Fiscal Impact: Yes. Mid-year budget adjustments are an increase of $1 .9 million for revenues and an increase of $2.5 million for expenditures. General Fund revenues and expenditures have no effect on the General Fund fund balance since both increase $1.4 million.
Summary: A mid-year review is done by staff to identify and adjust for budget differences from the adopted budget. This review includes both revenue and expenditure items and budget adjustments are presented in Attachment A.
Background: Revenue and expenditure budgetary variances are identified by staff and information is provided to and reviewed by Finance and a listing of proposed adjustments for any changes to the budget is prepared.
Discussion: The 2nd Quarter financial report for the General Fund is completed and an overview of the City's financial condition is complete. In conjunction with this mid-year report, a review of all revenue and expenditure line items was conducted by all City departments to identify and adjust for budget variances. A majority of the adjustments are related to strong revenue amounts due to higher than anticipated activity levels.
As part of the "3-2-1 Strategy", these revenues are being used to facilitate a one-time payment on the public safety pension UAL for $1.0 million. Other expenditure adjustments are to address some state law impacts and higher energy costs for electric and gas which were noted as part of our mid-year review.
After the proposed adjustments, the General Fund unassigned fund balance is projected to total approximately $5.0 million at the end of FY 2021-22. The General Fund revenue increases will be utilized to increase pension payments, offset cost increases caused by mostly external impacts. The operating position (excluding the effects of one-time revenues and expenditures) is an increase of approximately $1.1 million) and summarized as follows:
$ 72.0 million
70.8 million
Revised $ 1.2 million
Detailed revenue adjustments are presented in the attached schedule for the General Fund and for Other Funds. Total revenue increases are $1.9 million, with a General Fund increase of $1,380,860 and Other City funds revenue increases of $538,140.
General Fund revenue increases include tax revenue increases of $675,000 from Finance Agenda Report 3-1-22 / 6D-1

APPROVAL OF FIRST AMENDMENT TO THE PROFESSIONAL CONSUL TANT SERVICES AGREEMENT WITH CSG CONSULTANTS, INC., FOR CONTRACT PLANNING SERVICES.
Fiscal Impact: Yes. There are sufficient funds available in account# 001-433-43890 due to salary savings from Planning Division vacancies beginning of the Fiscal Year (July 1, 2021 through June 30, 2022).
Summary: Staff is requesting approval of the First Amendment to the Professional Consultant Services Agreement between the City of San Clemente and CSG Consultants, INC. (CSG), to continue providing contract planning services for the Planning Division. This Amendment increases the contract amount from $50,000 to $130,000 (an increase of $80,000) and eliminates the expiration date of the contract.
Discussion: The Planning Division has been utilizing CSG to provide contract planning services while the Division was in recruitment period to fill two vacancies. The Division has had the two vacancies since the beginning of the Fiscal Year (July 1, 2021 through June 30, 2022). Those vacancies have recently been filled, however the Planning Division is still in need of CSG's planning services to maintain customer demand. This contract Amendment will allow the continued use of contract planners until the newly hired staff can be trained. The contract planners are critical in maintaining customer demand and service level expectations. The temporary contract planners will continue to assist staff with processing minor discretionary permits, plan checks, counter assistance, zoom appointments, phone support, and other similar tasks. The cost of the temporary contract planners is offset by salary savings from the Planning Division vacancies beginning of the Fiscal Year until now.
Recommended
Actions: STAFF RECOMMENDS THAT the City Council approve and authorize the City Manager to execute the First Amendment to the Contract between the City of San Clemente and CSG Consultants to provide contract planning services. This Amendment increases the contract amount from $50,000 to $130,000 (an increase of $80,000) and eliminates the expiration date of the contract.

1sr AMENDMENT TO CONTRACT C19-035 WITH LAZ PA.RKING FOR TROLLEY OPERATIONS Yes. LAZ Parking is requesting an increase in driver hourly pay to ensure that they can maintain full and qualified staffing. The increase in operations costs for the standard summer season would be $93,509. However, ninety percent of operations are reimbursed through a Measure V grant with OCTA, so the City's increased share would be the remaining ten percent of the increase, $9,351. If the Council opts to extend the season, the total increase for 2022 operations would be $173,242, and the City's share would be $17,325.
Staff recommends that Council authorize the requested driver pay increase ta maintain service levels for 2022 Trolley operations. Staff has also secured authorization for a minor amendment to the City's Measure V grant scope allowing for services starting as early as April to be reimbursed by OCT A. Staff recommends that the Council authorize Saturday and Sunday service beginning on April 2nd.
LAZ Parking has operated the City's trolley services since 2019. During the 2021 season, they approached City staff with a request to increase the hourly rate within the contract. However, the City had concerns about fielding the increase during the uncertainty of the 2020-2021 budget year, and LAZ agreed to maintain service levels for the remainder of the season. The City Council did agree, however, to an initial rate increase for the, "extended season" between October and December. The base rate in 2021 was $51.19, and the extended season rate was $58.95. With a new season approaching, and the staffing environment still tenuous, LAZ has requested that the City consider a further increase to avoid disruption of Trolley service during the 2022 season. The City's contract with LAZ Parking expires after the 2022 season. Staff will seek out proposals for ongoing operations by the end of the calendar year.
The existing contract, C19-35, established an hourly rate of $52.41 for the 2022 season. LAZ is proposing a rate of $64.40. This amounts to a 23% increase over the baseline. It is a 9% increase above the rate paid during the 2021 extended season period, authorized by the City Council in October 2021.
The existing Schedule of Performance includes Trolley services from May 27 through September 25, which amounts to 6,550 anticipated service hours. Staff recommends modifying the start date to April 2 for Saturday and Sunday operations until daily operations commence on Friday, May 27th. This would add 528 service hours (22 hours per weekend for 8 additional weekends on three Trolleys). Staff also Economic Development Agenda Report 3-1-22 / 6G-1
' Agenda Report Page2
recommends repeating the successful extension period between Labor Day weekend and New Year's Day. That extension period would entail up to 924 hours. If the Council opts for both the early start and the late finish scenarios, an additional 1,452 hours would be authorized beyond the baseline of 6,550. The combine total would be 8,002 hours.
At the proposed rate, the baseline (6,550 hours) would cost $428,260. Again, the City would be responsible for 10% of costs that are within the grant amount from OCT A.
That grant is for $1,298,000 covering the 2019-2022 seasons; the City's contract with LAZ covers services not to exceed $1,340,308. So far, the City has used $585,751, and there is $712,249 remaining within this contract. Table 1 below demonstrates that actual costs will remain within the grant budget even with the proposed increase in hourly rate and with the expanded service hours.
Table 1: 2019-2022 Trolley Costs

One element of that amendment was to allow flexibility with unused Trolley funding while operations were limited due to the COVID-19 pandemic. The City's surplus funds as referenced above can be used to supplement this year's budget or in subsequent years. Because of this flexibility, the City can cover both the increased contractor costs and the additional hours of operation for the 2022 season while maintaining the 10/90 cost share with OCT A.
Future Discussion
Staff does have concern about sustainability of the program moving forward. The OCTA operations allocation in the Measure V grant increased 3% annually until this 2022 season. However, it appears that the 2020 Trolley continuation grant will reduce OCTA's funding for the program for the 2023-:-2027 term. Future operational years may . require a greater percentage share by the City, especially if labor costs continue to rise. Staff has requested a review of the ongoing funding by OCTA to determine whether additional grant revenues for future Trolley seasons is possible.
The contract with LAZ Parking ends after this 2022 season. Staff will seek proposals for operations beyond 2022, and return to Council at a future date with an operator recommendation as well as an update regarding OCTA grant funding levels. 3-1-22 / 6G-2

The Council will also have ttie opportunity to review a Zoning Amendment at their March 15, 2022 regular meeting which is proposed to include a fee similar to that used with the Temporary Outdoor Dining Program in 2021. This fee may also provide ongoing revenues to supplement the Trolley's operational expenses.

RECYCLED WATER EXPANSION UPDATE, PROJECT No. 17 407.

Fiscal Impact: None at this time.
Summary: Upon request of the City Council at its November 16, 2021 Meeting, staff is providing information related to potential recycled water expansion within Rancho San Clemente.
Background: The City has a long history of producing and utilizing recycled water dating back to the 1950s at the City's Municipal Golf Course. In the 1990s as part of the City's Water Reclamation Plant (WRP) Expansion, recycled water tertiary treatment was included as part of the project which allowed the City to expand its customer base to include Bella Gallina Golf Course. To investigate additional opportunities to deliver recycled water to existing irrigation customers, the City completed the 1994 Recycled Water Master Plan, which concluded recycled water expansion to the majority of the City was unfeasible.
In 2007, an updated Recycled Water Master Plan was developed with a reduced and more feasible potential project scope that would expand recycled water distribution only to the majority of the largest irrigation customers. Following the updated master plan and utilizing federal and state grant funding and a low interest State Revolving Fund Loan, the City completed a $25.1 million expansion of its recycled water system from approximately 2012 through 2016. The project included: the addition of nine miles of pipelines, conversion of a two million gallon reservoir to recycled water and expansion of the WRP tertiary treatment capacity from 2.2 to five million gallons per day. The infrastructure expansion allowed for the conversion of approximately 150 metered irrigation areas from potable irrigation to recycled water. Recycled water customers account for approximately 16% of the City's overall water demand and utilize approximately 1,400 acre feet per year of recycled water. The City's customer use of recycled water reduces the City's need for imported water from the Metropolitan Water District of Southern California (Metropolitan).
To complete the onsite customer retrofits, the City provided design and permitting assistance while its customers funded the onsite irrigation conversions. To reduce the financial burden on its customers, the City established a loan program to assist them with onsite retrofit costs by providing a zero percent interest rate loan with payback made through the difference in potable and non-potable rates. Essentially, the customer would continue to pay at the potable rate until the loan was repaid.
Utilities Agenda Report 3-1-22 I 9A-1
Agenda Report Page 2
Fortunately, as customers began retrofitting, Metropolitan created a new grant incentive program for onsite retrofits that funded the majority of customer conversions, and only one customer needed to utilize the City's loan program.
Upon completion of this first recycled water expansion, the City Council approved funding to evaluate an additional expansion in FY 2017. RMC Engineering, currently known as Woodard & Curran, evaluated potential expansion areas, which include: Los Mares Lateral, Linda Lane Park, Bahia Park, Forster Ranch, Presidential Heights, Los Molinas and Rancho San Clemente. Based on the preliminary study, the City Council funded the design and construction of the Recycled Water Expansion Phase II for Los Mares Lateral, Linda Lane Park and Bahia Park in Fiscal Years 2018 and 2020. The design is still being completed by City staff, as the project has been delayed due to staffing challenges associated with the pandemic.
Discussion: In an effort to better characterize expansion opportunities, given current costs and additional irrigation water use data in Rancho San Clemente, Woodard & Curran updated its analysis in January 2022. Based on the update, there are three potential projects that may be considered and are further defined within the attached presentation.
1. Project A: Calle Pastadero - The project includes installation of meters by the City and onsite facilities by the Rancho San Clemente Master Association (RSCMA), including: a pump station, mainline extension to connect to the existing meters and on site retrofit of the irrigation system. Due to limited pressure in the City's existing recycled water line that currently serves Rancho San Clemente Park at one of the City's highest service areas within the pressure zone, RSCMA would need to boost the pressure through a pump station to serve two of their meters on Calle Pastadero. The availability of recycled water throughout the day and night would also require some evaluation, since overnight irrigation demands for Rancho San Clemente Park and Lobo Elementary School will reduce available capacity for the potential expansion during peak irrigation times. It is possible that some of the RSCMA slopes would need to be irrigated during non-peak daytime hours for areas where there is low probability of human interaction with the irrigation system.
The estimated recycled water demand in this area is 14 acre feet per year with the • City's cost of $31,000 and RSCMA retrofit and pump station costs are approximately $283,000. Calle Pastadero services could also be added on to Project C: Vista Montana to reduce or eliminate the need for RSCMA to pay for and maintain an onsite pump station. Although, the cost to the City to extend the pipeline as part of Project C is over $1 million.
2. Project B: Montego - This project involves an additional 1,600 linear feet of new six inch recycled water main from the intersection of Vista Montana and Calle del Cerro to Montego Homeowners Association. The estimated recycled water demand in this area is 8 acre feet per year at a cost to the City of approximately $939,000. Onsite customer retrofit costs are to be determined.
3. Project C: Vista Montana - This is the largest potential expansion to serve customers along Calle de! Cerro and Avenida Vista Montana. Due to the elevations of the service area well above the City's existing Bella Collina service area for 3-1-22 I 9A-2
Agenda Report
Recommended
recycled water, either the construction of a new City-owned pump station or an interconnection agreement with Santa Margarita Water District that would permit the City to use their existing Pico Pump Station is required. Approximately 9,700 linear feet of six inch pipeline is needed from the intersection of Avenida Pico and Avenida La Pata to Avenida Vista Montana. The estimated recycled water demand in this area is 14 acre feet per year at a cost to the City of approximately $6,334,000. The demand in this area could increase due to potential subassociation demands that have not been evaluated.
The potential interconnection agreement for recycled water with Santa Margarita Water District is still pending due to the City's recycled water containing slightly higher total dissolved solids (TDS). Trussell Engineers is evaluating a project to reduce TDS and improve the City's recycled water quality through a side stream microfiltration and reverse osmosis system at the WRP. The project location, cost and impacts to rate payers is being evaluated. If the project and interconnection are cost effective, the Pico Pump Station could be modified to provide service from the City's system or from the regional Trampas Canyon Recycled Water Reservoir, where the City may also seek to purchase storage capacity as part of the agreement. The interconnection agreement is anticipated for City Council consideration prior to the end of the current fiscal year.
While opportunities exist within Rancho San Clemente and other areas within the City, staff is recommending further coordination with RSCMA regarding potential expansion Project A: Calle Pastadero and to continue evaluating potential additional irrigation demands from its sub-associations for Option C: Vista Montana. In addition, staff is recommending the preparation of an update to the 2007 Recycled Water Master Plan to evaluate the current availability of recycled water to potential service areas and the feasibility of pursuing a combination of grants and loans that may help offset impacts to rate payers. Given the delay in the design and construction of Recycled Water Expansion Phase II and the potential for grant funding in the near future, staff is recommending utilizing a portion of the existing expansion funding to complete the Recycled Water Master Plan Update. Additional funding to offset the master plan cost will be requested as part of the FY 2023 GIP Budget process.
Action: STAFF RECOMMENDS THAT the City Council direct staff to coordinate with the Rancho San Clemente Master Association and its sub-associations to evaluate future recycled water expansion opportunities, and to update the 2007 Recycled Water Master Plan utilizing funding from Recycled Water Expansion Phase II, Project No. 17407.

County Library Analysis
Objective
To provide Council with an overview of the current model for providing Library Services within the City of San Clemente and to provide options for providing those services in the future.
Background and Discussion
Library Services
Library services for San Clemente residents are provided by Orange County Public Libraries (OCPL}, currently 013erating within a portion of a City-owned building on Avenida Del Mar in the downtown area of San Clemente. T.he building is owned by the City and OCPL is r~sponsible for the interior furnishings and operations of the Library portion of the building. With the completion of construction of the new Senior Center, the building space formerly used for Senior Services was made available for expansion of the Library. In December 2010, the concept plan for the Library expansion was approved by the City Council. The bid for construction closed February 5, 2014 and construction is tentatively scheduled to begin in April of 2014.
OCPL is a dependent special district governed by the Orange County Board of Supervisors, with libraries distributed throughout the County. The unincorporated area and twenty-four cities, including the City of San Clemente, are served by OCPL. There are a total of thirty-four OCPL libraries and support facilities in Orange County, serving approximately 1.6 million residents. The County's ten remaining cities operate thirty libraries for about 1.6 million residents within their incorporated boundaries. These libraries are funded and managed separately by the respective cities and are not part of the OCPL system.
OCPL is the third largest local library system in California; only the LA County and LA City systems are larger. A professional-technical library staff operates the libraries under the direction of a unified management team. Library Advisory Board members represent the jurisdictions that are a part of the system, and various "friends" organizations and volunteers support specific libraries within individual communities.
Property tax is the primary funding source for OCPL, with approximately 86% of all OCPL revenue derived from this source. Property tax revenue fof OCPL fof Fiscal Year (FY} 2014 is projected at $37.8 million. Comparatively, total property taxes for OCPL for FY 2013 were $36.5 million and for FY 2012 were $36 million.
Out of the 25 cities that participate in property tax funding for the OCPL, San Clemente is the fourth (4th} highest contributor. To provide some perspective of the property tax payments that OCPL has deducted from San Clemente, below you will find a summary of payments for FY 2001/2002 to 2013/2014:

Funding _
Property taxes are the primary funding source for OCPL (Attachment A). San Clemente property tax payers contribute $0.001833 per property tax dollar to OCPL. This contribution is sent directly from the County to OCPL. This revenue is restricted to use for library services.
Property Tax derived from the City of San Clemente for OCPL for FY 2014 is projected at $2.33 million. Comparatively, total property tax derived from the City of San Clemente for OCPL for FY 2013 was $2.27 million, and for FY 2012 was $2.24 million. Since FY 2002, the FY 2014 projected payment reflects an average of 8% annual growth. Please refer to Attachment A, this reflects a 13 year contrioution model for all participating agencies.
As of June 30, 2013, OCPL reported and ending fund balance available of $13.S million, an increase or about $7 million, or 52% higher in comparison with the prior year. This was due to savings and increased revenue that was contributed to a number of factors: salaries and benefits decreased by $1.7 million, reduct"ion in extra help, supplies and services came in 26.9% less than budget, County wide cost allocation was $522k less than budgeted and most significant was the additional $6 million in unexpected revenue from the dissolution of the redevelopment agency.
In October of 2013 the Library Advisory Board, presented cities with Financial Planning Assumptions (FPA) for the next five years, Attachment B. It is important to note, the FPA reflects an increase in revenues of 0.5% over the next five years, while the adjusted reserve balance remained static, at $5.74 million. This is due to the set aside taken out to address the City of Irvine's recalculation.
Branch Allocation Formula
Funding is "allocated" to various libraries within OCPL based on a "Branch Allocation Formula".
The formula allocates the total funding for branch operations to individual city libraries based on a formula that takes three factors into account, on a weighted basis. The three factors - property tax revenue (ability to pay), circulation (library use), and population, - are weighted 40%, 30%, and 30%, respectively. As of May, 2012 the "Branch Allocation Formula" for San Clemente is as follows:
221
3-1-22 / 98-3
County Library Analysis
The funding amounts determined through the Branch Allocation Formula are compared to the actual costs to operate the applicable facility in order to determine if there is an excess or deficit. If the funding allocation is more than the cost to operate the facility (meaning there is an excess) the applicable City is considered a "donor" city. San Clemente's allocations exceed the cost of operating its library, so San Clemente is considered a "donor" city. Based on OCPL's FY 2012-13 Allocation Plan with "Robust" Circulation, San Clemente exceeded our allocation by $372,583.
For purposes of the Branch Allocation Formula methodology, the amount allocated only includes branch operating costs and does not include system wide costs or reserves. System wide costs are "centralized expenses" that support branch library operations but are not I applied directly to a specific branch library operating cost. These costs include administrative departments such as HR, IT, Accounting and Purchasing. Additionally, these costs include system wide information system maintenance and upgrades, system wide book/collection purchases, and system wide insurance and other overhead costs, among others. Since these costs are not included in the Branch Allocation Formula, it makes it difficult for member cities to know the total actual cost of the services received, and the related excess or deficit for the applicable City.
Future Alternatives
Considering that the City of San Clemente is funding more than the services it is receiving, alternatives to the County operating model could be explored.
1. The City could request that OCPL allocate funding (outside the Branch Allocation Formula) on either a one-time or continuing basis, provided the appropriation is for libraries and related services. This allocation could be used by OCPL to provide additional hours or services at the San Clemente library.
2. The City could request that OCPL refund San Clemente's "excess funding" directly to the City to be used for some type of alternative library service within the City.
3. The City could withdraw from the OCPL system, redirecting Library property tax revenue directly to the City, and operate and maintain the Library with City staff. The City would be required to use any redirected revenue to provide Hbrary services. 222

County Library Analysis
Conclusion
City Library Services are provided by Orange County Public Libraries (OCPL). Since the City property tax payers are paying more into the system than the services that are being received, City Council may want to explore alternatives to the current service model.
Recommendations
Staff requests that the City Council provide direction on exploring alternative models for Library services.
Fiscal Impact of Recommendations
The fiscal impact would be determined by which alternative models the City Council would like to explore.
Council Action (5-0)
The City Council approved the following actions:
Staff to provide direction on the process to withdraw from the County Library system. Staff is to remain cognizant of the fact that January 1 is the deadline to provide the Board of Supervisors with an intent to withdraw from the County system. 223

AGENDA REPORT
SAN CLEMENTE CITY COUNCIL MEETING
Meeting Date: March 1, 2022
Agenda Item i2l,C _ Approvals:
City Manager ,t;,,. '9> Ip
Dept. Head --- Attorney C i,J
Finance
Department: City Manager
City Attorney
Prepared By: Scott Smith, City Attorney
Subject: ADOPT AN ORDINANCE AMENDING SECTION 2.04.040 OF THE SAN CLEMENTE MUNICIPAL
CODE RELATING TO COMPENSATION FOR CITY COUNCIL MEMBERS
Fiscal Impact: If approved, the maximum annual increase in the stipend for each Councilmember would be $5,760 (from the General Fund).
Summary: The City Council asked at its February 15·, 2022 meeting that this item be brought back for Council consideration at this meeting. Government Code Section 36516(a)(4) allows the adjustment of City Councilmembers' monthly stipends by ordinance, not to be effective until the beginning of the next elected term of any one of the Councilmembers. The item provides the means for the City Council to adjust the monthly stipend its members receive, which has not been adjusted since 1998.
Background: The San Clemente City Council last adjusted its members' compensation rate by Ordinance No. 1217, adopted November 18, 1998, which amended San Clemente Municipal Code Section 2.04.040 to set the Council's monthly compensation to $400.
Government Code Section 36516(a)(4} permits a local government to, by ordinance, increase its members' base compensation by five percent (5%) per calendar year since such base compensation was last increased. This five percent index is not compounded annually, per a 2006 opinion of the State Attorney General. ( See 89 Ops.
Cal. AttyGen.159, 161-62 (2006).)
November 18, 2022 will mark 24 calendar years since the enactment of Ordinance No. 1217. Accordingly, the current stipend multiplied by five percent, multiplied by 24, allows for a $480 increase to each stipend, resulting in a new monthly stipend of up to $880 for each Councilmember.
This calculation can be represented as follows:
[(Current stipend x 5%) x (24 years)]+ Current stipend= New stipend [(400 X 0.05) X (24)] + 480 = 880
The attached Ordinance, if enacted, will amend San Clemente Municipal Code Section 2.04.040 to adjust the current monthly stipend from $400 to $880, effective after the Councilmembers elected in 2022 commence their terms. (Pursuant to City Council Agenda Report

Government Code 36516.5, increases in stipends cannot take effect until the new term of Councilmembers elected after passage of the increase.) As three of the current Councilmembers' terms expire in November 2022, the Ordinance would not come into effect until the beginning of terms of those elected at that time, whereupon it would apply to all sitting Councilmembers.
Action: STAFF RECOMMENDS THAT the City Council consider the following action:
1. Introduce for first reading Ordinance No. __ , entitled AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA AMENDING SECTION 2.04.040 OF THE SAN CLEMENTE MUNICIPAL CODE RELATING TO COMPENSATION FOR CITY COUNCIL MEMBERS.

1 3-1-22 / 9C-3
Section 3. The City Council finds that this ordinance is not subject to the requirements of California Environmental Quality Act ("CEQA") for the following reasons:
