A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ALLOWING FOR THE USE OF OCEAN LIFEGUARDS AT ITS PUBLIC SWIMMING POOL FACILITIES WHEREAS, on September 13, 2022, the Governor of California signed and approved Assembly Bill 1672 (“AB 1672”) titled “Public Swimming Pools: Lifeguards” allowing for local public agencies that are certified by the United States Lifeguard Association (“USLA”) to use qualified lifeguard personnel to provide lifeguard services at a public swimming pool; and WHEREAS, the City of San Clemente (“City”) owns and operates year round public swimming pool facilities at the San Clemente Aquatics Center and the Ole Hanson Beach Club; and WHEREAS, a significant reduction in pool operating hours has resulted from an ongoing decline in the number of City Pool Lifeguard employees correlating to a difficult labor market and a national lifeguard shortage; and WHEREAS, the City Marine Safety Division is certified by USLA and maintains an active membership that meets the minimum qualifications to provide lifeguard services at a public swimming pool based on the exemptions provided in AB 1672; and NOW, THEREFORE, The City Council of the City of San Clemente does hereby resolve as follows:
Section 1. Ocean Lifeguards who meet the qualifications provided for within the USLA certifications may act as pool lifeguards to immediately fill gaps in pool scheduling that are adversely affecting the City’s aquatic facility operations and public availability.
Section 2. This Resolution shall remain in effect for 12 months from its adoption date in accordance with the terms AB 1672.
Section 3. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
