FIRST AMENDMENT TO
PROFESSIONAL CONSULTANT SERVICES AGREEMENT FOR
WASTEWATER COST-OF-SERVICE STUDY
This First Amendment to Professional Consultant Services Agreement for professional
FINANCIAL CONSULTING SERVICES TO BE PERFORMED IN CONNECTION WITH A WASTEWATER COST-OF-SERVICE STUDY consulting services (this “First Amendment”) is made and entered into on this ____day of ________, 2022, by and between the CITY OF SAN CLEMENTE, a California municipal corporation (“City”), and RAFTELIS FINANCIAL CONSULTANTS, INC. (“Consultant”).
R E C I T A L S:
A. City and Consultant entered into that certain Professional Consultant Services Agreement for FINANCIAL CONSULTING SERVICES TO BE PERFORMED IN CONNECTION WITH A WASTEWATER COST-OF-SERVICE STUDY (the “Agreement”) on February 19, 2019.
B. City and Consultant desire to amend the Agreement in the manner provided herein.
C O V E N A N T S:
Section 1.1 of the Agreement is hereby amended by extending the Agreement through May 31, 2023.
Section 1.2 of the Agreement is hereby amended by adding services to provide for continued financial consulting services to be performed in connection with a Wastewater Cost-ofService study. In addition to the services to be performed by Consultant as referenced in Exhibit A to the Agreement, Consultant shall also perform those services described in Exhibit “A” to this First Amendment, which exhibit is attached hereto and incorporated herein by this reference.
Section 3.1 of the Agreement is hereby amended by increasing the not to exceed amount from Fourty Six Thousand Seven Hundred and Eight Dollars ($46,708) to Sixty One Thousand Nine Hundred and Sixty Eight Dollars ($61,968) for the remainder of the Agreement.
Except as expressly amended by this First Amendment, the remaining portions of the Agreement shall remain in full force and effect.

Subject: San Clemente Wastewater Rate Study
Dear Mr. Rebensdorf,
As of the last billing cycle, for the month of July, the remaining budget for the San Clemente Wastewater Rate Study was approximately $1,000. The project was started in January of 2019 but postponed due to Covid. Starting and stopping the project contributed to the budget depletion as more meetings are required. We also updated the model with FY 2022 and 2023 revenue and expenses and reserve balances so that the financial plan and rates are up to date which was not part of the original scope.
We estimate the following tasks are required to complete the study:
1) Finalize rates with staff,
2) Prepare a presentation for City Council,
3) Prepare draft and final reports,
4) Prepare a public hearing presentation and present at a public hearing.
If you feel additional items may be required, please let me know. The proposed fee and hours to complete that study are shown in the fee table below. Note that we assumed the meetings are virtual however we could assume in-person meetings if desired. Please let me know if you have any questions.
