FIRST AMENDMENT TO
AGREEMENT FOR TREE MAINTENANCE SERVICES
This First Amendment to the Agreement for Tree Maintenance Services (this “First Amendment”) is made and entered into on this _____ day of February, 2023, by and between the City of San Clemente, a California municipal corporation (“City”), and West Coast Arborists, Inc., a California Corporation (“Contractor”).
Recitals
City and Contractor entered into that certain Agreement for Tree Maintenance Services (the “Agreement”) on April 20, 2021.
City and Contractor desire to amend the Agreement increasing the total compensation not to exceed amount to One Million Three Hundred Fifty-Five Thousand Dollars ($1,355,000) for Tree Maintenance Services through June 30, 2025.
Covenants
Section 3: Section 3.3.1 of the Agreement titled “Compensation” is hereby amended to read:
3.3.1 Compensation.
The total compensation shall not exceed One Million Three Hundred Fifty-Five Thousand Dollars ($1,355,000).
Except as expressly amended by this First Amendment, the remaining portions of the Agreement shall remain in full force and effect.
