FIRST AMENDMENT TO
PROFESSIONAL CONSULTANT SERVICES AGREEMENT FOR
MARINE SAFETY RELOCATION STUDY
This First Amendment to Professional Consultant Services Agreement for the MARINE SAFETY RELOCATION STUDY (this “First Amendment”) is made and entered into on this ____day of ________, 20__, by and between the CITY OF SAN CLEMENTE, a California municipal corporation (“City”), and HMC Architects (“Consultant”).
R E C I T A L S:
A. City and Consultant entered into that certain Professional Consultant Services Agreement for the MARINE SAFETY RELOCATION STUDY (the
“Agreement”) on June 1, 2021.
B. City and Consultant desire to amend the Agreement in the manner provided herein.
C O V E N A N T S:
Section 3.3.1. of the Agreement is hereby amended by increasing the contract amount from Eighty Seven Thousand and Five Hundred Dollars ($87,500) to One Hundred Twenty Two Thousand and Five Hundred Dollars ($122,500), and increase of Thirty Five Thousand Dollars ($35,000). In addition to the services to be performed by Consultant as referenced in Exhibit A to the Agreement, Consultant shall also perform those services described in Exhibit “A” to this First Amendment, which exhibit is attached hereto and incorporated herein by this reference.
Section 3.1.2. of the Agreement is hereby amended to extend the Term of the Agreement from June 15, 2023, to June 15, 2024.
Except as expressly amended by this First Amendment, the remaining portions of the Agreement shall remain in full force and effect.

AMENDMENT NO. 1 TO OWNER/ARCHITECT AGREEMENT
That certain Owner/Architect Agreement (Agreement) dated June 1, 2021, by and between City of San Clemente (Owner) and HMC Group (Architect), with respect to providing Architectural Services is hereby amended, modified, and revised as follows:
Scope of Work:
Additional services for ongoing architectural consultation beyond the originally anticipated scope included in executed agreement for the Marine Safety Headquarters project.
Architect's Compensation:
Fee for the additional scope of work listed above shall be on an hourly basis not-to-exceed ThirtyFive Thousand Dollars ($35,000.00), without prior written approval per Attachment “A”, HMC Hourly Rate Schedule.
Reimbursable Expenses:
Reimbursable out of pocket costs related to Owner requested printing plotting (including 3D plotting), and other expenses are in addition to hourly compensation for the services described above and the expense of transportation in connection with authorized out-of-town travel, including mileage. These expenses shall be billed by the Architect to the Owner at one and one-fifteenth (1.15) times the expense incurred by the Architect.
