up San Bruno Initiative by improving the consistency and timeliness of illegal dumping removal at State-owned locations without shifting the cost to Recology ratepayers.
Adopt a Resolution Authorizing the City Manager to Execute a Services Agreement with Recology San Bruno for Illegal Dumping Collection Services on Caltrans-Owned Property in an Amount Not to Exceed $200,000 for a One-Year Term and Determine the Project is Exempt Under the California Environmental Quality Act

4. Force Majeure
4.1 A party shall be excused from its obligations under this Agreement (other than payment obligations) in the event, and for so long as, it is impossible or extremely impracticable for such party to perform such obligations due to Force Majeure or the effect thereof. “Force Majeure” means (i) an act of God, flood, fire, earthquake, landslide, epidemic, storm or similar occurrence, (ii) an act of war, insurrection, terrorism, riot, civil disobedience, sabotage or similar occurrence, (iii) a strike or other labor action, or (iv) any other event or occurrence not the fault of, and beyond the reasonable control of, the party claiming excuse. 7. Indemnification
7.1 Recology shall defend (with counsel reasonably acceptable to City), indemnify and hold harmless City and its officers, officials, agents, employees, agents and volunteers (collectively, “Indemnitees”), from and against any and all liabilities, costs, damages, penalties, fines, forfeitures, liens, demands, claims, causes of action, suits, and judgments, and costs and expenses incidental thereto, including court costs and reasonable attorneys’ fees (collectively, “Claims”), which any or all of the Indemnitees may hereafter suffer, incur, be responsible for or pay out, to the extent caused by (i) any breach of this Agreement by Recology, including any representations and warranties herein, (ii) any willful misconduct, negligent action or omission, or violation of Applicable Law by Recology in connection with this Agreement, (iii) the acts of Recology, its agents, employees, and/or subcontractors in performing services under this Agreement for which strict liability is imposed by law, or (iv) any Hazardous Waste released, threatened to be released, or spilled by Recology under this Agreement, or disposed of by Recology under this Agreement at any facility owned by Recology or any of its affiliates, in each of (i), (ii), (iii) or (iv) of or by Recology, its affiliates, or its or their respective employees, officers, directors, owners, agents or subcontractors (all the foregoing collectively, the “Recology Parties”). 7.2 Other Provisions. A party seeking indemnity shall notify the other party of any Claim promptly after becoming aware of such Claim, provided, however, that no delay in providing such notification shall affect Recology’s indemnity obligations, unless (and only to the extent that) Recology has been actually prejudiced by such delay. Recology shall not settle any Claims without City’s prior written consent, which shall not be unreasonably withheld, conditioned, or delayed, unless the settlement involves only the payment of money damages paid in full by Recology; does not impose an injunction or other equitable relief upon the indemnitees subject to the settlement; does not constitute an admission of wrongdoing by any such indemnitee; and results in the unconditional release of such indemnitees with respect to all claims for which indemnity is sought. The party seeking indemnity shall provide, to Recology and its counsel, reasonable access to its employees, property and records reasonably related to the claim (excluding records protected by the attorney-client privilege or the work-product doctrine).

Staff Report
CITY OF SAN BRUNO
DATE: September 8, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Alex D. McIntyre, City Manager
PREPARED BY: Matt Lethin, Police Chief
SUBJECT: Consider Adoption of an Ordinance Entitled “An Ordinance of the City Council of the City of San Bruno Amending Chapter 6.48 of the San Bruno Municipal Code Regarding Penalties for False Alarms” BACKGROUND:
On August 25, 2026, the City Council introduced and approved the first reading of an ordinance amending Chapter 6.48 of the San Bruno Municipal Code regarding false alarms. As part of the same action, the City Council adopted a resolution establishing administrative penalties for repeated false alarms and adopted a resolution authorizing the Police Chief to execute a non- standard agreement with PMAM Corporation to administer the City's false alarm program.
The ordinance modernizes the City's false alarm regulations by clarifying alarm-user responsibilities, converting the existing false alarm assessment from a cost-recovery fee to an administrative penalty, extending the evaluation period for repeated false alarms from 180 days to 365 days, and providing additional enforcement tools for locations that generate repeated false alarms.
DISCUSSION:
The ordinance is presented for second reading and adoption. No changes have been made since the first reading.
If adopted, the ordinance will take effect in 31 days in accordance with state law. The administrative penalty schedule and agreement with PMAM Corporation were approved by the City Council on August 25, 2026, and no further action on those items is required as part of this second reading.
FISCAL IMPACT:
There is no fiscal impact.
ENVIRONMENTAL IMPACT:
The proposed action is not a project subject to the California Environmental Quality Act (CEQA) because it does not have the potential to result in a direct or reasonably foreseeable physical change in the environment.

8 ORDINANCE NO. ____
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN BRUNO AMENDING CHAPTER 6.48 OF THE SAN BRUNO MUNICIPAL CODE REGARDING
PENALTIES FOR FALSE ALARMS
THE CITY COUNCIL OF THE CITY OF SAN BRUNO DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 6.48.010 (Fee determination) of Chapter 6.48 (False Alarms) of the San Bruno Municipal Code is amended and replaced in its entirety to read as follows:
Section 6.48.010 False alarms prohibited.
A. The city council finds and determines that responses to false alarms by the city can result in a significant expenditure of police department time and resources and increased costs to the public for law enforcement services. The council, therefore, finds that it is necessary and appropriate for the city to impose penalties for responses to false alarms on the persons responsible for such alarms.
B. Each alarm user has a duty to take all reasonable steps to prevent false alarms.
Reasonable steps are maintaining the alarm system in good working order, providing the necessary service to prevent malfunctions, and controlling use of the alarm system to activate only when there is evidence of a crime or other activity on the premises that warrants the assistance of the city’s police department on the premises.
C. An alarm user shall not have two or more false alarms within a three hundred- and sixty-five-day period. After the second false alarm from an alarm system during a three hundred- and sixty-five-day period, the police department may send a warning notice to the alarm user, which shall state the date and time of the second false alarm, and that subsequent false alarms occurring within the three hundred- and sixty-five-day period are subject to a false alarm fee pursuant to this section.
D. The false alarm fee is an administrative penalty for violating this section
6.48.010. The amount of the false alarm fee shall be established by resolution of the city council.
E. The following terms are defined for the purposes of this chapter as follows:
(i) “Alarm officer” means the officer or employee of the city or its police department, having responsibility for responding, or for causing the response, to an activated alarm system.
(ii) “Alarm user” means any person who purchases, leases, contracts for, or otherwise obtains and operates an alarm system or contracts for the servicing or maintenance of an alarm system at the alarm user’s premises. (iii) “False alarm” means the notification to the city’s police department concerning the activation of an alarm system when there is no evidence of a crime or other activity that warrants the assistance of the city’s police department on the premises, as indicated by the investigation of a police officer on the scene or by the lack of a police report filed by the occupant or property owner, and no individual who was on or near the premises or who viewed a video communication from, or live-monitored the premises called for the dispatch or confirmed a need for police response. “False alarm” shall not include an alarm for which the city’s police department personnel do not actually arrive at the 50 of 52 ATTACHMENT 1
2 3
9 3
8 alarm location, or any alarm caused by earthquakes, severe storms or other extraordinary circumstances determined by the alarm officer to be clearly beyond the control of the alarm user.
F. Pursuant to California Government Code Section 38771, the city council hereby declares three or more false alarms during a three hundred- and sixty-five-day period to be a nuisance.
SECTION 2.Section 6.48.0600 (Conduct) of Chapter 6.48 (False Alarms) of the San Bruno Municipal Code is amended to read as follows (deleted language shown with strike through and added language shown with underline):
At the date set for hearing, the city manager shall hear all competent testimony relating to the granting of the permit imposition of false alarm fees and may continue the hearing to a fixed date.
